For most of Ireland\u2019s history, travelling by sea was the only way to transport anything to and from the island, shaping the country we are today. Inevitably, it means there are numerous shipwrecks found off the coast. There are <a href=\"https:\/\/www.archaeology.ie\/advice-and-support\/locate-a-monument-or-wreck\/wreck-viewer\/\" target=\"_blank\" rel=\"nofollow noopener\">more than 18,000 known and potential shipwrecks off the coast of Ireland<\/a>, ranging from the early 16th century to the modern day.<\/p>\n<p>These ships range from galleons and large warships, such as the wreckage of the <a href=\"https:\/\/www.rte.ie\/archives\/2017\/0629\/886402-spanish-armada-cannon\/\" target=\"_blank\" rel=\"nofollow noopener\">Spanish Armada<\/a> from the 16th century, to merchant ships, ships from World War One, and all the way to modern vessels. The general laws governing shipwrecks fall under the <a href=\"https:\/\/www.irishstatutebook.ie\/eli\/1930\/act\/2\/enacted\/en\/html\" target=\"_blank\" rel=\"nofollow noopener\">National Monuments Acts 1930 to 2014<\/a>, which protect archaeological heritage, monuments and historic sites. &#8220;This is on course to be overhauled by the <a href=\"https:\/\/www.irishstatutebook.ie\/eli\/2023\/act\/26\/enacted\/en\/html\" target=\"_blank\" rel=\"nofollow noopener\">Historic and Archaeological Heritage and Miscellaneous Provisions Act 2023<\/a>, which is being brought in on a progressive basis,&#8221; addd McCarthy.<\/p>\n<p>The 2023 Act will bring in updated protections for historic wrecks and underwater archaeological objects, which will come into effect soon. It\u2019s when a wreck is 100 or more years old that the legislation changes. The most famous wreck on the island is the <a href=\"https:\/\/en.wikipedia.org\/wiki\/RMS_Lusitania\" target=\"_blank\" rel=\"nofollow noopener\">Lusitania<\/a> off the coast of Cork.&#8221;<\/p>\n<p>The Lusitania was a British ocean liner which was <a href=\"https:\/\/www.rte.ie\/centuryireland\/articles\/lusitania-sunk-by-german-torpedo\" target=\"_blank\" rel=\"nofollow noopener\">sunk by a German U-boat in 1915 during World War I<\/a>, and claimed the lives of over 1,000 people. Its final resting place is off the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Old_Head_of_Kinsale\" target=\"_blank\" rel=\"nofollow noopener\">Old Head of Kinsale<\/a>, but it was only in 1995 that then Minister for Arts, Culture and Gaeltacht, <a href=\"https:\/\/en.wikipedia.org\/wiki\/Michael_D._Higgins\" target=\"_blank\" rel=\"nofollow noopener\">Michael D. Higgins<\/a>, made it subject to an <a href=\"https:\/\/www.archaeology.ie\/policy\/underwater-cultural-heritage\/\" target=\"_blank\" rel=\"nofollow noopener\">Underwater Heritage Order<\/a>.<\/p>\n<p>&#8220;This essentially introduced exclusion zones, restrictions on diving, fishing restrictions, restrictions on anchoring, and restrictions on salvage,&#8221; says McCarthy. &#8220;The Lusitania is interesting in that it had been in international waters before the change in legislation. What goods were traded, how people lived and travelled, the technology available at the time, and information about significant historical events such as the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Spanish_Armada\" target=\"_blank\" rel=\"nofollow noopener\">Spanish Armada<\/a>.<\/p>\n<p>Yet a modern shipwreck brings different qualities, usually resulting from an industrial failure or a tragedy. Considering that ships are usually bigger and transport more cargo, not to mention more fuel, preventing environmental damage becomes the priority.<\/p>\n<p>&#8220;The overwhelming aspect of salvage these days is in respect to environmental damage, because any shipwreck will cause that,&#8221; McCarthy says. &#8220;They all have reserves of oil in them, and something like a super tanker would be an international incident. The main one is the <a href=\"https:\/\/www.lloyds.com\/market-resources\/salvage-arbitration-branch\/lloyds-open-form\" target=\"_blank\" rel=\"nofollow noopener\">Lloyds Open Form<\/a>, which is the standardised form contract for a proposed marine salvage operation. Within it is the <a href=\"https:\/\/www.lloyds.com\/market-resources\/salvage-arbitration-branch\/scopic\" target=\"_blank\" rel=\"nofollow noopener\">SCOPIC clause<\/a>, which permits salvage rewards to those who act to limit damage and avert environmental catastrophe.<\/p>\n<p>Likewise, the country the ship is registered in is under international law of the sea, and still has primacy in regulating a ship. Regulations like the <a href=\"https:\/\/www.imo.org\/en\/about\/conventions\/pages\/nairobi-international-convention-on-the-removal-of-wrecks.aspx\" target=\"_blank\" rel=\"nofollow noopener\">Nairobi International Convention on the Removal of Wrecks<\/a> put strict liability on the owner of and on the flag state of the vessel to remove the wreck. Ireland has yet to sign this convention, and so it is dependent upon old legislation, specifically the <a href=\"https:\/\/www.irishstatutebook.ie\/eli\/1993\/act\/34\/enacted\/en\/html\" target=\"_blank\" rel=\"nofollow noopener\">Merchant Shipping Salvage and Wreck Act 1993<\/a>, and the <a href=\"https:\/\/www.irishstatutebook.ie\/eli\/1996\/act\/35\/enacted\/en\/html\" target=\"_blank\" rel=\"nofollow noopener\">Liability of Ship Owners Act 1996<\/a>.<\/p>\n<p>That said, sometimes wrecks fall into grey areas and are harder to decipher. McCarthy gives a recent example of the <a href=\"https:\/\/en.wikipedia.org\/wiki\/MV_Alta\" target=\"_blank\" rel=\"nofollow noopener\">MV Alta<\/a>, an abandoned ship that <a href=\"https:\/\/www.rte.ie\/brainstorm\/2020\/0303\/1119882-ballycotton-ghost-ship-alta\/\" target=\"_blank\" rel=\"nofollow noopener\">eventually washed up on shore at Ballycotton<\/a>, in Co Cork during <a href=\"https:\/\/www.rte.ie\/news\/ireland\/2020\/0215\/1115476-storm-dennis-weather\/\" target=\"_blank\" rel=\"nofollow noopener\">Storm Dennis<\/a> in 2020.<\/p>\n<p class=\"youtube-container tpe\" data-embed=\"youtube\" data-id=\"LFHcBJKzeT4\">\n<p>From Dronehawk, MV Alta Ghost Ship &#8211; 7 year Anniversay<\/p>\n<p>As there was no success in tracking down its owners, it was eventually left on the coast, as disturbing the wreck would put salvagers and the local environment at risk.
