Alleged crime gang leader Daniel Kinahan<\/a> will apply for bail \u201cin due course\u201d in the coming weeks, and will seek disclosure of two foreign investigations, a court heard.<\/p>\n

Kinahan (49) appeared before the Special Criminal Court<\/a> on Monday, having been brought to the court by armed escort from Portlaoise Prison<\/a>.<\/p>\n

He is facing a single charge of \u201cdirecting the activities of a criminal organisation\u201d between October 18th, 2015, and April 6th, 2017, contrary to section 71a of the Criminal Justice Act 2006, as amended.<\/p>\n

The prosecuting barrister Dominic McGinn applied for an adjournment until December 21st to allow for the preparation of the book of evidence.<\/p>\n

He said there is a \u201ccomplex factual matrix\u201d behind the single charge, noting that the \u201cstatement of fact\u201d used to secure to extradition of the Irish citizen from the United Arab Emirates ran to 189 pages.<\/p>\n

The prosecutor said that statement of fact would need to be reduced to a legally submissible document.<\/p>\n

\u201cWe anticipate the book will be prepared by that date,\u201d he said of the December 21st date.<\/p>\n

Judge Caroline Biggs, presiding at the three-judge court, granted the adjournment for the book of evidence to be prepared.<\/p>\n

Solicitor Darragh Mackin of Phoenix Law raised three issues before the court, noting that the timetable of any trial would need to factor in the examination of digital evidence by experts instructed by his client.<\/p>\n

Mackin said he was seeking disclosure of all of the information behind two other international investigations which he said his client was \u201cacquitted\u201d of.<\/p>\n

His solicitor said Kinahan will apply for bail at the High Court \u201cin due course\u201d. It is understood he will apply prior to the December 21st appearance.<\/p>\n

\u201cWe look forward to a trial,\u201d Kinahan\u2019s solicitor said outside the court and pledged to \u201cvehemently defend\u201d the case against his client.<\/p>\n

Mackin said he hoped the trial will be \u201cin the early part of next year\u201d.<\/p>\n

\u201cWe are anxious to make progress. We are comforted that the Book of Evidence will now be served before the end of the year,\u201d he said. \u201cThe rule of law applies to everyone. Nobody is above the rule of law and, equally, nobody is below the rule of law.\u201d<\/p>\n

Kinahan was not asked to speak during the court and appeared wearing a dark grey suit and black shirt.<\/p>\n

He was the first Irish person extradited from the UAE under a new permanent extradition treaty, which came into force last year. He lived in Dubai with his wife and five children for the last 10 years.<\/p>\n

He was arrested in April on foot of an extradition request from Ireland and was in custody there until he was extradited.<\/p>\n
