Today, GuardDog Telehealth, Epic, and healthcare provider co-plaintiffs filed a stipulated judgment. If entered by the court, judgment will be entered against GuardDog on the claims asserted by plaintiffs. GuardDog admitted that while \u201cits goal was to provide chronic care management and remote patient monitoring for patients,\u201d that \u201cdid not happen.\u201d \u201cFor the duration of its existence, its business instead focused on requesting, reviewing, and summarizing medical records, and providing those medical records to law firms.\u201d GuardDog obtained these records \u201cby asserting a treatment purpose\u201d through Carequality, the interoperability framework hospitals rely on to share records for patient care.<\/p>\n
Under the terms of the stipulated judgment, GuardDog would be permanently barred from \u201crequesting records using the TEFCA or Carequality interoperability frameworks,\u201d required to \u201cdelete any patient health information or records obtained from the TEFCA or Carequality frameworks within one week,\u201d and barred from \u201cany further use or dissemination of any patient health information or records\u201d it obtained.<\/p>\n
