So what are their rights to protest? | Australia news"},"content":{"rendered":"<p>Thousands of Australians are expected to march on Monday in nationwide protests against a visit by the Israeli president, Isaac Herzog, to Australia after an invitation by the prime minister, Anthony Albanese, in the wake of the Bondi terror attack.<\/p>\n<p>The visit has reanimated the issue of the right to protest, particularly in <a href=\"https:\/\/www.theguardian.com\/australia-news\/new-south-wales\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\" rel=\"nofollow noopener\" target=\"_blank\">New South Wales<\/a> where there is a new law that has led to a curtailing of the ability for protesters to march in certain areas. This law is now facing a constitutional challenge.<\/p>\n<p>Is there a right to protest in Australia?<\/p>\n<p class=\"dcr-130mj7b\">An express right to protest is protected in some individual jurisdictions, including <a href=\"https:\/\/humanrights.gov.au\/resource-hub\/by-resource-type\/publications\/rights-and-freedoms\/guides\/protest-rights-australia-explainer#:~:text=Only%20Queensland%2C%20Victoria%20and%20the%20ACT%20have%20Human%20Rights%20Acts%20and%20other%20laws%20which%20expressly%20protect%20the%20right%20to%20peaceful%20assembly%2C\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">Victoria, Queensland and the ACT<\/a>.<\/p>\n<p class=\"dcr-130mj7b\">However, there is no such explicit right under commonwealth legislation, although it\u2019s covered in common law and by the Australian constitution \u2013 which the high court has found implies the right to freedom of political communication.<\/p>\n<p class=\"dcr-130mj7b\">Governments cannot create laws that significantly impede this right. However, there are many laws that critics claim have eroded it.<\/p>\n<p class=\"dcr-130mj7b\">Courts can overturn such laws if they are found to be constitutionally invalid, and <a href=\"https:\/\/www.theguardian.com\/australia-news\/2023\/dec\/13\/knitting-nannas-claim-partial-victory-in-nsw-anti-protest-law-challenge\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">have done so<\/a>.<\/p>\n<p class=\"dcr-130mj7b\">Tim Roberts, the president of the NSW Council for Civil Liberties, says a protest itself cannot be considered illegal.<\/p>\n<p class=\"dcr-130mj7b\">However, an individual protester can be charged with an offence based on their conduct during the protest \u2013 for example, if they fail to comply with a move-on direction by police.<\/p>\n<p>Do protests require approval?<\/p>\n<p class=\"dcr-130mj7b\">Generally, they don\u2019t.<\/p>\n<p class=\"dcr-130mj7b\">But in <a href=\"https:\/\/www.theguardian.com\/australia-news\/2024\/oct\/04\/protesters-wouldnt-have-to-fight-for-police-permission-if-nsw-had-less-undemocratic-system-expert-says\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">NSW<\/a> and <a href=\"https:\/\/www.police.qld.gov.au\/protests-and-public-assembly-demonstrations\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">Queensland<\/a>, there are permit-style systems where organisers submit forms about a planned protest.<\/p>\n<p class=\"dcr-130mj7b\">Protesters submit the forms to police outlining details such as which roads the protest intends to march along.<\/p>\n<p class=\"dcr-130mj7b\">It is not mandatory for organisers to use this process. But if they do, and police accept the details on the form, protesters won\u2019t be charged for offences such as blocking traffic or pedestrians.<\/p>\n<p class=\"dcr-130mj7b\">In Queensland, the protest is deemed authorised so long as five days\u2019 notice is given and no court order has been issued to block it.<\/p>\n<p class=\"dcr-130mj7b\">If NSW police oppose the application, they don\u2019t have the final say \u2013 a court does. This is why the Palestine Action Group went to the NSW supreme court to win permission for its march across the Sydney Harbour Bridge. The court later ruled against a similar protest at the Sydney Opera House on safety grounds.<\/p>\n<p class=\"dcr-130mj7b\">Last year, the court sided with police and opposed a climate rally in Newcastle by Rising Tide. Organisers went ahead with the protest regardless. The court decision simply meant the protesters were not protected from being charged under protest laws.<\/p>\n<p class=\"dcr-130mj7b\">In the wake of the Bondi terror attack, the Minns government passed a law which prevents the use of this system in designated areas.<\/p>\n<p class=\"dcr-130mj7b\">The Victorian government opposes introducing a permit system, citing successive police chief commissioners not recommending them. However, it did\u00a0<a href=\"https:\/\/www.theguardian.com\/australia-news\/2025\/dec\/02\/victoria-police-search-powers-children\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">pass tougher protest laws in December<\/a>. The laws include a ban on using attachment devices to lock on to objects in a way that endangers the public as well as fines of more than $1,000 for those who fail to comply with a police direction to remove a mask.<\/p>\n<p class=\"dcr-130mj7b\">In the ACT, protests are permitted without approval. However, the erection of structures in the parliamentary triangle <a href=\"https:\/\/www.nca.gov.au\/events\/right-protest#\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">does require permission<\/a>.<\/p>\n<p>When can police issue a move-on direction?<\/p>\n<p class=\"dcr-130mj7b\">In Victoria, police have move-on powers in <a href=\"https:\/\/www.theguardian.com\/australia-news\/2025\/nov\/25\/melbourne-police-search-powers-warrantless-pat-downs-six-months\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">declared designated areas<\/a>.<\/p>\n<p class=\"dcr-130mj7b\">In NSW and Queensland, police don\u2019t have the full suite of their move-on powers if the protest is deemed \u201cauthorised\u201d.<\/p>\n<p class=\"dcr-130mj7b\">Where there\u2019s not a permit, the Law Enforcement (Powers and Responsibilities) Act in NSW states that police may issue a move-on order if protesters obstruct traffic or pedestrians, or pose a \u201cserious risk\u201d to someone else\u2019s safety.<\/p>\n<p class=\"dcr-130mj7b\">In Queensland, police can only order a person to move on during an unauthorised protest \u2013 although they \u201cmust not give a direction \u2026 that interferes with a person\u2019s right of peaceful assembly\u201d unless deemed necessary on the grounds of public order, safety or to protect other people. The move on powers cannot be used during an authorised protest.<\/p>\n<p>What is the law impacting Sydney\u2019s march?<\/p>\n<p class=\"dcr-130mj7b\">The NSW premier, Chris Minns, recently passed legislation that effectively bans people from marching in designated areas in Sydney without the risk of being arrested.<\/p>\n<p class=\"dcr-130mj7b\">This is done by allowing for the permit-style system to be restricted in certain areas. The police commissioner can put in place this restriction, known as a Public Assembly Restriction Declaration, for up to 90 days after a terror attack.<\/p>\n<p class=\"dcr-130mj7b\">Three groups \u2013 Blak Caucus, Palestine Action Group and Jews Against Occupation \u2013 have launched a constitutional challenge against the restriction, arguing it burdens the implied right to freedom of political communication. It will be heard by the court of appeal on 26 February.<\/p>\n<p class=\"dcr-130mj7b\">The proposed route of the Palestine Action Group march on Monday \u2013 from Town Hall to NSW parliament \u2013 falls within a restricted area.<\/p>\n<p class=\"dcr-130mj7b\">Protests can still be held in these areas, and many have done so since the restriction was put in place. But police have their full suite of move-on powers if anyone obstructs traffic or pedestrians.<\/p>\n<p class=\"dcr-130mj7b\">Three NSW Labor backbenchers have said they will attend the rally at Town Hall on Monday, with one scheduled to speak at the event.
