A HIGH COURT judge has said the head of the Christian Brothers, David Gibson, could have prevented difficulties for former students who were sexually abused and some of the organisation\u2019s own elderly members if he would put himself forward as a nominee in a civil case against the order.<\/p>\n
Ms Justice Mary Rose Gearty said she doesn\u2019t know enough about Canon Law to know whether Brother Gibson would be duty-bound to obey what he was asked to do by the Pope.<\/p>\n
While the judge said she is not suggesting, at this stage, to \u201cserve the Pope\u201d, she added that she would \u201cnot rule it out\u201d.<\/p>\n
\u201cMr Gibson is in a better position to know better than anyone in this court,\u201d she said.<\/p>\n
Ms Justice Gearty made the comment today having previously criticised Brother Gibson for an \u201cobstructive\u201d approach towards civil lawsuits alleging abuse.<\/p>\n
As an unincorporated association, the Christian Brothers cannot be directly sued if it does not provide a legal \u2018nominee\u2019.<\/p>\n
Brother Gibson has refused to act as a nominee for the congregation, leaving litigants to bring legal action against all individual members or former members of the order.<\/p>\n
Difficulties have arisen because although the order has provided names of its former members, the litigants have been unable to find addresses for some.<\/p>\n
As a result, the High Court previously granted permission for the names of more than 300 members or former members to be published in a national newspaper in the hope that they would come forward.<\/p>\n
Those members are not accused of any acts of abuse but are now co-defendants accused of a breach of duty in a civil sexual abuse claim.<\/p>\n
Andrew Nugent BL today successfully argued to join a raft of further defendants to proceedings, bringing the total number to 435. All co-defendants were members of the Congregation of the Christian Brothers between 1 July 1971 and 30 June 1977.<\/p>\n
Mr Nugent said: \u201cThe reason this comes before the court is that Mr Gibson declined to act as a nominee himself, so what we are now obliged to do is to sue everybody involved who was a member of the Christian Brothers during that time period.\u201d<\/p>\n
As it was \u201cunlikely\u201d that Mr Gibson could assist in locating the former members, he said, \u201cwhat we did was to ask for an order to serve former members in the Irish Independent\u201d.<\/p>\n
In granting the application, Ms Justice Gearty said that she would also agree to the serving of an additional warning letter to all members named by Mr Gibson to be sent to the Christian Brothers\u2019 European headquarters in Marino, Dublin.<\/p>\n
Commenting, the judge said it was \u201cvery difficult\u201d for plaintiffs taking \u201cextraordinary steps\u201d to pursue the case.<\/p>\n
She expressed concern at the disturbing of \u201cinnocent old men\u201d, former members of the Christian Brothers, \u201cwho may have a complete defence in these proceedings\u201d.<\/p>\n
Ms Justice Gearty said all of this could have been avoided if Mr Gibson \u201cwould simply allow himself to be nominated in respect of this matter\u201d.<\/p>\n
She continued: \u201cI don\u2019t know enough about Canon Law to know whether Mr Gibson would have any duty to obey what he was asked to do by the Pope, I don\u2019t. I am not suggesting, at this stage, to serve the Pope but I am not ruling it out.\u201d<\/p>\n
Ms Justice Gearty then ordered the matter to be adjourned for four weeks.<\/p>\n
The case was brought by a plaintiff who was abused by Christian Brother Liam Coughlan (90) while the victim attended school in Co Kilkenny in the 1970s.<\/p>\n
