THE FAMILY OF\u00a0Irish fashion designer Martha Nolan-O\u2019Slatarra, who died on a\u00a0yacht in Montauk in New York a year ago, have launched a lawsuit against the boat\u2019s owner.\u00a0<\/p>\n
The legal action was filed this week\u00a0in the Supreme Court of New York by the deceased\u2019s mother\u00a0Elma Nolan, who is based in Carlow, and a New York-based lawyer who is handling\u00a0Ms Nolan-O\u2019Slatarra\u2019s estate.\u00a0<\/p>\n
According to court filings, the lawsuit against Christopher Durnan of Garden City in New York alleges wrongful death in the case of\u00a0Ms Nolan-O\u2019Slatarra and also alleges that he \u201cintentionally and wrongfully assaulted\u201d her.\u00a0<\/p>\n
The court filing indicates that the alleged \u201cwrongful conduct\u201d or Mr Durnan took place on or about 4 and 5 August last year aboard a vessel at a yacht club at 32 Star Island Road, Montauk.<\/p>\n
The lawsuit alleges \u201cgross negligence and wanton conduct\u201d by the defendant which it is claimed caused\u00a0Ms Nolan-O\u2019Slatarra\u2019s death.\u00a0<\/p>\n
The lawsuit is seeking a range of damages, including damages for pain and suffering prior to Ms Nolan-O\u2019Slatarra\u2019s death, and seeks a default judgment of $50 million (\u20ac43.3 million) should the defendant not respond to the summons.<\/p>\n
Speaking in an article published in New York Magazine published last year, Robert Holdman, a lawyer for\u00a0Mr Durnan, said that the pair had been on his client\u2019s boat together. He said his client was \u201cdistraught\u201d following\u00a0Ms Nolan-O\u2019Slatarra\u2019s death and that he described her as \u201ca good friend\u201d.\u00a0<\/p>\n
Martha Nolan-O\u2019Slatarra was originally from Carlow and was a graduate of UCD\u2019s Smurfit Business School before moving to Manhattan where she lived for a number of years.<\/p>\n
She was founder of fashion brand East x East,\u00a0a resort-wear brand that had\u00a0opened a pop-up store in Montauk the month before she died.\u00a0<\/p>\n
Following her death,\u00a0Suffolk County Police said that an initial autopsy conducted on the deceased \u201cdid not show evidence of violence\u201d but that the final cause of death was not established.\u00a0<\/p>\n
