Such conduct may include agreeing who will win a contract, submitting cover bids, taking turns winning contracts or agreeing not to bid,” the watchdog said.

“Effective competition is essential to supporting a strong, resilient and growing Irish economy. When businesses compete fairly, it drives innovation, supports economic growth and helps ensure that businesses, public bodies and consumers get the best possible value for money,” Úna Butler, Commission Member at the CCPC said.

“While searches do not imply that any breach of competition law has occurred, the CCPC remains committed to fully investigating suspected bid-rigging to protect fair competition and consumers,” she added.

The CCPC also operates a Cartel Immunity Programme, in conjunction with the Director of Public Prosecutions (DPP) and an Administrative Leniency programme. Individuals may avoid criminal prosecution and get immunity from, or reductions in, fines if they reveal their involvement in illegal activity and fully cooperate with a CCPC investigation.

The Competition Act prohibits anti-competitive agreements, decisions, and concerted practices, which may include any of the following:

Price fixing, where competitors illegally agree the price for, or discounts on, goods or services.
Market sharing, where competitors illegally agree on which locations each of them can or cannot operate in, or customers to whom they can or cannot sell; or divide locations and/or customers up.
Limiting production, where competitors illegally agree to restrict the amount of goods or services provided to ensure prices remain high.
Bid-rigging/collusive tendering, where competitors illegally agree how they will bid for contracts instead of competing independently. This can lead to higher prices and poorer value for purchasers.

The Competition and Consumer Protection Commission (CCPC) has carried out “dawn raids” of businesses active in the solar…

[5
270747,72,43427,270748,61,60,17216
post-637363","post","type-post","status-publish","format-standard","has-post-thumbnail","category-business","tag-bid-rigging","tag-business","tag-ccpc","tag-dawn-raids","tag-ie","tag-ireland","tag-solar-panels
["GET
