(AP) \u2014 Some Republican legislators are looking to restrict their states\u2019 ability to set environmental regulations, a move that comes as President <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/hub\/donald-trump\" rel=\"nofollow noopener\" target=\"_blank\">Donald Trump<\/a> \u2019s administration pushes to <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-epa-climate-zeldin-power-plants-feb184286a7a9419aefddce293362e6b\" rel=\"nofollow noopener\" target=\"_blank\">roll back environmental rules<\/a> on power plants, water and <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-climate-change-epa-clean-air-act-c149d5ea6ec71c862e6c4b578adf92cd\" rel=\"nofollow noopener\" target=\"_blank\">greenhouse gases<\/a>.<\/p>\n<p>The Alabama Legislature on Tuesday approved legislation backed by business groups that would prevent state agencies from setting restrictions on pollutants and hazardous substances exceeding those set by the federal government. In areas where no federal standard exists, the state could adopt new rules only if there is a \u201cdirect causal link\u201d between exposure to harmful emissions and \u201cmanifest bodily harm\u201d to humans. <\/p>\n<p>Supporters said the Alabama measure would ground standards in \u201csound science\u201d and prevent regulatory overreach. Environmental groups said it would cripple the state\u2019s ability to respond to environmental or health risks, including a group of chemicals known as PFAS, or <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/forever-chemicals-pfas-south-carpet-industry-2e5308561e17d7fd41ad23b3133a035b\" rel=\"nofollow noopener\" target=\"_blank\">forever chemicals<\/a>, that has contaminated swaths of the South. <\/p>\n<p>Sarah Stokes, a senior attorney with the Southern Environmental Law Center, said the bill sets an \u201cimpossible hurdle\u201d for state regulations since the bill specifies that an \u201cincreased risk of disease\u201d is not enough to demonstrate harm to humans. <\/p>\n<p>    <a class=\"AnchorLink\" id=\"more-section-display-name\"\/><\/p>\n<p>    <a class=\"Link\" aria-label=\"Alabama sets execution for man in auto parts store customer\u2019s death\" href=\"https:\/\/apnews.com\/article\/alabama-execution-sonny-burton-8f457305c2e495dbf0901ea387b9f511\" rel=\"nofollow noopener\" target=\"_blank\"><\/p>\n<p><img decoding=\"async\" class=\"Image\" alt=\"This 2025 photo provided by Matt Schulz shows Charles &quot;Sonny&quot; Burton, who is facing execution in Alabama for a 1991 murder during a robbery, in which he was not the triggerman, at the Holman Correctional Facility in Atmore, Ala. We\u2019re basically sacrificing human health for businesses,\u201d Stokes said. \u201cThat doesn\u2019t seem like the best calculation for our citizens.\u201d<\/p>\n<p>The U.S. Chamber of Commerce and business groups supported the legislation, and the bill\u2019s sponsor, Republican Sen. Donnie Chesteen, told a legislative committee this month that his bill is a \u201cpro-business\u201d piece of legislation. <\/p>\n<p>\u201cIf we\u2019re going to be able to compete with states in the Southeast to attract and bring some of these businesses in, then we need to have these standards adopted so that it\u2019s clearly defined what our companies are working with,\u201d Chesteen said. Supporters also argued the bill follows Trump\u2019s deregulatory agenda.<\/p>\n<p>\u201cThis does not remove the use of sound science and legitimate science,\u201d Republican Rep. Troy Stubbs said during debate. \u201cWhat it does is protect Alabama and the people of Alabama from runaway government that can become overly burdensome and regulatory to a point that it drives the cost of living way up.\u201d<\/p>\n<p>Stubbs disputed that it would weaken existing rules, saying current state regulations would stay in place. However, the environmental lawyer Stokes said she is concerned that businesses could use it as a basis to challenge existing rules. <\/p>\n<p>The measure is the latest effort to restrict state-level environmental regulations. Indiana Gov. Mike Braun signed an executive order last year saying Indiana can\u2019t have new environmental rules stricter than federal ones unless deemed necessary by state law or the governor. Tennessee lawmakers last year passed legislation requiring any regulations that are more stringent than federal regulations to be based on links to \u201cmanifest bodily harm in humans.\u201d <\/p>\n<p>Stokes said the Alabama proposal goes further than the Tennessee law. A similar bill has been introduced in Utah.<\/p>\n<p>Stokes said the Alabama legislation was introduced after advocacy groups persuaded the Alabama Environmental Management Commission to consider updating state standards for arsenic and cyanide and 11 other toxic pollutants.<\/p>\n<p>Cara Horowitz, an environmental law professor and executive director of the Emmett Institute on Climate Change and the Environment at UCLA School of Law, said the legislation would prevent state agencies from making \u201cindependent decisions about how much to protect public health from things like water pollution, air pollution, and toxics.\u201d<\/p>\n<p>\u201cAlabama could adopt its own pollution standard only where the state\u2019s rationale for doing so relies on a very particular kind of science,\u201d Horowitz wrote in an email. \u201cAlabama could not rely, for example, on studies showing a correlation between pollution exposure and an increased risk of disease.\u201d<\/p>\n<p>The bill also bars agencies from using the EPA\u2019s Integrated Risk Information System, which characterizes the health hazards of chemicals found in the environment, as the default basis for water quality standards. A lobbying group for the chemical industry has criticized the system as overly burdensome and scientifically flawed.<\/p>\n<p>Democrats in the Alabama Legislature spoke against the bill for two hours until GOP lawmakers voted to end debate and force a vote. <\/p>\n<p>Democratic Rep. Chris England said the bill turns Alabama residents into test subjects. \u201cWe are a petri dish for businesses to do as they will until they kill people,\u201d England said.<\/p>\n<p>Rep. Neil Rafferty, also a Democrat, said the bill is \u201cdefining sound science just to gut our ability to use it to drive science-based and data-driven policy.\u201d <\/p>\n<p>The state House of Representatives voted 88-34 for the bill, which now goes to Republican Gov. Kay Ivey. A spokeswoman for Ivey did not have an immediate comment on the bill. <\/p>\n","protected":false},"excerpt":{"rendered":"MONTGOMERY, Ala.
