{"id":348445,"date":"2026-03-20T03:28:08","date_gmt":"2026-03-20T03:28:08","guid":{"rendered":"https:\/\/www.newsbeep.com\/il\/348445\/"},"modified":"2026-03-20T03:28:08","modified_gmt":"2026-03-20T03:28:08","slug":"three-men-charged-with-illegally-smuggling-advanced-ai-chips-into-china","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/il\/348445\/","title":{"rendered":"Three men charged with illegally smuggling advanced AI chips into China"},"content":{"rendered":"<p id=\"anchor-0b0dc4\" class=\"body-graf\">Three people affiliated with server maker Supermicro were charged Thursday in connection with allegations they conspired to smuggle advanced Nvidia chips into China, in violation of U.S. export controls barring their sale to China without a license.<\/p>\n<p id=\"anchor-767875\" class=\"body-graf\"><a href=\"https:\/\/www.justice.gov\/opa\/pr\/three-charged-conspiring-unlawfully-divert-cutting-edge-us-artificial-intelligence\" target=\"_blank\" rel=\"nofollow noopener\">The indictment<\/a> from the U.S. Attorney for the Southern District of New York alleges that Wally Liaw, Steven Chang, and Willy Sun conspired to sell $2.5 billion worth of servers to a company based in Southeast Asia, which then repackaged the boxes to send $510 million worth of servers with banned chips to final destinations in China.<\/p>\n<p id=\"anchor-f3388b\" class=\"body-graf\">The Department of Justice said Liaw, a U.S. citizen who co-founded Supermicro, and Sun, a citizen of Taiwan, were arrested today while Chang, also a citizen of Taiwan, remains a fugitive.<\/p>\n<p id=\"anchor-8a53b2\" class=\"body-graf\">The three men are each charged with a count of conspiring to violate the Export Controls Reform Act, carrying a maximum prison term of 20 years, if convicted. The three also each face one count of conspiring to smuggle goods and one count of conspiring to defraud the United States, each count carrying a maximum prison term of five years.<\/p>\n<p id=\"anchor-33c9a1\" class=\"body-graf\">In 2022, the U.S. tightened its export controls on selling advanced artificial intelligence chips to China, <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/speeches-remarks\/2022\/09\/16\/remarks-by-national-security-advisor-jake-sullivan-at-the-special-competitive-studies-project-global-emerging-technologies-summit\/\" target=\"_blank\" rel=\"nofollow noopener\">citing national security<\/a> national security concerns. The bans covered Nvidia\u2019s B200 and H200 graphics processing units, among the company\u2019s most advanced AI chips, and only allowed sales to China through a license granted by the government.<\/p>\n<p id=\"anchor-eabf54\" class=\"body-graf\">The three men are charged with selling servers, without a license, to China that included B200 and H200 GPUs.<\/p>\n<p id=\"anchor-5f7e9b\" class=\"body-graf\">\u201cThey did so through a tangled web of lies, obfuscation, and concealment \u2014 all to drive sales and generate revenues in violation of U.S. law,\u201d said U.S. Attorney Jay Clayton. \u201cDiversion schemes like those disrupted today generate billions of dollars in ill-gotten gains and pose a direct threat to U.S. national security.\u201d<\/p>\n<p id=\"anchor-b973bf\" class=\"body-graf\">Chang and Liaw did not immediately respond to a request for comment sent via email. Contact information couldn\u2019t be found for Sun. It was not immediately clear if the men had attorneys who could speak on their behalf. <\/p>\n<p id=\"anchor-16ea8c\" class=\"body-graf\">Liaw, 71, co-founded Supermicro in 1993, and serves as a senior vice president of business development and a member of the company\u2019s board of directors. Chang, 53, is a sales manager based out of the company\u2019s Taiwan office, and Sun, 44, is described in the indictment as a \u201cthird-party broker and \u2018fixer\u2019\u201d who worked with the other two.<\/p>\n<p id=\"anchor-1c080c\" class=\"body-graf\">Supermicro was not named in the indictment, but the company confirmed the roles of the three individuals. In a statement, the company said the two employees are on administrative leave and the relationship with the contractor has been terminated, effective immediately.<\/p>\n<p id=\"anchor-e8dd40\" class=\"body-graf\">\u201cThe conduct by these individuals alleged in the indictment is a contravention of the Company\u2019s policies and compliance controls, including efforts to circumvent applicable export control laws and regulations. Supermicro maintains a robust compliance program and is committed to full adherence to all applicable U.S. export and re-export control laws and regulations,\u201d the company said in a statement to NBC News. <\/p>\n<p id=\"anchor-19b4ab\" class=\"body-graf\">Supermicro added it is \u201ccooperating fully\u201d with the government\u2019s investigation.<\/p>\n<p id=\"anchor-c7d590\" class=\"body-graf\">In a statement, Nvidia said strict compliance is a \u201ctop priority,\u201d adding that it is working with customers and the government on compliance programs.<\/p>\n<p id=\"anchor-c3767d\" class=\"body-graf\">\u201cUnlawful diversion of controlled U.S. computers to China is a losing proposition across the board \u2014 NVIDIA does not provide any service or support for such systems, and the enforcement mechanisms are rigorous and effective,\u201d an Nvidia spokesperson said.<\/p>\n<p id=\"anchor-b3e68e\" class=\"body-graf\">The alleged scheme comes amid concerns that banned chips are slipping into China, oftentimes \u201ctransshipping\u201d to China through nearby countries like those in Southeast Asia. A <a href=\"https:\/\/www.ft.com\/content\/6f806f6e-61c1-4b8d-9694-90d7328a7b54?syn-25a6b1a6=1#:~:text=At%20least%20%241bn%20worth%20of,to%20restrain%20Beijing&#039;s%20high%2Dtech%20ambitions.\" target=\"_blank\" rel=\"nofollow noopener\">Financial Times report<\/a> from last July estimated that China was able to secure about $1 billion in advanced AI processors in the three months after President Donald Trump tightened export controls.<\/p>\n<p id=\"anchor-5f381c\" class=\"body-graf\">Chris McGuire, a senior fellow for China and emerging technologies at the Council on Foreign Relations, said the indictment shows that the government should more closely look at the \u201cglaring loopholes\u201d of exporting through Southeast Asia. <\/p>\n<p id=\"anchor-7873e1\" class=\"body-graf\">\u201cThis operation is further evidence that China is aggressively stealing U.S. technology to help power its AI industry \u2014 which is unsurprising, given U.S. AI chips are far superior to any chips the Chinese can make,\u201d Mcguire said.<\/p>\n<p id=\"anchor-38b32c\" class=\"body-graf\">More recently, the Trump administration has warmed up to allowing limited chip sales to China.<\/p>\n<p id=\"anchor-07aca4\" class=\"endmark body-graf\">In August, the White House <a href=\"https:\/\/www.nbcnews.com\/business\/business-news\/trumps-nvidia-amd-china-deal-means-world-rcna224316\" target=\"_blank\" rel=\"nofollow noopener\">agreed to let Nvidia sell<\/a> its more limited H20 chips to China on the condition that it would share 15% of chip sales with the U.S. government.
