{"id":544140,"date":"2026-07-11T08:12:18","date_gmt":"2026-07-11T08:12:18","guid":{"rendered":"https:\/\/www.newsbeep.com\/ie\/544140\/"},"modified":"2026-07-11T08:12:18","modified_gmt":"2026-07-11T08:12:18","slug":"e6m-ballsbridge-penthouse-owner-sues-over-temperatures-reaching-33c","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/ie\/544140\/","title":{"rendered":"\u20ac6m Ballsbridge penthouse owner sues over temperatures reaching 33c"},"content":{"rendered":"<p>A  <a target=\"_blank\" rel=\"noopener noreferrer nofollow\" href=\"https:\/\/www.irishexaminer.com\/news\/courtandcrime\/\">High Court<\/a> dispute over alleged overheating of a \u20ac6m penthouse apartment in Dublin is to go to mediation, a judge has been told.<\/p>\n<p>Aideen O&#8217;Byrne bought the Lansdowne Place, Ballsbridge, apartment \u2014 marketed in 2017 as &#8220;thought to be the most expensive in Ireland&#8221; \u2014 for some \u20ac6.16m and moved in in 2021.<\/p>\n<p class=\"\">She has claimed that due to a failure to maintain or repair the district heating system, temperatures in her apartment have reached &#8220;unbearable&#8221; highs of 33C degrees.<\/p>\n<p class=\"\">Temperatures in lobby areas have been recorded to reach 29C degrees, she claimed.<\/p>\n<p class=\"\">She has sued the developers, Copper Bridge C 2015 ICAV, and engineers O&#8217;Connor Sutton Cronin and Associates Ltd.<\/p>\n<p><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/www.newsbeep.com\/ie\/wp-content\/uploads\/2026\/07\/5152067_6_articleinlinemobile_Berkeley_20Sun_20Room_1_.jpg\" alt=\"Temperatures in lobby areas have been recorded to reach 29C degrees, she claimed. Copper Bridge said it had experts who &#8220;flatly contradict&#8221; the claims of Ms Byrne and also that it spent three years trying to address her claims without any progress.<\/p>\n<p class=\"\">The case has been before the court on a number of occasions to deal with a number of matters, including discovery.<\/p>\n<p class=\"\">On Friday, Gavin Mooney, for Ms O&#8217;Byrne, told Mr Justice Brian Cregan that pleadings had closed, most discovery had been agreed, and it had been agreed between the parties to go to mediation on October 12.<\/p>\n<p class=\"\">The court heard outstanding discovery issues had been paused until then.<\/p>\n<p class=\"\">The judge said he wanted the parties to &#8220;put their minds together&#8221; and use the 10 weeks between now and the mediation to resolve outstanding issues on discovery.
