Solicitors working in the criminal legal aid system in Dublin have repeated calls on the Minister for Justice to engage in talks aimed at resolving the current dispute over the new payment scheme.<\/p>\n
The call followed a meeting in Dublin today during which solicitors agreed to escalate their protest with complete work stoppages on two days this week and three days next week.<\/p>\n
The action will affect court hearings in Dublin tomorrow and Thursday and next Tuesday, Wednesday and Thursday.<\/p>\n
A statement issued after the meeting said the new scheme had been imposed without “meaningful consultation” to discuss the “flaws in the new scheme”.<\/p>\n
Solicitors say the new scheme expects them to represent clients with no absolute guarantee of payment, regardless of the duration of the case or the volume of charges.<\/p>\n
A spokesperson said it was “with great regret that solicitors have decided to implement a shutdown of cases on Wednesday and Thursday of this week in the Criminal Courts of Justice. Every solicitor would much prefer to be in court representing their clients but that is simply not possible under the new legal aid scheme”.<\/p>\n
The statement went on to say that solicitors are available at any time work towards an agreement adding: “The Minister’s intransigence is the major obstacle in the way of progress and resolution.”<\/p>\n

Criminal court system in Mayo has ‘ground to a halt’<\/p>\n
A Castlebar based solicitor has said that all solicitors in Mayo have resigned from the legal aid panel.<\/p>\n
Gary Mulchrone, a solicitor in criminal law at Thomas J Walsh & Company, said solicitors in Mayo had already declined to provide services in court.<\/p>\n
Speaking on RT\u00c9’s News at One, he said: “Mayo has now become, unfortunately, a legal desert in terms of access to justice for people in the criminal defence system.<\/p>\n
“Sixty-seven cases were listed yesterday in the Circuit Criminal Court in Castlebar. Over the last three weeks, we’ve had three jury panels in and been sent home with no work to do. It has ground to a halt.”<\/p>\n
He said he believed the situation was replicated in several other counties.<\/p>\n
“Cases are being delayed. Victims are not getting their cases heard and clients are not getting their matters disposed of.<\/p>\n
“And I think the reason it has reached this point is that solicitors have felt extremely strongly in relation to their opposition to the minister’s proposals that came into effect without proper negotiation and engagement from the 1st of July.”<\/p>\n

Please review their details and accept them to load the content.Manage Preferences<\/a><\/p>\n The new scheme came into effect on 1 July and brings in a flat fee payment per client.<\/p>\n Under the old system, a solicitor was paid for each court appearance by a single person, starting at \u20ac239.38 for the first appearance, and then \u20ac59.86 for each subsequent hearing.<\/p>\n The new system replaces that with a \u20ac520 flat fee.<\/p>\n Mr Mulchrone said he disagreed with Minister for Justice Minister Jim O’Callaghan’s contention that the flat fee reform was evidence-based on data in a report commissioned for the department.<\/p>\n “We’re talking about a report that wasn’t published on the department’s website until a week or so ago. And prior to that, we were told that the report contained a lot of data and evidence in relation to supporting the minister’s position.<\/p>\n “But having seen that report, there are three examples cited of what the minister cites as concerns. And that is out of a total of 350,000 cases reviewed, representing 0.0005% of the total cases analysed.<\/p>\n “I don’t think that’s evidence-based reform and the data does not support it. And if it does exist, I’d call upon the minister to release that data.”<\/p>\n Mr Mulchrone said that the department needs to engage with the Law Society to address the issues.<\/p>\n “It’s unprecedented in modern times that the Department of Justice would not liaise efficiently and extensively with the Law Society, which is the representative body of almost 13,000 solicitors in this country.<\/p>\n “The lack of engagement has been startling. And I would just simply call on the minister to get around the table – talk to people. There’s a team in the Law Society ready to negotiate.<\/p>\n “The alternative is a system which increasingly is grinding to a halt and it’s not going to be viable for solicitors to work in this area.”<\/p>\n Read more
