A young father who raped a 15-year-old girl during a teenage birthday party has been jailed for seven years.<\/p>\n
Patrick Faulkner (24) was 18 when he raped the then teenager during a birthday party for another teenage girl. Faulkner denied the charge but was convicted of rape by a jury after a Central Criminal Court trial sitting in Limerick last February.<\/p>\n
Faulkner, with an address at Lower Mallow Street in Limerick city, does not accept the jury verdict and continues to maintain that the schoolgirl consented to the sexual activity.<\/p>\n
At the sentence hearing Lily Buckley BL, prosecuting, told the court that the victim wished to waive her anonymity so that Faulkner can be named.<\/p>\n
Imposing sentence on Monday, Ms Justice Eileen Creedon commended the young woman for her \u201ccourage and honesty\u201d in giving evidence at trial and providing a \u201cvery powerful\u201d victim impact statement.<\/p>\n
She noted that the woman outlined the heavy toll the rape has had on her life and the mental trauma she has suffered as a result. It has impacted her ability to trust others.<\/p>\n
Ms Justice Creedon acknowledged that Faulkner does not accept the verdicts of the jury and maintains that all sexual interactions with the then teenager were consensual.<\/p>\n
She accepted that he had a right to contest the charges against him but said that left \u201cvery little by way of mitigation\u201d available to the court to reduce the headline sentence of eight and a half years.<\/p>\n
Ms Justice Creedon imposed a sentence of seven and a half years taking into account the man\u2019s young age at the time of the offending and his co-operation with the garda investigation. She suspended the final six months of the term for a year.<\/p>\n
Detective Garda Denise Moriarty told the court that on the date of the offence the teenager had been at school and had changed her clothes before going to the party. There was adult supervision at the house for the early part of the evening.<\/p>\n
Det Gda Moriarty said that the victim had consumed some Blue Wkd \u201cand some cans\u201d and there was also \u201csome vodka drink\u201d at the party. She said the victim did not know Faulkner but knew of him as a cousin of hers was friendly with some of his family.<\/p>\n
She said that during the evening Faulkner asked her to go upstairs with him, but she said \u2018no\u2019. Later she went upstairs by herself to charge her phone and he followed her up into a bedroom.<\/p>\n
She told garda\u00ed that they kissed and he then put his fingers inside her. At this point she told him to stop as she was aware that \u201cmatters were getting out of her control\u201d, the garda testified.<\/p>\n
Faulkner closed the door of the bedroom and said to her \u201cdo you wanna ride?\u201d and she said \u2018no\u2019. He then pushed her back.<\/p>\n
Faulkner pulled the gusset of her bodysuit to one side and raped her as she repeatedly told him \u201cstop Patrick\u201d.<\/p>\n
Faulkner ignored these requests and said \u201cI’m nearly done\u201d a number of times. The girl tried to lift him off her, but she was unable. The court heard the victim is of a small build while the defendant is a \u201cstrong, robust\u201d build.<\/p>\n
After ejaculating Faulkner told the girl \u201cI came inside you, you’ve to get the morning after pill\u201d. She later told garda\u00ed that to get rid of him she told him she \u201chad the bar\u201d and she then ran into a bathroom and began crying and told him to go away.<\/p>\n
Snapchat<\/p>\n
Shortly afterwards she ran out of the house but on the way out she told a friend she had been raped. That same night she sent a message into a friend\u2019s Snapchat group called \u201cVirgins XOX\u201d saying \u201cI’m after being raped (by) Patrick Faulkner, I’m bawling\u201d.<\/p>\n
She also said in this group that \u201cI kept telling him \u2018no, get off me\u2019 but he wouldn’t.\u201d<\/p>\n
After his arrest Faulkner told garda\u00ed that the 15-year-old had initiated the sexual activity and that it was all consensual.<\/p>\n
Faulkner has a number of previous convictions including one for harassment. In that offence, committed two months before this rape, Faulkner had approached a girl in a public place on two occasions in July 2020 and asked her to have sex with him for money.<\/p>\n
He was given a suspended sentence of 18 months on November 11th, 2023, at Limerick Circuit Criminal Court. Faulkner also has convictions for public order offences, assault and road traffic offences.<\/p>\n
Patrick O\u2019Sullivan BL, defending, told the court that since this offence his client has married and has had two children and has settled down. Faulkner\u2019s wife testified that he was a good husband and father and a support to her in the care of their young son who has ongoing health issues.<\/p>\n
Victim impact statement<\/p>\n
In her victim impact statement, the complainant said that she was a child when Faulkner raped her.<\/p>\n
\u201cI did not have the emotional tools or life experience to cope,\u201d she said. She said the rape left her struggling with her mental health and that she continues to suffer with flashbacks that come without warning and bring her back to the attack.<\/p>\n
\u201cThe sense of safety I once had was taken from me,\u201d she said. She outlined that she has self-harmed and also attempted suicide.<\/p>\n
She said she is working hard to heal but that it is \u201ca long painful process\u201d.<\/p>\n
\u201cComing forward and talking about what happened has been extremely difficult. The truth matters and what happened to me was wrong,\u201d she said.<\/p>\n
Det Gda Moriarty confirmed to Ms Buckley that during the trial it was put to the victim, under cross-examination by the defendant’s legal team, that she had consented and had never told the defendant to stop.<\/p>\n
The transparent dress, which would have had a bodysuit \u201cbuilt into it\u201d, worn by the victim was produced in court and the victim was asked if she was wearing underwear, the court heard.<\/p>\n
