Halle Berry has claimed that a photo of her submitted by her ex-husband Oliver Martinez in their custody battle does not prove his allegations she abused their 13-year-old son, Maceo.

Martinez filed for temporary primary custody of Maceo earlier this month over allegations Berry had “choked” and “physically abused” their child during an alleged altercation in September. The actress has denied the allegations.

In the aftermath, Maceo reportedly claimed in a follow-up court filing that Maceo “immediately” took a photo of Berry after the alleged altercation because he had “been roughed up” in the past and “no one believed him”.

Now, the Oscar-winning actress has fired back at Martinez’s claims about the photo, saying via her lawyers in a responsive declaration that it “does not corroborate abuse, injury, or danger”.

“It simply shows her standing calmly, with her hands in her pockets, several feet away from Maceo,” the declaration read, per the Daily Mail, adding that the picture does not prove Martinez’s “allegation that [Berry] strangled” Maceo.

It comes amid the ongoing fallout of Martinez’s original claims, which led to him being granted temporary primary custody of Maceo earlier this month.

Berry sought to reinstate the 50/50 custody arrangement originally in place, with the next hearing in the case slated for October 16.

The actress was spotted with her son in Los Angeles after the allegations broke, at around the same time she claimed Martinez had influenced Maceo to be “angry and combative” towards her.

Berry’s daughter Nahla Aubry, who she shares with ex-boyfriend Gabriel Aubry, came to her mother’s defence in a declaration filed in Los Angeles Superior Court last week, saying she had “never seen my mum hit, slap, choke, grab, or physically abuse Maceo in any way”.

Berry also denied the allegations via her lawyers, saying the custody filing was “entirely meritless and deliberately misleading”.

“[The] filing is not entirely unexpected from an individual with a well-documented history of erratic, possessive and violent behaviour,” Berry’s lawyer Marina Beck said.

Berry and Martinez, both 60, first met on the set of their film, Dark Tide, back in July 2010. They tied the knot in July 2013 and were married for two years, before splitting in October 2015.

Their extremely contentious divorce took eight years to finalise.
