\n\tNetflix<\/a> has filed a motion<\/a> to strike and dismiss Tyra Banks<\/a>\u2018 defamation lawsuit<\/a> against Netflix over her portrayal in the streamer\u2019s America\u2019s Next Top Model\u00a0docuseries,\u00a0entitled Reality Check<\/a>.<\/p>\n

\n\tBanks filed a lawsuit against Netflix in June, where she argued she was falsely represented in the docuseries, arguing that her comments were \u201cstripped of context and\u00a0reassembled to support a false and defamatory narrative unrelated to what she\u00a0actually expressed.\u201d She participated in a three-and-a-half hour long interview, outlining that just 16 minutes of her footage was used for Reality Check.<\/p>\n

\n\tNetflix\u2019s motion, which was filed Friday, argues that Banks\u2019 complaints are \u201cabout ordinary editorial decisions.\u201d <\/p>\n

\n\tThe motion confirms that Banks sat for a three-and-a-half-hour interview, adding that \u201cAfter the interview, [Banks] signed an agreement granting the filmmakers the right to edit her interview footage, acknowledging she had \u2018no right to review or approve\u2019 the finished documentary, and releasing claims arising from it \u2014 including for defamation and false light. She now alleges the documentary, Reality Check: Inside America\u2019s Next Top Model (the \u2018Documentary\u2019), defames her \u2014 not because it says anything false about her, but because she wanted advance notice of what another interviewee would say, more of her interview included, and her perspective presented differently.\u201d <\/p>\n

\n\tIn Banks\u2019 lawsuit, she specifically cited how she was shown in the docuseries responding to cycle two contestant Shandi Sullivan\u2019s alleged sexual assault during filming. She was shown being asked \u201cYou remember the story with Shandi?\u201d in Reality Check, to which she responded \u201cum,\u201d before the screen cuts to black, creating a \u201cdevastating and deliberate\u201d implication that Banks couldn\u2019t remember the assault, she argued in her suit. <\/p>\n

\n\t\u201cAnd when Banks is asked whether she remembers Sullivan\u2019s story, the Documentary shows her answer: \u2018I do remember her story.\u2019 A documentary expressly showing Banks remembering does not imply that she forgot,\u201d Netflix\u2019s motion reads in response. <\/p>\n

\n\t\u201cBanks understands editorial discretion. She created, hosted, and executive produced 24 seasons of ANTM, making the same kinds of editorial decisions she now attacks \u2014 what footage to include, what to omit, and how to present competing narratives,\u201d the motion continues. \u201cThe Documentary simply turned that editorial lens back on ANTM and Banks. Her disagreement with the resulting portrayal does not make it defamatory.\u201d<\/p>\n

\n\tA Netflix spokesperson told ABC News<\/a> in a statement Friday they plan to \u201cvigorously defend\u201d the docuseries and those behind it. <\/p>\n

\n\t\u201cDirectors Daniel Sivan and Mor Loushy are respected documentarians who thoroughly interviewed the people behind America\u2019s Next Top Model,\u201d the statement reads. \u201cTyra Banks was given the opportunity to speak openly about her experience and the creators fairly presented her perspective alongside those of every other participant shown in this documentary. We stand behind Reality Check: Inside America\u2019s Next Top Model and will continue to vigorously defend it.\u201d<\/p>\n
