Before we thaw out, here\u2019s a brisk tour of the forces reshaping the drug channel. As he correctly notes: \u201cIf the PBM convinces the employer to choose the current system, then they can do it just the way they always have.\u201d<\/p>\n<p>Mark Cuban is right: the FTC\u2013Express Scripts settlement doesn\u2019t overhaul the entire system. He zeroes in on the crucial \u201cSection XI. Meeting Competition\u201d loophole that I wrote about in <a href=\"https:\/\/www.drugchannels.net\/2026\/02\/the-ftc-blows-up-express-scripts-pbm.html\" target=\"_blank\" rel=\"nofollow noopener\">The FTC Blows Up Express Scripts\u2019 PBM Model\u2014and Launches the Net Pricing Drug Channel<\/a>.\n<\/p>\n<p>Nonetheless, I still believe that the settlement puts us on a path toward something better.\n<\/p>\n<p>By basing patient out-of-pocket costs on net prices and passing through rebates at the point of sale, the settlement helps shield patients from the excesses of the gross-to-net bubble.\n<\/p>\n<p>What&#8217;s more, the default plan sponsor agreement aligns with a Net Pricing Drug Channel (NPDC). Yes, plans could still undermine the NPDC through the Section XI carve outs. That&#8217;s probably why Wall Street didn&#8217;t freak out.\n<\/p>\n<p>But changing the default sets the system in motion.\n<\/p>\n<p>A top-down attempt to \u201cfix everything\u201d at once is almost guaranteed to fail, creating chaos and disruption for healthcare stakeholders and patients. Setting new rules and letting incentives do the work, however, could (maybe, hopefully) get us there.\n<\/p>\n<p>Either way, it\u2019s going to be a wild ride. Stay tuned!<\/p>\n<p><a href=\"https:\/\/drugch.nl\/4kfK62l\" target=\"_blank\" rel=\"nofollow noopener\">Patient Perspectives on Health Insurance Design: A Mixed-Methods Analysis<\/a>, Journal of Market Access &amp; Health Policy<br \/>\n<br \/>Here\u2019s some evidence of patient demand for the NPDC.<\/p>\n<p>Surveyed patients (n=146) strongly support changes that reduce unpredictable out-of-pocket costs:\n<\/p>\n<p>Eliminating coinsurance for stable chronic meds<br \/>\nCovering high-value drugs without deductibles<br \/>\nCapping medication costs as a share of income<br \/>\nReplacing coinsurance with fixed copays<br \/>\nHere are the summary results:<\/p>\n<p>[Click to Enlarge]<\/p>\n<p><a href=\"https:\/\/blogger.googleusercontent.com\/img\/b\/R29vZ2xl\/AVvXsEiGLljXDMXglRqJc9RTFVhAVfRQ14T_yINFAZjtVDhiB_UgKo_sdZRCTRwZQucZb91da6fUG6FpOpcIOnLwXVh_uU8Av762K9k6BJYq2-gprfzoPtPMJ_QaxaxdbiYbTZuJGoXcbLIm-jA3hW9Wjv-iNngLmAd6CZ-3jcr2ogWtAcHTa0FBkTxKxw\/s1600\/Patient-view.png\" style=\"display: block; padding: 0em 0px; text-align: center;\" rel=\"nofollow noopener\" target=\"_blank\"><img loading=\"lazy\" decoding=\"async\" alt=\"\" border=\"0\" data-original-height=\"658\" data-original-width=\"969\" height=\"348\" src=\"https:\/\/www.newsbeep.com\/il\/wp-content\/uploads\/2026\/02\/Patient-view.png\" width=\"512\"\/><\/a><br \/>\n<br \/>As you can see, affordability and predictability matter more than transparency. Patients want to plan and budget\u2014not estimate\u2014out-of-pocket costs. And after paying premiums, they expect coverage for high-value care.<\/p>\n<p>As Peter Kolchinsky of RA Capital often says: No one fakes cancer to joyride chemo.<\/p>\n<p><a href=\"https:\/\/drugch.nl\/4cGuzXm\" target=\"_blank\" rel=\"nofollow noopener\">The QALY Paradox: An Unintended Consequence Of Most Favored Nation Drug Pricing<\/a>, Health Affairs<br \/>\n<br \/> I have long argued that international reference pricing is a flawed policy shortcut, not a sustainable solution. Benchmarking U.S. drug prices vs. other countries overlooks fundamental structural differences in healthcare financing, delivery, and value assessment frameworks. <\/p>\n<p>This timely Health Affairs article raises a deeper legal and policy question at the intersection of quality-adjusted life-years (QALYs) and Most Favored Nation (MFN) pricing models:\n<\/p>\n<p>When Congress explicitly prohibits a particular methodology in statute, can the executive branch effectively circumvent that prohibition by adopting foreign prices derived from the banned methodology?<br \/>\nAs the authors explain, the U.S. ban on QALYs reflects a &#8220;bipartisan compromise to protect vulnerable groups from being disadvantaged in the pursuit of cost containment.&#8221; Referencing foreign prices is not a neutral act when those prices are grounded in frameworks that U.S. law has deliberately declined to adopt.<\/p>\n<p>Kudos to Dominique Seo, Kenneth E. Thorpe, and T.
