{"id":227058,"date":"2026-01-08T10:17:08","date_gmt":"2026-01-08T10:17:08","guid":{"rendered":"https:\/\/www.newsbeep.com\/il\/227058\/"},"modified":"2026-01-08T10:17:08","modified_gmt":"2026-01-08T10:17:08","slug":"how-can-justice-be-served-when-the-prosecutor-is-the-occupying-force","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/il\/227058\/","title":{"rendered":"how can justice be served when the prosecutor is the occupying force?"},"content":{"rendered":"<p>By abducting the president of Venezuela Nicol\u00e1s Maduro and his wife, Cilia Flores, through a military operation with <a href=\"https:\/\/www.chathamhouse.org\/2026\/01\/us-capture-president-nicolas-maduro-and-attacks-venezuela-have-no-justification\" target=\"_blank\" rel=\"nofollow noopener\">no justification under international law<\/a> to <a href=\"https:\/\/x.com\/DropSiteNews\/status\/2008409837458149594?s=20\" target=\"_blank\" rel=\"nofollow\">bring them to a New York court on Monday, January 5,<\/a> the US president Donald Trump has bypassed deliberately global norms and the <a href=\"https:\/\/www.justiceinfo.net\/tribunals\/icc\" rel=\"nofollow noopener\" target=\"_blank\">International Criminal Court (ICC)<\/a>. He thus gives priority to<a href=\"https:\/\/www.justice.gov\/opa\/media\/1422326\/dl\" target=\"_blank\" rel=\"nofollow noopener\"> a narrow narcotics bust<\/a> over a holistic, victim-focused potential reckoning for alleged crimes against humanity.<\/p>\n<p>In October 2025, the ICC Office of the prosecutor declared that Venezuela had made \u201c<a href=\"https:\/\/www.icc-cpi.int\/sites\/default\/files\/2025-12\/2025-annual-report.pdf\" target=\"_blank\" rel=\"nofollow noopener\">no meaningful progress<\/a>\u201d in its own domestic investigations and that it would close its Caracas office, signalling a shift towards international warrants. This was followed on <a href=\"https:\/\/www.reuters.com\/world\/americas\/venezuelan-lawmakers-pave-way-withdrawal-international-criminal-court-2025-12-11\" target=\"_blank\" rel=\"nofollow noopener\">11 December<\/a> by the country\u2019s National Assembly vote to withdraw from the Rome Statute, <a href=\"https:\/\/www.icc-cpi.int\/venezuela-i\" target=\"_blank\" rel=\"nofollow noopener\">which Venezuela ratified in 2000<\/a>. There is a possibility that a sealed ICC warrant may already <a href=\"https:\/\/www.aljazeera.com\/news\/2025\/12\/12\/venezuela-seeks-withdrawal-from-international-criminal-courts-rome-statute\" target=\"_blank\" rel=\"nofollow noopener\">exist for Maduro for crimes against humanity<\/a>. If this turns out to be the case, it would place the Trump administration \u2013 which is <a href=\"https:\/\/www.aljazeera.com\/news\/2025\/2\/7\/trump-sanctions-international-criminal-court-over-its-us-israel-probes\" target=\"_blank\" rel=\"nofollow noopener\">sanctioning ICC judges<\/a> \u2013 in the position of holding a high-value defendant and blocking his surrender for the mass atrocities that define his regime\u2019s legacy. The Venezuelan people <a href=\"https:\/\/justiceinconflict.org\/2019\/09\/16\/hi-venezuela-youve-reached-the-icc-can-we-put-you-on-hold\" target=\"_blank\" rel=\"nofollow noopener\">will keep waiting for justice, that may now not come at all.<\/a><\/p>\n<p>During the arraignment, <a href=\"https:\/\/www.theguardian.com\/us-news\/2026\/jan\/05\/maduro-pleads-not-guilty\" target=\"_blank\" rel=\"nofollow noopener\">Maduro pleaded\u00a0not guilty<\/a>\u00a0to the <a href=\"https:\/\/www.aljazeera.com\/news\/2026\/1\/5\/what-is-the-us-charging-nicolas-maduro-with\" target=\"_blank\" rel=\"nofollow noopener\">charges of narco-terrorism<\/a>, cocaine importation and the possession of machine guns. The counsel, for his visibly bruised and injured wife, requested an X-ray for <a href=\"https:\/\/nypost.com\/2026\/01\/05\/us-news\/nicolas-maduros-wife-cilia-flores-suffered-possible-rib-fracture-bruising-during-arrest-lawyer\" target=\"_blank\" rel=\"nofollow noopener\">suspected fractured ribs<\/a> sustained during the military abduction. Despite the defence challenging the legality of the capture, the court proceeded under the\u00a0<a href=\"https:\/\/en.wikipedia.org\/wiki\/Ker%E2%80%93Frisbie_doctrine\" target=\"_blank\" rel=\"nofollow noopener\">US Ker-Frisbie doctrine<\/a>, treating the <a href=\"https:\/\/www.aljazeera.com\/opinions\/2026\/1\/4\/we-just-witnessed-power-kidnapping-the-law\" target=\"_blank\" rel=\"nofollow noopener\">indisputable illegality of the kidnapping<\/a> as disturbingly irrelevant to its domestic jurisdiction.<\/p>\n<p>The Ker-Frisbie doctrine<\/p>\n<p>US domestic law can use the\u00a0Ker-Frisbie doctrine, a 19th-century precedent initially established in\u00a01886 to allow the kidnapping and the trial in Illinois of larcenist Frederick Ker, who had fled to Peru. It asserts that the power of a court to try a person is not impaired by the fact that they were brought within the court\u2019s jurisdiction via \u201c<a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/119\/436\" target=\"_blank\" rel=\"nofollow noopener\">forcible abduction<\/a>\u201d. This was significantly <a href=\"https:\/\/en.wikipedia.org\/wiki\/United_States_v._Alvarez-Machain\" target=\"_blank\" rel=\"nofollow noopener\">reaffirmed in 1992<\/a> when the US Supreme Court held that the abduction of a Mexican national did not violate extradition treaties. The only significant limit to this doctrine stems from the <a href=\"https:\/\/law.justia.com\/cases\/federal\/appellate-courts\/F2\/500\/267\/112446\" target=\"_blank\" rel=\"nofollow noopener\">1974 case\u00a0against Francisco Toscanino<\/a>, convicted of drug conspiracy, whose conviction was declared invalid because American agents kidnapped and tortured him from Uruguay to bring him to the US, violating his constitutional rights and international law.<\/p>\n<p>Here, the Second Circuit Court of Appeals \u2013 the same circuit overseeing Maduro\u2019s case \u2013 suggested that a court could divest itself of jurisdiction if the government\u2019s conduct \u201c<a href=\"https:\/\/uniset.ca\/other\/cs5\/500F2d267.html\" target=\"_blank\" rel=\"nofollow noopener\">shocks the conscience<\/a>\u201d. This exception typically requires <a href=\"https:\/\/rutgerslawreview.com\/wp-content\/uploads\/2011\/08\/Rendition-to-Torture-A-Critical-Legal-History.pdf\" target=\"_blank\" rel=\"nofollow noopener\">proof of torture<\/a> or cruel, inhuman, and degrading treatment during the abduction \u2013 and one might consider in the present case that the injuries to Flores may yet force the court to consider whether it meets that high bar.<\/p>\n<p>By applying the Ker-Frisbie doctrine to a head of state, the US continues to operate in contrast to the evolving norms of the global rule of law and the UN Charter. Most legal systems, and the UN Charter itself, view extrajudicial rendition as <a href=\"https:\/\/www.everycrsreport.com\/reports\/RL32890.html\" target=\"_blank\" rel=\"nofollow noopener\">a violation of state sovereignty<\/a> and of the right to due process. Furthermore, under <a href=\"https:\/\/tlblog.org\/a-primer-on-foreign-official-immunity\" target=\"_blank\" rel=\"nofollow noopener\">customary international law<\/a>, sitting heads of state have absolute <a href=\"https:\/\/www.justsecurity.org\/128073\/head-of-state-immunity-maduro-trial\" target=\"_blank\" rel=\"nofollow noopener\">immunity from the criminal jurisdiction of foreign nations<\/a>. Maduro\u2019s lawyer, <a href=\"https:\/\/apnews.com\/live\/us-venezuela-trump-maduro-updates-01-05-2026\" target=\"_blank\" rel=\"nofollow noopener\">Barry J. Pollack<\/a>, has signalled that his client \u201cis head of a sovereign state and entitled to the privilege\u201d that this legal status ensures.<\/p>\n<p>The UN Charter among the casualties<\/p>\n<p>Just three miles north of the courthouse, the <a href=\"https:\/\/www.reuters.com\/world\/americas\/legality-us-capture-venezuelas-maduro-focus-united-nations-2026-01-04\" target=\"_blank\" rel=\"nofollow noopener\">UN Security Council<\/a> convened an emergency meeting on Monday to address the legality of the US operation which deployed over 150 aircraft as part of the strike on January 3, 2026 in a clear act of aggression, bypassing both Congressional authorisation and UN mandates. Preliminary reports suggest <a href=\"https:\/\/www.washingtonpost.com\/national-security\/2026\/01\/06\/maduro-raid-death-toll\" target=\"_blank\" rel=\"nofollow noopener\">around 75 people were killed in the attack<\/a>, including civilians and members of Maduro\u2019s security team, with the overwhelming majority of UN delegates expressing alarm at the unilateralist action and <a href=\"https:\/\/www.theguardian.com\/commentisfree\/2026\/jan\/05\/donald-trump-venezuela-nicolas-maduro\" target=\"_blank\" rel=\"nofollow noopener\">precedent set<\/a> \u2013 although European representatives were disappointingly quieter here. <\/p>\n<p>As the UN High Commissioner for Human Rights, Volker T\u00fcrk, <a href=\"https:\/\/www.theguardian.com\/commentisfree\/2026\/jan\/05\/trump-military-action-venezuela-us\" target=\"_blank\" rel=\"nofollow noopener\">warned on Monday<\/a>, the US intervention \u201cdamages the architecture of international security, making every country less safe.\u201d T\u00fcrk wrote how rights are being \u201cinstrumentalised\u201d, invoked to justify a breach of international law and breach of the UN Charter, but sidelined when they don\u2019t serve the narrow interests of a narcotics bust or the \u201cexploitation of fossil fuels.\u201d It may seem an obvious point, but <a href=\"https:\/\/www.ohchr.org\/en\/press-briefing-notes\/2026\/01\/turk-says-us-operation-venezuela-clearly-undermines-fundamental\" target=\"_blank\" rel=\"nofollow noopener\">accountability for human rights violations will not be achieved through unilateral military intervention that violates international law<\/a> and causes further instability.<\/p>\n<p>FIND THIS ARTICLE INTERESTING?<\/p>\n<p>\t\t\t<a href=\"https:\/\/www.justiceinfo.net\/en\/newsletter\" target=\"_blank\" rel=\"nofollow noopener\">Sign up now for our (free) newsletter<\/a> to make sure you don&#8217;t miss out on other publications of this type. \t\t<\/p>\n<p>Another immediate casualty is\u00a0article 2(4) of the UN Charter, which once prohibited the threat or use of force against the territorial integrity of any state, although the 2003 Iraq invasion showed how manipulated this principle could be. <a href=\"https:\/\/www.newyorker.com\/news\/q-and-a\/the-brazen-illegality-of-trumps-venezuela-operation\" target=\"_blank\" rel=\"nofollow noopener\">Professor Oona Hathaway<\/a> and other <a href=\"https:\/\/www.ejiltalk.org\/trumps-illegal-attack-on-venezuela-and-its-consequences\" target=\"_blank\" rel=\"nofollow noopener\">international legal scholars<\/a> have set out how the legal basis for this most recent US operation is <a href=\"https:\/\/www.justsecurity.org\/127981\/international-law-venezuela-maduro\" target=\"_blank\" rel=\"nofollow noopener\">non-existent<\/a>.\u00a0By asserting that drug trafficking can override the Charter\u2019s prohibition on war, the Trump administration is setting a dangerous expansion of the right to self-defence, which requires an \u201carmed attack\u201d as a threshold that narcotics smuggling has never met.<\/p>\n<p>It is a grim irony therefore, that the illegality of the US strikes and abduction <a href=\"https:\/\/opiniojuris.org\/2026\/01\/06\/the-united-states-attack-against-venezuela-might-does-not-make-right\" target=\"_blank\" rel=\"nofollow noopener\">qualifies as a crime of\u00a0aggression<\/a>, which was added to the ICC Rome Statute\u00a0<a href=\"https:\/\/asp.icc-cpi.int\/crime-of-aggression\" target=\"_blank\" rel=\"nofollow noopener\">in 2010<\/a> and became effective in\u00a0July 2018. But neither the US nor Venezuela has <a href=\"https:\/\/treaties.un.org\/pages\/viewdetails.aspx?src=treaty&amp;mtdsg_no=xviii-10-b&amp;chapter=18&amp;clang=_en\" target=\"_blank\" rel=\"nofollow noopener\">signed<\/a> up to this. The ICC is barred from exercising jurisdiction over the <a href=\"https:\/\/www.justiceinfo.net\/tag\/crime-of-aggression\" rel=\"nofollow noopener\" target=\"_blank\">crime of aggression<\/a> when committed by a non-State Party\u2019s nationals or on its territory. Unless the UN Security Council refers the situation \u2013 a move subject to a US veto \u2013 there is no legal mechanism to hold the US accountable today for what Nuremberg deemed the supreme international crime, eighty years ago.<\/p>\n<p>More aggression may still be to come. The attack on Venezuela\u00a0<a href=\"https:\/\/juliansayarer.substack.com\/p\/abducting-oil\" target=\"_blank\" rel=\"nofollow noopener\">followed a meeting\u00a0<\/a>between Trump and Israeli Prime Minister Benjamin Netanyahu at Mar-a-Lago, in Florida, and <a href=\"https:\/\/www.iranintl.com\/en\/202601036187\" target=\"_blank\" rel=\"nofollow noopener\">Israeli political leaders<\/a> have explicitly framed US intervention in Venezuela as a warning to Iran.<\/p>\n<p>\u201cIt\u2019s not enough, but it\u2019s something\u201d<\/p>\n<p>Outside the US court, the legal technicalities felt worlds away from the lived reality of the Venezuelan diaspora. Life is not black and white, and for many Venezuelans who have suffered under Maduro\u2019s regime, Monday represented a long-awaited reckoning.\u00a0<\/p>\n<p>Pedro Reyes, 39, still carries the scars of the violently repressed 2014 protests. He described a police state that almost tore his daughter from him. \u201cI never saw [the others detained with me] again,\u201d he said. For Pedro and his friend Javier, 38, who have both called New York home for the past six years, the sight of Maduro in a Manhattan court was a moment of profound, if conflicted, relief. When asked about the US prioritising drug charges over the crimes they witnessed, the response was one of desperate pragmatism. \u201cIt\u2019s not enough,\u201d Javier said. \u201cBut it\u2019s something.\u201d<\/p>\n<p>This sentiment was echoed by Naomi Zambrano, 33, who stood nearby with her baby son. Her assessment was also clear \u2013 \u201cMaduro is a killer.\u201d Yet, for Naomi, the day was defined by\u00a0\u2018incertidumbre\u2019 (uncertainty) and she fears a future where global powers like China, Russia and Iran might be drawn into a regional conflagration following the intervention. \u201cI have concern for that,\u201d she added, worrying that her country would be treated as a mini-America by an administration that fundamentally misunderstands the local context.<\/p>\n<p>Further down the protest line, Michael Carter of\u00a0<a href=\"https:\/\/commondefense.us\/news\/veterans-condemn-violent-regime-change-in-venezuela-warn-of-new-forever-war-and-demand-accountability\" target=\"_blank\" rel=\"nofollow noopener\">Common Defense<\/a>, a grassroots organisation of US veterans and military families seeking to \u201cdefend the Constitution, oppose Forever Wars, and fight for a democracy where liberty and justice truly exist for all\u201d was also concerned. \u201cIf the US has the authority to kidnap Maduro,\u201d Carter asked, \u201cwhy doesn\u2019t the European Union have the authority to kidnap Trump and bring him to The Hague?\u201d Next to him, Sean Bogue viewed the proceedings as a \u201ctransparent, bullying\u201d pretext, drawing a connection with the false pretences of weapons of mass destruction in Iraq to the drugs as pretext in Venezuela. \u201cWe\u2019ve seen the bodies, the deaths and destruction we cause by pretending to be liberators,\u201d he said. \u201cI think this could potentially even get worse for the people of Venezuela.\u201d<\/p>\n<p>What now for transitional justice?<\/p>\n<p>Perhaps the greatest tragedy of Monday\u2019s hearing is what was\u00a0not\u00a0in the indictment. The charges focus on the logistical flow of cocaine onto American streets and do not address the <a href=\"https:\/\/www.hrw.org\/news\/2025\/04\/30\/venezuela-brutal-crackdown-elections\" target=\"_blank\" rel=\"nofollow noopener\">systemic persecution<\/a> that has defined the Maduro era, and which <a href=\"https:\/\/www.justiceinfo.net\/en\/38998-latin-american-states-to-refer-venezuela-to-the-icc.html\" rel=\"nofollow noopener\" target=\"_blank\">in September 2018<\/a>\u00a0prompted <a href=\"https:\/\/www.icc-cpi.int\/news\/statement-prosecutor-international-criminal-court-fatou-bensouda-referral-group-six-states\" target=\"_blank\" rel=\"nofollow noopener\">six states<\/a> \u2013 Argentina, Canada, Chile, Colombia, Paraguay and Peru \u2013 to jointly refer the situation to the ICC.\u00a0<a href=\"https:\/\/www.justiceinfo.net\/en\/84481-venezuela-icc-who-is-fooling-who.html\" rel=\"nofollow noopener\" target=\"_blank\">In 2021<\/a>, ICC Chief Prosecutor Karim Khan <a href=\"https:\/\/www.icc-cpi.int\/news\/icc-prosecutor-mr-karim-aa-khan-qc-opens-investigation-situation-venezuela-and-concludes\" target=\"_blank\" rel=\"nofollow noopener\">announced<\/a> that a preliminary examination had been concluded with a decision to proceed with investigations and opening an office in Caracas, which has <a href=\"https:\/\/www.barrons.com\/news\/venezuela-accuses-icc-of-shirking-duties-for-closing-caracas-office-1ab33c0c?reflink=desktopwebshare_permalink\" target=\"_blank\" rel=\"nofollow noopener\">since been closed<\/a>.<\/p>\n<p>By prioritising a narco-terrorism indictment through the military strategy of an occupying force, the US has sidelined these investigations into the regime\u2019s most heinous alleged domestic crimes. For the victims of the Maduro era, a meaningful justice must require more than a drug conviction in Manhattan, but rather it should be a process that belongs to them.
