{"id":114685,"date":"2025-11-04T10:33:16","date_gmt":"2025-11-04T10:33:16","guid":{"rendered":"https:\/\/www.newsbeep.com\/il\/114685\/"},"modified":"2025-11-04T10:33:16","modified_gmt":"2025-11-04T10:33:16","slug":"astronomy-ireland-including-founder-told-to-pay-former-manager-more-than-e10000-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/il\/114685\/","title":{"rendered":"Astronomy Ireland, including founder, told to pay former manager more than \u20ac10,000 \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \">Space commentator David Moore has been held personally liable for multiple employment rights breaches against a former manager at <a href=\"https:\/\/www.irishtimes.com\/tags\/astronomy-ireland\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/astronomy-ireland\/\">Astronomy Ireland<\/a> who said she was forced to quit due to a \u201ctoxic\u201d work environment and alleged \u201cserious financial irregularities\u201d.<\/p>\n<p class=\"c-paragraph paywall \">The club and four members of its management committee, including Mr Moore, have been ordered to pay more than \u20ac10,000 to the ex-employee, Sonya Martin, after she complained of constructive dismissal to the <a href=\"https:\/\/www.irishtimes.com\/tags\/workplace-relations-commission\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/workplace-relations-commission\/\">Workplace Relations Commission<\/a> (WRC).<\/p>\n<p class=\"c-paragraph paywall \">It follows a series of four hearings over nearly 11 months before the employment tribunal. <\/p>\n<p class=\"c-paragraph paywall \">In the case, founder Mr Moore \u2013 known for his media appearances on astronomy and space exploration \u2013 objected repeatedly to being attached to the claim, alleged that Astronomy Ireland was \u201clibelled\u201d and later walked out of a hearing with his solicitor.<\/p>\n<p class=\"c-paragraph paywall \">The WRC heard Ms Martin was hired by Astronomy Ireland as an administrator in 2021 and promoted to manager in March 2022. She resigned in July 2023 following a long-term absence due to workplace stress, citing a \u201ctoxic work environment\u201d, the tribunal was told.<\/p>\n<p class=\"c-paragraph paywall \">\u201cThe whole situation has broken my heart and left me with the realisation that I can never return without further sacrificing my health and moral integrity,\u201d she had told her employer in her resignation letter.<\/p>\n<p class=\"c-paragraph paywall \">Ms Martin went out sick due to workplace stress following what she termed a \u201cheated\u201d meeting in December 2022 when she said she was \u201chorrified\u201d to be told by Mr Moore the club had no board.<\/p>\n<p class=\"c-paragraph paywall \">Alan Crann, for Ms Martin, said his client felt she had been made \u201cparty to a fraud on the State\u201d by Astronomy Ireland as she had made applications for public grant money on the basis it was governed by a board of directors.<\/p>\n<p class=\"c-paragraph paywall \">Ms Martin said she was already suffering from workplace stress following months of pressure while she worked two jobs in the wake of the sacking of a junior employee.<\/p>\n<p class=\"c-paragraph paywall \">After pressure from the committee about the amount of cash in the society\u2019s bank accounts, a junior administrator, Nicole Doyle, raised concerns that Mr Moore was in the practice of \u201cpocketing\u201d speaking fees which were meant to be the society\u2019s main revenue stream, Ms Martin said.<\/p>\n<p><img decoding=\"async\" data-chromatic=\"ignore\" alt=\"David Moore told the WRC he had not received notifications of the commission's hearings\" class=\"c-image\" loading=\"lazy\" src=\"https:\/\/www.newsbeep.com\/il\/wp-content\/uploads\/2025\/11\/EB3OBCYKW73K62HSG5RFK6BYTM.jpg\"   width=\"800\" height=\"1237\"\/>David Moore told the WRC he had not received notifications of the commission&#8217;s hearings <\/p>\n<p class=\"c-paragraph paywall \">Legal submissions from the complainant stated the workplace environment at Astronomy Ireland became \u201cvery disruptive and tense\u201d after Ms Doyle identified \u201cserious financial irregularities\u201d.<\/p>\n<p class=\"c-paragraph paywall \">\u201cThey\u2019d been nitpicking at me for months. It\u2019s no way to treat staff. They\u2019d bullied and harassed me for months on end,\u201d Ms Martin said.<\/p>\n<p class=\"c-paragraph paywall \">Mr Moore claimed last year the society had been \u201clibelled\u201d before the WRC, branding accusations of money going astray and financial irregularities as \u201cfalse\u201d. <\/p>\n<p class=\"c-paragraph paywall \">Legal submissions made on behalf of Astronomy Ireland stated it was an \u201cexemplary employer\u201d which rejected strongly the allegations of bullying and harassment.<\/p>\n<p class=\"c-paragraph paywall \">The tribunal\u2019s taking of evidence on the case stalled in June last year after Mr Moore, who appeared at that stage without legal representation, told WRC adjudicator Jim Dolan that Astronomy Ireland\u2019s status was \u201ciffy in law\u201d as \u201can unincorporated society, to the best of my knowledge\u201d.<\/p>\n<p class=\"c-paragraph paywall \">Mr Dolan said at that point he would have to consider whether \u201cevery single\u201d subscribing member of Astronomy Ireland was answerable for the statutory claims.<\/p>\n<p class=\"c-paragraph paywall \">As the hearings continued into 2025, Mr Moore made repeated objections to being attached personally to the claim and he told Mr Dolan he had not received hearing notifications.<\/p>\n<p class=\"c-paragraph paywall \">\u201cEmails are unreliable,\u201d he said. <\/p>\n<p class=\"c-paragraph paywall \">When Ms Martin\u2019s solicitor, Daniel O\u2019Connell, said the notification was sent by post, too, Mr Moore said: \u201cThe post is unreliable.\u201d<\/p>\n<p class=\"c-paragraph paywall \">Mr Dolan decided to attach as respondents to the statutory complaints all four members of a management committee identified by Mr Moore. <\/p>\n<p class=\"c-paragraph paywall \">They include the club\u2019s treasurer, Seamus Bonner, Mr Moore himself, and two club officers, Willie McDonagh and a woman who cannot be named by direction of the WRC.<\/p>\n<p class=\"c-paragraph paywall \">Mr Moore appeared with a solicitor, Eugene Smartt, at a fourth hearing last May  and renewed his objections to being attached. Mr Smartt argued Ms Martin was out of time to pursue the management committee,<\/p>\n<p class=\"c-paragraph paywall \">Mr O\u2019Connell said: \u201cI don\u2019t think my client should be punished for the fact that Astronomy Ireland haven\u2019t got their house in order.\u201d<\/p>\n<p class=\"c-paragraph paywall \">Mr Dolan said: \u201cMr Moore is sitting there telling us he doesn\u2019t recognise he\u2019s the respondent in this. He signed the sign-in sheet 20 minutes ago: \u2018David Moore, position: respondent\u2019.\u201d<\/p>\n<p class=\"c-paragraph paywall \">In response, Mr Moore said: \u201cI\u2019m the respondent for Astronomy Ireland, it\u2019s not for me personally.\u201d<\/p>\n<p class=\"c-paragraph paywall \">Then Mr Dolan told him: \u201cI\u2019m not adjourning.\u201d<\/p>\n<p class=\"c-paragraph paywall \">After further exchanges, Mr Moore and Mr Smartt left the hearing room and Mr Dolan concluded the case.<\/p>\n<p class=\"c-paragraph paywall \">In a decision issued this week, the adjudicator upheld all but one of Ms Martin\u2019s complaints.<\/p>\n<p class=\"c-paragraph paywall \">He awarded four weeks\u2019 wages in compensation, \u20ac3,077, for constructive dismissal in breach of the Unfair Dismissals Act 1977 on the basis there was \u201cno mention of any steps to mitigate loss\u201d on the part of Ms Martin.<\/p>\n<p class=\"c-paragraph paywall \">He has awarded a further \u20ac7,707 for the employer\u2019s failure to pay Ms Martin for statutory sick leave, annual leave and public holidays, and the failure to provide her with a written statement of her terms of employment.<\/p>\n<p class=\"c-paragraph paywall \">Astronomy Ireland, Mr Moore, Mr McDonagh, Mr Bonner and the fourth management committee member have been directed to pay total compensation of \u20ac10,784 to Ms Martin within 42 days.<\/p>\n","protected":false},"excerpt":{"rendered":"Space commentator David Moore has been held personally liable for multiple employment rights breaches against a former manager&hellip;\n","protected":false},"author":2,"featured_media":114686,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[23],"tags":[74050,85,46,141,145,74049],"class_list":{"0":"post-114685","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-space","8":"tag-astronomy-ireland","9":"tag-il","10":"tag-israel","11":"tag-science","12":"tag-space","13":"tag-workplace-relations-commission"},"_links":{"self":[{"href":"https:\/\/www.newsbeep.com\/il\/wp-json\/wp\/v2\/posts\/114685","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.newsbeep.com\/il\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.newsbeep.com\/il\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/il\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/il\/wp-json\/wp\/v2\/comments?post=114685"}],"version-history":[{"count":0,"href":"https:\/\/www.newsbeep.com\/il\/wp-json\/wp\/v2\/posts\/114685\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/il\/wp-json\/wp\/v2\/media\/114686"}],"wp:attachment":[{"href":"https:\/\/www.newsbeep.com\/il\/wp-json\/wp\/v2\/media?parent=114685"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.newsbeep.com\/il\/wp-json\/wp\/v2\/categories?post=114685"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.newsbeep.com\/il\/wp-json\/wp\/v2\/tags?post=114685"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
