{"id":616317,"date":"2026-09-06T13:58:32","date_gmt":"2026-09-06T13:58:32","guid":{"rendered":"https:\/\/www.newsbeep.com\/ie\/616317\/"},"modified":"2026-09-06T13:58:32","modified_gmt":"2026-09-06T13:58:32","slug":"what-a-nile-crocodile-case-means-for-trumps-dc-building-projects","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/ie\/616317\/","title":{"rendered":"What a Nile crocodile case means for Trump\u2019s DC building projects"},"content":{"rendered":"<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmtnfyx3d00063b6rxmiq1buf@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The Supreme Court\u2019s 5-4 decision backing President <a href=\"https:\/\/www.cnn.com\/2026\/08\/31\/politics\/supreme-court-white-house-ballroom-trump\" rel=\"nofollow noopener\" target=\"_blank\">Donald Trump\u2019s massive ballroom<\/a> at the White House is already playing into challenges over his other pet projects and has renewed a debate over a legal doctrine tied to an abandoned California ski resort and crocodiles in Egypt.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmtnfyx3d00073b6rolu3naxl@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Over the objection of <a href=\"https:\/\/www.cnn.com\/2026\/09\/01\/politics\/john-roberts-ballroom-dissent-supreme-court\" rel=\"nofollow noopener\" target=\"_blank\">Chief Justice John Roberts<\/a> and the court\u2019s three liberals, five conservative justices last week barred a historic preservationist from suing over the $400 million ballroom for \u201caesthetic\u201d reasons. The Trump administration has rushed to use that decision to shut down lawsuits against the president\u2019s other construction plans for the nation\u2019s capital.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmtnfyx3d00083b6r5ao24p3a@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            At the heart of some of those cases are questions about the scope of \u201caesthetic standing,\u201d or the idea that Americans have a right to sue in some instances based on changes that deprive them of the enjoyment of seeing a landscape, for instance, or an endangered animal.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmtnfyx3d00093b6rkk9687ij@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Trump argues that critics suing over his projects have not met that seemingly subjective standard. And when it came to his ballroom on the White House grounds, five justices agreed.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmtnfyx3d000a3b6r1g48dg0h@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThis court has not found standing in circumstances like these before,\u201d the court wrote Monday in a 5-4, <a href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/26a203_2b8e.pdf\" target=\"_blank\" rel=\"nofollow noopener\">unsigned decision<\/a>, which allowed Trump to continue work that is already well underway. \u201cWe have repeatedly held that mere offense, disagreement, or distaste does not qualify as a concrete and particularized injury.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmtnfyx3d000b3b6rfgbm9gkz@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In the days since, the Justice Department quickly inserted that Supreme Court order into lower courts reviewing the president\u2019s <a href=\"https:\/\/www.cnn.com\/2026\/09\/03\/politics\/trump-arch-construction-start\" rel=\"nofollow noopener\" target=\"_blank\">250-foot\u202farch<\/a> proposed on a bank of the Potomac River and an effort to remodel a <a href=\"https:\/\/www.cnn.com\/2026\/09\/03\/politics\/lorax-trump-dc-golf-course-renovation\" rel=\"nofollow noopener\" target=\"_blank\">public golf course<\/a> in Washington, DC.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmtnfyx3d000c3b6r3il8u35z@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Other cases, such as the administration\u2019s beleaguered effort to renovate the <a href=\"https:\/\/www.cnn.com\/2026\/09\/03\/politics\/reflecting-pool-contractor-algae\" rel=\"nofollow noopener\" target=\"_blank\">Lincoln Memorial\u202fReflecting Pool<\/a> and to paint an iconic <a href=\"https:\/\/www.cnn.com\/2026\/07\/29\/politics\/trump-eisenhower-executive-office-building-paint-test\" rel=\"nofollow noopener\" target=\"_blank\">Gilded Age\u202fgovernment building<\/a> near the White House, have also raised questions about standing. On Friday, federal court reviewing the Reflecting Pool case <a href=\"https:\/\/www.documentcloud.org\/documents\/28601758-reflecting-pool-order-re-ballroom-ruling\/\" target=\"_blank\" rel=\"nofollow noopener\">ordered a new round<\/a> of briefing in light of the ballroom ruling.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmtnfyx3d000d3b6rdlbwce89@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The challenge with aesthetic standing, said Robert Pushaw, a professor at Pepperdine University Caruso School of Law, is that \u201caesthetic injury is a gut call.\u201d That\u2019s because, he said, aesthetics\u202fare a matter of personal taste and inherently subjective.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmtnfyx3d000e3b6r3ujjhoeo@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Because it came in an emergency docket case, the court\u2019s decision Monday technically has limited precedential value.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmtnfyx3d000f3b6rjpylzxj8@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cBut the case does indicate where five conservative justices are going, and they might be inclined in a later case to either reject aesthetic injuries or limit them to plaintiffs challenging environmental laws,\u201d Pushaw said. \u201cEither way, however, plaintiffs suing over alleged legal violations will have great difficulty\u202festablishing standing.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmtnfyx3d000g3b6rv2fnhx22@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Around the same time the Supreme Court was tightening standing rules for federal courts in the 1970s, the justices introduced the idea of aesthetic standing in a case challenging a Disney ski resort in Sequoia National Park.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmtnfyx3d000h3b6rcxaehbvb@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In that case, Sierra Club v. Morton, Justice Potter Stewart wrote that \u201caesthetic and environmental wellbeing\u201d are \u201cimportant ingredients of the quality of life\u201d and are not less deserving of legal protection than \u201ceconomic wellbeing.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmtnfyx3d000i3b6rq9ooy4oo@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The plaintiff in that case, the court ruled, ultimately did not have standing to sue. (The ski resort was nevertheless later abandoned.)\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmtnfyx3d000j3b6rm0g3heiv@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In his dissent Monday, Roberts also cited a 1992 decision challenging foreign aid for a project that wildlife groups feared would affect the habitat of the endangered Nile crocodile.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmtnfyx3d000k3b6r1cqp7nqe@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In that case, a <a href=\"https:\/\/www.oyez.org\/cases\/1991\/90-1424\" target=\"_blank\" rel=\"nofollow noopener\">6-3 court concluded<\/a> the plaintiffs did not have standing to sue, but not before the court wrote that \u201cof course\u201d the desire to \u201cuse or observe an animal species, even for purely esthetic purposes\u201d is \u201cundeniably a cognizable interest for purpose of standing.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmtnfyx3d000l3b6rkmaokgw9@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            With the court\u2019s rejection of the ballroom lawsuit Roberts wrote, \u201cit now is the case that \u2018I want to look at a crocodile\u2019 can adequately answer the ever critical \u2018what\u2019s it to you?\u2019 question\u201d of standing, but that \u201c\u2018I want to look at the White House\u2019 cannot.\u201d\n    <\/p>\n<p>        Plaintiffs still standing<\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmtnfyx3d000n3b6r8dxig1r9@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            If the historic preservation groups and their members don\u2019t have standing to sue, it\u2019s not clear who does and whether Trump\u2019s projects can be stopped by federal courts.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmtnfyx3e000o3b6rln1kqdv0@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            But groups and experts who have closely followed the growing disputes over Trump\u2019s projects say there remains plenty of room for those challenges to continue despite the high court\u2019s ballroom decision.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmtnfyx3e000p3b6r8e3ji3ur@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Nicolas Sansone with the Public Citizen Litigation Group, and the lead attorney challenging the arch, told CNN the case is different.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmtnfyx3e000q3b6rdb16lmdd@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cIrrespective of how we view that analysis on its own terms, we believe that our case presents meaningfully different facts and we\u2019re prepared to explain those factual distinctions to a district court,\u201d he said in an interview before the administration announced its plans to break ground on the arch.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmtnfyx3e000r3b6r01fwgquo@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Sara Bronin, a George Washington University law professor who served as chair of the Advisory Council on Historic Preservation during President Joe Biden\u2019s administration, said the court\u2019s decision in the ballroom case \u201cmakes it harder, but not impossible, for preservationists to use litigation to force the federal government to follow its own rules to protect historic places.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmtnfyx3e000s3b6rn9x1xvjl@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Plaintiffs challenging those projects, she said, \u201cwill just need to more fully articulate the ways the challenged action harms or will harm them.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmtnfyx3e000t3b6rj6bh7phu@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Trump and his supporters have argued the theory of standing raised by the National Trust for Historic Preservation in the ballroom case would have allowed virtually anyone to stop a government building project just because they didn\u2019t like the design.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmtnfyx3e000u3b6r0hkp6yyk@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThe National Trust for Historic Preservation artificially created standing from one member\u2019s opinion who said the completed building would diminish her personal enjoyment of visiting the White House,\u201d Idaho Attorney General Ra\u00fal Labrador, a Republican, told CNN.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmtnfyx3e000v3b6rj352jdz9@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cActivists cannot be allowed to manufacture standing from personal displeasure and use it to stop any project they oppose,\u201d he said.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmtnfyx3e000w3b6r5q5w8m5v@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Trump has repeatedly said the same, in coarser language, all year.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmtnfyx3e000x3b6rswc4ikmd@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThere is absolutely no argument that a woman walking her dog in the vicinity of the White House has STANDING to stop such a desperately needed National Security structure for the people of the United States of America, as it will provide Presidents, current and future, a secure space to do their jobs, especially when she never saw the Building, because it had not risen, and she had no rendering, or pictures of the Building because they, also, were in the formative stages of production,\u201d the president wrote in a <a href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/117097114321052680\" target=\"_blank\" rel=\"nofollow noopener\">Truth Social post last month<\/a>.\n
