There are also the <a href=\"https:\/\/phhp.ufl.edu\/2023\/06\/12\/tips-for-adding-arts-into-your-wellness-routine\/\" rel=\"nofollow noopener\" target=\"_blank\">social<\/a> <a href=\"https:\/\/www.artgallery.nsw.gov.au\/media-office\/black-dog\/\" rel=\"nofollow noopener\" target=\"_blank\">benefits<\/a>,<br \/>\nand the importance of <a href=\"https:\/\/www.un.org\/en\/about-us\/universal-decla%20ation-of-human-rights\" rel=\"nofollow noopener\" target=\"_blank\">connection to culture<\/a> on a societal level.<\/p>\n<p>Importantly, we need to value art in all its forms \u2013 even when it\u2019s confronting or politically risky. When artists take risks, they add value to society. They may express deeply felt convictions, or progress public discourse by challenging common beliefs. <\/p>\n<p>But taking risks means being left exposed. The question then is: to what extent are arts organisation responsible for protecting artists?<\/p>\n<p>An intro to governance<\/p>\n<p>Australian organisations operate in three sectors with distinct governance obligations. <\/p>\n<p>Private companies require at least one <a href=\"https:\/\/www.aicd.com.au\/board-of-directors\/performance\/structure\/board-size.html\" rel=\"nofollow noopener\" target=\"_blank\">director<\/a>, while a public company \u2013 a corporation open to investment by the public \u2013 must have at least three <a href=\"https:\/\/www.governanceinstitute.com.au\/news_media\/directors-duties\/\" rel=\"nofollow noopener\" target=\"_blank\">directors<\/a>. A director makes major decisions on a company\u2019s behalf and holds all legal responsibility.<\/p>\n<p>Incorporated non-profits require \u201c<a href=\"https:\/\/www.acnc.gov.au\/tools\/topic-guides\/responsible-person\" rel=\"nofollow noopener\" target=\"_blank\">responsible people<\/a>\u201d. These are generally members of the governing board or committee who agree to act in the best interests of the non-profit, including through responsible management of finances.<\/p>\n<p>There are also <a href=\"https:\/\/www.ato.gov.au\/businesses-and-organisations\/not-for-profit-organisations\/getting-started\/in-detail\/types-of-dgrs\/a-k\/cultural-organisations\" rel=\"nofollow noopener\" target=\"_blank\">cultural statutory authorities<\/a>, established by specific acts of state or federal parliament. These have board members appointed by government. Examples include funding bodies such as Creative Australia, and arts organisations such as the <a href=\"https:\/\/www.portrait.gov.au\/content\/national-portrait-gallery-becomes-statutory-authority\" rel=\"nofollow noopener\" target=\"_blank\">National Portrait Gallery<\/a> and the <a href=\"https:\/\/artgallery.wa.gov.au\/\" rel=\"nofollow noopener\" target=\"_blank\">Art Gallery of Western Australia<\/a>.<\/p>\n<p>      Read more:<br \/>\n      <a href=\"https:\/\/theconversation.com\/would-sidney-nolan-be-cancelled-for-painting-ned-kelly-today-thats-what-creative-australia-has-done-to-khaled-sabsabi-249952\" rel=\"nofollow noopener\" target=\"_blank\">Would Sidney Nolan be cancelled for painting Ned Kelly today? That\u2019s what Creative Australia has done to Khaled Sabsabi<\/a><\/p>\n<p>The importance of the board<\/p>\n<p>In Australia, boards have become the dominant governing structure for arts organisations seeking legitimacy and government funding. <\/p>\n<p>Boards provide a way to manage business while being guided by an organisation\u2019s own rules and values. They will also, ideally, amplify a diverse range of voices to allow for robust debate. <\/p>\n<p>Today, corporate board structures are a notable feature of even <a href=\"https:\/\/co3.org.au\/our-people\/\" rel=\"nofollow noopener\" target=\"_blank\">small<\/a> and <a href=\"https:\/\/form.net.au\/our-people\" rel=\"nofollow noopener\" target=\"_blank\">medium<\/a> non-profit arts organisations. Board members may have skills in finance, law or marketing \u2013 which can be advantageous for growing an organisation. <\/p>\n<p>However, tensions around the makeup of boards \u2013 which might render organisations somewhat corporate in their approach \u2013 reveal fault lines around how to manage risk and freedom of expression, and what artists can expect of the companies that employ them. <\/p>\n<p>We saw these problems play out at Adelaide Writers Week <a href=\"https:\/\/theconversation.com\/masterclass-in-poor-governance-what-was-the-boards-role-in-the-end-of-adelaide-writers-week-273357\" rel=\"nofollow noopener\" target=\"_blank\">earlier this year<\/a>, when dozens of artists withdrew to <a href=\"https:\/\/theconversation.com\/as-authors-abandon-adelaide-writers-week-after-cancelling-of-randa-abdel-fattah-is-free-speech-in-tatters-273020\" rel=\"nofollow noopener\" target=\"_blank\">protest the board\u2019s decision<\/a> to rescind its invitation to Palestinian-Australian author Randa Abdel-Fattah.<\/p>\n<p>Within days, Writers Week director Louise Adler resigned, board members stepped down, and the event was cancelled.<\/p>\n<p>Jo Dyer, former director of Writers Week, <a href=\"https:\/\/www.artshub.com.au\/news\/features\/arts-board-management-101-arts-leaders-reveal-whats-changed-2838456\/#new-pressures-arts-boards-must-address\" rel=\"nofollow noopener\" target=\"_blank\">has said<\/a> board-level risk management is no longer confined to finances:<\/p>\n<p>it is much more about managing the different perspectives that different stakeholders have on key political, and often very febrile, issues. [\u2026] And you cannot fix these problems that emerge by silencing the artists on whom you rely, and whose work is the raison d\u2019\u00eatre of the organisation itself.<\/p>\n<p>As a statutory body, the Adelaide Festival is vulnerable to <a href=\"https:\/\/www.theguardian.com\/australia-news\/2026\/jan\/14\/randa-abdel-fattah-defamation-concerns-notice-peter-malinauskas-sa-premier\" rel=\"nofollow noopener\" target=\"_blank\">political interference<\/a>, despite having strong artistic representation on its board. <\/p>\n<p>Externalised risks<\/p>\n<p><a href=\"https:\/\/creative.gov.au\/research\/artists-workers-economic-study-professional-artists-australia\" rel=\"nofollow noopener\" target=\"_blank\">Fewer than one in four<\/a> professional artists in Australia work for a salary or wage in their primary artistic occupation. Instead, they\u2019re more likely to be hired to work on a project (such as an actor in a theatre company season), or be paid for a work (such as an artist being paid a gallery fee to display their art).<\/p>\n<p>Because artists are often employed as contractors, and therefore <a href=\"https:\/\/www.ato.gov.au\/businesses-and-organisations\/hiring-and-paying-your-workers\/employee-or-independent-contractor\/difference-between-employees-and-independent-contractors\" rel=\"nofollow noopener\" target=\"_blank\">don\u2019t have the same rights<\/a> as employees, they tend to assume certain risks from arts organisations. <\/p>\n<p>For one thing, the organisation may only pay for the presentation or performance. It might not pay for the work that produces the performance, including the hours of practice required to be performance-ready. This means organisations can defray the financial risk of employing an artist whose work outputs wax and wane. <\/p>\n<p>Work structured in this way also externalises creative risk. Artists as contractors can easily be cut loose when they behave or express themselves in a way that\u2019s criticised by paying audiences or donors. <\/p>\n<p><a href=\"https:\/\/theconversation.com\/the-mso-and-lattouf-rulings-are-seemingly-at-odds-where-does-this-leave-free-speech-at-work-287288\" rel=\"nofollow noopener\" target=\"_blank\">We saw this<\/a> in the recent freedom-of-speech cases involving concert pianist Jayson Gillham, who lost his court battle against Melbourne Symphony Orchestra, and broadcast journalist Antoinette Lattouf, who won hers against the ABC.<\/p>\n<p>These structures are unsustainable, as they push risk onto those who can least afford it. Too often we have seen large arts organisations reactively fold in the face of criticism, rather than holding their nerve and leaning on their <a href=\"https:\/\/theconversation.com\/whats-behind-the-spate-of-arts-leadership-departures-in-australia-perhaps-a-mismatch-of-values-238583\" rel=\"nofollow noopener\" target=\"_blank\">institutional value<\/a>.<\/p>\n<p>Cultural value needs courageous advocates<\/p>\n<p>Professor of cultural value, <a href=\"https:\/\/demos.co.uk\/wp-content\/uploads\/files\/Culturalvalueweb.pdf\" rel=\"nofollow noopener\" target=\"_blank\">John Holden<\/a>, has described the value that institutions accrue as trusted civic spaces and agents of what the public wants. <\/p>\n<p>As long-term beneficiaries of public support, arts organisations have significant influence in cultural debates. But this influence can be eroded when they withdraw support from artists \u2013 which is easily done with casualised labour.  <\/p>\n<p>To better protect artists from financial and legal risk, arts boards must slow down their decision making, while withstanding media scrutiny.<\/p>\n<p>Moreover, diverse representation on boards \u2013 of cultural as well as professional backgrounds \u2013 is necessary to produce robust discussion that will help protect artists\u2019 rights.<\/p>\n<p>It\u2019s true that arts organisations are bigger than any one individual, but they cease to exist without their artists.<\/p>\n","protected":false},"excerpt":{"rendered":"How we value the arts comes down to much more than looking at the sector\u2019s economic contributions.
