{"id":161927,"date":"2025-12-01T06:44:09","date_gmt":"2025-12-01T06:44:09","guid":{"rendered":"https:\/\/www.newsbeep.com\/il\/161927\/"},"modified":"2025-12-01T06:44:09","modified_gmt":"2025-12-01T06:44:09","slug":"what-charges-does-benjamin-netanyahu-face-and-whats-at-stake-if-he-is-granted-a-pardon","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/il\/161927\/","title":{"rendered":"What charges does Benjamin Netanyahu face, and what\u2019s at stake if he is granted a pardon?"},"content":{"rendered":"<p>Israeli Prime Minister Benjamin Netanyahu has <a href=\"https:\/\/www.nytimes.com\/2025\/11\/30\/world\/middleeast\/netanyahu-pardon-request-israel.html\" rel=\"nofollow noopener\" target=\"_blank\">requested<\/a> a pardon in his long-running corruption trial \u2013 a move that has set off alarm bells among his critics that he\u2019s trying to circumvent the rule of law.<\/p>\n<p>In a <a href=\"https:\/\/x.com\/netanyahu\/status\/1995079559998509231\" rel=\"nofollow\">video message<\/a>, Netanyahu says Israel\u2019s current \u201csecurity and political\u201d situation makes it impossible for him to appear in court several times a week.<\/p>\n<p>His request for a pardon from Israel\u2019s president is just the <a href=\"https:\/\/edition.cnn.com\/world\/middleeast\/benjamin-netanyahu-fast-facts\" rel=\"nofollow noopener\" target=\"_blank\">latest twist<\/a> in a case that has dragged on for years. It could have significant implications for Israel\u2019s legal system \u2013 and Netanyahu\u2019s political future, with elections due next year.<\/p>\n<p>What charges does he face?<\/p>\n<p>Netanyahu is indisputably the most important political figure of modern Israeli politics. He was first elected prime minister in 1996 and is now in his sixth term.<\/p>\n<p>He has been indicted on charges of bribery, fraud and breach of trust, related to <a href=\"https:\/\/edition.cnn.com\/world\/middleeast\/benjamin-netanyahu-fast-facts\" rel=\"nofollow noopener\" target=\"_blank\">investigations<\/a> that date back to 2016. There are three cases now <a href=\"https:\/\/www.bbc.com\/news\/world-middle-east-47409739\" rel=\"nofollow noopener\" target=\"_blank\">known by numbers<\/a> \u2013 Case 1,000, Case 2,000 and Case 4,000. The trial began in 2020.<\/p>\n<p>In <a href=\"https:\/\/apnews.com\/article\/israel-corruption-netanyahu-gaza-war-scandal-17518bca5b27fc47216eed974e96f3e6\" rel=\"nofollow noopener\" target=\"_blank\">Case 1,000<\/a>, Netanyahu is alleged to have received some US$200,000 (A$305,000) worth of gifts, including cigars and champagne, from Hollywood producer Arnon Milchan and Australian billionaire James Packer.<\/p>\n<p><a href=\"https:\/\/www.bbc.com\/news\/world-middle-east-47409739\" rel=\"nofollow noopener\" target=\"_blank\">Case 2,000<\/a> is related to alleged meetings Netanyahu had with Arnon Mozes, the publisher of the prominent Yediot Ahronot newspaper. Prosecutors say Mozes offered Netanyahu favourable coverage in exchange for restrictions being imposed on one of his rival newspapers.<\/p>\n<p>And the final case, <a href=\"https:\/\/www.bbc.com\/news\/world-middle-east-47409739\" rel=\"nofollow noopener\" target=\"_blank\">Case 4,000<\/a> is related to a communications conglomerate, Bezeq. The attorney-general alleges another reciprocal agreement: Netanyahu would be portrayed positively on the online platform, it\u2019s alleged, in exchange for him supporting regulatory changes that would benefit Bezeq\u2019s controlling shareholder. <\/p>\n<p>Netanyahu has consistently denied any wrongdoing in the cases, saying he\u2019s a victim of a \u201cwitch hunt\u201d. In 2021, he characterised the charges as \u201c<a href=\"https:\/\/www.i24news.tv\/en\/news\/israel\/politics\/1612762808-israel-netanyahu-to-give-formal-response-to-corruption-charges-at-court-hearing\" rel=\"nofollow noopener\" target=\"_blank\">fabricated and ludicorous<\/a>\u201d. When  he took the stand in 2024, he <a href=\"https:\/\/www.france24.com\/en\/middle-east\/20241210-israel-s-netanyahu-prepares-to-take-the-stand-in-historic-corruption-trial\" rel=\"nofollow noopener\" target=\"_blank\">said<\/a>:<\/p>\n<p>These investigations were born of sin. There was no offence, so they found an offence.<\/p>\n<p>Experts have <a href=\"https:\/\/www.nytimes.com\/2025\/11\/30\/world\/middleeast\/netanyahu-pardon-request-israel.html\" rel=\"nofollow noopener\" target=\"_blank\">pointed out<\/a> that a pardon can only be given once someone\u2019s been convicted of a crime. But Netanyahu is not offering to admit any responsibility or guilt in the case, and he likely never will. He\u2019s simply asking for a pardon, so that he can get on with his job. <\/p>\n<p>Independence of Israel\u2019s judicial system<\/p>\n<p>Since the trial began in 2020, many witnesses have <a href=\"https:\/\/www.theguardian.com\/world\/2021\/nov\/22\/former-netanyahu-aide-testifies-corruption-trial-nir-hefetz\" rel=\"nofollow noopener\" target=\"_blank\">testified in the case<\/a>, including some former Netanyahu aides who entered into plea bargains and became state witnesses. So, there\u2019s been some pretty damning material brought against Netanyahu. <\/p>\n<p>But he\u2019s been extremely savvy and politically intelligent to use other issues \u2013 particularly the Gaza war \u2013 at every opportunity to try to postpone or interrupt the proceedings. <\/p>\n<p>And after the Hamas attacks of October 2023, the number of trial days was limited because of security. According to <a href=\"https:\/\/www.timesofisrael.com\/netanyahus-testimony-in-graft-trial-canceled-for-the-day-amid-shock-gaza-offensive\/\" rel=\"nofollow noopener\" target=\"_blank\">media reports<\/a>, Netanyahu has frequently requested his hearings be cancelled due to his handling of the war. <\/p>\n<p>Netanyahu\u2019s supporters don\u2019t seem to have a problem with his request for a pardon, but it is shining a light on broader questions around the independence of the Israeli legal system. <\/p>\n<p>In early 2023, the Netanyahu government put forth plans to <a href=\"https:\/\/www.bbc.com\/news\/world-middle-east-65086871\" rel=\"nofollow noopener\" target=\"_blank\">overhaul the judicial system<\/a>, which critics said would weaken the Supreme Court and Israel\u2019s system of checks and balances. Netanyahu wasn\u2019t involved in the effort because the attorney-general <a href=\"https:\/\/www.theguardian.com\/world\/2023\/feb\/02\/netanyahu-judiciary-overhaul-israel-corruption-trial\" rel=\"nofollow noopener\" target=\"_blank\">said<\/a> it would be a conflict of interest due to his corruption trial, but other ministers in his cabinet were pushing it. <\/p>\n<p>Massive protests happened on a regular basis throughout Israel in response to this move. Critics saw this as a <a href=\"https:\/\/www.pbs.org\/newshour\/world\/israels-netanyahu-doubles-down-on-judicial-plan-rejects-criticism-and-moves-ahead-toward-key-vote\" rel=\"nofollow noopener\" target=\"_blank\">frontal attack<\/a> on the basic foundations of the Israeli legal system. <\/p>\n<p>The request for a pardon is now part of this wider story, even though the two issues are not formally linked. He was <a href=\"https:\/\/www.aa.com.tr\/en\/middle-east\/netanyahu-re-elected-as-likud-leader-set-to-run-in-israel-s-upcoming-elections\/3737019\" rel=\"nofollow noopener\" target=\"_blank\">re-elected<\/a> leader of the Likud Party this month and he has <a href=\"https:\/\/www.timesofisrael.com\/liveblog_entry\/netanyahu-says-he-will-run-in-next-elections-expects-to-win\/\" rel=\"nofollow noopener\" target=\"_blank\">declared<\/a> his intention to run again for prime minister in next year\u2019s elections \u2013 and that he expects to win. <\/p>\n<p>The Israeli Basic Law <a href=\"https:\/\/www.gov.il\/apps\/elections\/elections-knesset-19\/eng\/law\/BasicLawKnesset_eng.html#:%7E:text=(a)%20Every%20Israel%20national%20who,does%20not%20bear%20moral%20turpitude\" rel=\"nofollow noopener\" target=\"_blank\">suggests<\/a> Netanyahu couldn\u2019t run if he\u2019s been convicted of a serious offence, though it\u2019s not clear if he would actually be blocked at this point. <\/p>\n<p>Media reports have suggested Netanyahu wants to <a href=\"https:\/\/www.aa.com.tr\/en\/middle-east\/israel-s-netanyahu-plans-to-move-up-general-elections-to-june-2026\/3720094\" rel=\"nofollow noopener\" target=\"_blank\">move up the elections<\/a> from November to June in the hopes he\u2019ll be able to secure deals to normalise relations with both Saudi Arabia and Indonesia by then. This fits a pattern of him trying to use foreign policy gains to offset his domestic problems. <\/p>\n<p>With elections coming, he\u2019s now trying every possible manoeuvre to improve his position \u2013 and the pardon is just one of them.
