{"id":194299,"date":"2025-12-20T05:00:07","date_gmt":"2025-12-20T05:00:07","guid":{"rendered":"https:\/\/www.newsbeep.com\/il\/194299\/"},"modified":"2025-12-20T05:00:07","modified_gmt":"2025-12-20T05:00:07","slug":"what-are-the-laws-proposed-in-nsw-to-ban-hate-speech-and-hate-symbols-after-the-bondi-terror-attack-bondi-beach-terror-attack","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/il\/194299\/","title":{"rendered":"What are the laws proposed in NSW to ban hate speech and hate symbols after the Bondi terror attack? | Bondi beach terror attack"},"content":{"rendered":"<p>The <a href=\"https:\/\/www.theguardian.com\/australia-news\/new-south-wales\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\" rel=\"nofollow noopener\" target=\"_blank\">New South Wales<\/a> government will move to limit protest rights and ban the display of hate symbols as it continues to reform state laws in the wake of the Bondi terror attack.<\/p>\n<p>The premier, Chris Minns, said a ban on the phrase \u201cglobalise the intifada\u201d would also follow tighter gun laws and new powers to ban protests for three months, after he <a href=\"https:\/\/www.theguardian.com\/australia-news\/2025\/dec\/19\/anti-protest-laws-extraordinary-powers-nsw-premier-linking-gaza-rallies-bondi-terror-attack-ntwnfb\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">linked pro-Palestine rallies<\/a> to the shooting that killed 15 people.<\/p>\n<p>Here\u2019s how state laws are set to change.<\/p>\n<p>What is the NSW government proposing?<\/p>\n<p class=\"dcr-130mj7b\">Minns on Saturday announced the state will move to ban the display of hateful symbols, matching national laws, and give police new powers.<\/p>\n<p class=\"dcr-130mj7b\">It would be illegal in NSW to publicly display flags and other symbols of listed terrorist organisations, including Islamic State, al-Qaeda, Hamas, Hezbollah, al-Shabaab, Boko Haram and others from \u201caround the world\u201d, according to the NSW attorney general, Michael Daley.<\/p>\n<p class=\"dcr-130mj7b\">Federal laws already prohibit such displays, but Daley said the new state law would be simpler. Those responsible would face up to two years\u2019 prison, similar to an existing state ban on Nazi symbols.<\/p>\n<p class=\"dcr-130mj7b\">The state will also allow police to require a person they believe is committing any offence at a public assembly to remove their face covering.<\/p>\n<p class=\"dcr-130mj7b\">Existing laws only give police that power that when the person is suspected of a serious indictable offence. Minns denied reforms would violate the rights of women wearing face coverings for religious reasons.<\/p>\n<p class=\"dcr-130mj7b\">\u201cPolice [will] be in a position to identify who is responsible for offensive conduct, hateful slogans or racist behaviour,\u201d Minns said.<\/p>\n<p class=\"dcr-130mj7b\">The government will also move to limit gun owners to <a href=\"https:\/\/www.theguardian.com\/australia-news\/2025\/dec\/19\/australia-gun-buy-back-bondi-beach-terror-attack-anthony-albanese\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">holding four firearms<\/a> and create a power to effectively ban protests for three months after a terrorism event, in reforms announced earlier this week.<\/p>\n<p>What about hate speech?<\/p>\n<p class=\"dcr-130mj7b\">The government wants to expand its hate speech laws to include the phrase \u201cglobalise the intifada\u201d and other phrases.<\/p>\n<p class=\"dcr-130mj7b\">.<\/p>\n<p class=\"dcr-130mj7b\">\u201cI will insist that \u2018globalise the intifada\u2019 is included in that list of hateful, violent rhetoric in New South Wales,\u201d Minns said.<\/p>\n<p class=\"dcr-130mj7b\">To ensure the expansion of hate speech laws survive legal challenges, the government will send laws to a parliamentary committee. Minns said the government will look to ban the phrase in the new year after the committee reports back.<\/p>\n<p class=\"dcr-130mj7b\">Asked whether the phrase \u201cfrom the river to the sea\u201d would be banned, he said he would not prejudge the parliamentary committee\u2019s investigation.<\/p>\n<p class=\"dcr-130mj7b\">Minns also flagged NSW would take further action against preachers and community figures who promote hatred or violence, following a <a href=\"https:\/\/www.theguardian.com\/australia-news\/2025\/dec\/19\/new-hate-speech-laws-will-go-to-constitutional-limit-to-crack-down-on-dehumanising-rhetoric-tony-burke-says-ntwnfb\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">federal government crackdown <\/a>announced this week.<\/p>\n<p class=\"dcr-130mj7b\">More law reform will follow in 2026 if people find loopholes in the proposed changes, Daley said.<\/p>\n<p class=\"dcr-130mj7b\">\u201cWe will not stop. This process will never end,\u201d Daley said.<\/p>\n<p class=\"dcr-130mj7b\">\u201cWe can\u2019t force people to live together in harmony \u2026 [and] for those very small few who decide that they won\u2019t do that, what is left at our disposal is strong legislation backed up by the best police force in the world.\u201d<\/p>\n<p>What does this mean for protests?<\/p>\n<p class=\"dcr-130mj7b\">While specific bans on protests and the phrase \u201cglobalise the intifada\u201d are yet to be legislated, Minns said residents who engage in either could face legal trouble.<\/p>\n<p class=\"dcr-130mj7b\">Chanting \u201cglobalise the intifada\u201d may already be in breach of existing hate speech laws in the state, according to advice provided to government, Minns said.<\/p>\n<p class=\"dcr-130mj7b\">\u201cYou\u2019re running a very risky racket if you\u2019re thinking of using that phrase before the bill goes through,\u201d he said.<\/p>\n<p class=\"dcr-130mj7b\">Minns also warned police would not tolerate breaches of the law, including at any unauthorised protests planned for this week.<\/p>\n<p class=\"dcr-130mj7b\">\u201cIf there\u2019s an unauthorised protest and they attempt to go on the street, take over the streets, then they\u2019ll met with the full force of the law,\u201d he said.<\/p>\n<p class=\"dcr-130mj7b\">Police have warned any large-scale public gatherings will face a significant policing response.<\/p>\n<p>Could reforms be stopped by parliament or legal challenges?<\/p>\n<p class=\"dcr-130mj7b\">All of the flagged reforms are yet to pass the state parliament, which will sit on Monday and Tuesday.<\/p>\n<p class=\"dcr-130mj7b\">Daley said he had briefed the opposition on previously announced protest and gun reforms and would continue to discuss the changes with the crossbench. Face covering and hate symbol reforms will also be put to parliament in December.<\/p>\n<p class=\"dcr-130mj7b\">Minns said he believes the protest-limiting reforms are constitutional and the government is prepared for any legal challenge.
