{"id":352005,"date":"2026-03-22T08:26:20","date_gmt":"2026-03-22T08:26:20","guid":{"rendered":"https:\/\/www.newsbeep.com\/il\/352005\/"},"modified":"2026-03-22T08:26:20","modified_gmt":"2026-03-22T08:26:20","slug":"meloni-v-the-judges-high-stakes-for-italian-pm-in-vote-on-judiciary-overhaul-italy","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/il\/352005\/","title":{"rendered":"Meloni v the judges: high stakes for Italian PM in vote on judiciary overhaul | Italy"},"content":{"rendered":"<p class=\"dcr-130mj7b\">In the run-up to a referendum in Italy on a government quest to overhaul the judiciary, <a href=\"https:\/\/www.repubblica.it\/politica\/2026\/03\/05\/news\/post_fdi_si_referendum_meloni_giudici_stupratori-425202424\/\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">a campaign flyer<\/a> circulated online quoting Giorgia Meloni, the prime minister, taking aim at judges and feminists. \u201cJudges block the deportations of rapists. Where are the feminists? Vote yes \u2013 there will not be another opportunity,\u201d it read.<\/p>\n<p class=\"dcr-130mj7b\">The flyer, posted on the Facebook page of Meloni\u2019s <a href=\"https:\/\/www.theguardian.com\/world\/brothers-of-italy\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\" rel=\"nofollow noopener\" target=\"_blank\">Brothers of Italy<\/a>, a party with neofascist roots, was subsequently removed. But its tone has defined a campaign dominated by inflammatory rhetoric rather than meaningful debate.<\/p>\n<p class=\"dcr-130mj7b\">At a demonstration against the proposals, Chiara Antonini, from Rome, said: \u201cIt is shameful of Meloni to use such threatening language and to intervene on sensitive issues such as the protection of women, especially given the hypocrisy after the government <a href=\"https:\/\/www.theguardian.com\/uk-news\/2025\/nov\/27\/italy-parliament-delays-new-rape-law-sex-without-consent\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">backtracked on a law<\/a> that would have defined sex without consent as rape. The government just seems to have it in for the judiciary.\u201d<\/p>\n<p class=\"dcr-130mj7b\">After more than three years in power, Meloni is leading one of the most stable governments in the history of the Italian republic and burnishing her image abroad. Now she is putting that hard-won credibility to the test with this high-stakes referendum on Sunday and Monday.<\/p>\n<p class=\"dcr-130mj7b\">Italy\u2019s electorate will vote yes or no to approving amendments to the country\u2019s post-fascism constitution that would shake up the organisation of the justice system. But what is in essence a ballot on a technical and complex change has morphed into a de facto confidence vote on Meloni\u2019s government before a general election in 2027.<\/p>\n<p class=\"dcr-130mj7b\">Mattia Diletti, a politics professor at Sapienza University in Rome, said: \u201cIt has become a political referendum and is a power issue for her. It is essentially a choice between <a href=\"https:\/\/www.theguardian.com\/world\/giorgia-meloni\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\" rel=\"nofollow noopener\" target=\"_blank\">Giorgia Meloni<\/a> or the judges.\u201d<\/p>\n<p>Giorgia Meloni says the changes are needed to ensure impartiality, but critics believe they will have the opposite effect. Photograph: Roberto Monaldo\/LaPresse\/Shutterstock<\/p>\n<p class=\"dcr-130mj7b\">A victory for the yes campaign would usher in changes to how judges and prosecutors are recruited and governed, including separating their career paths, establishing two governing councils selected by lottery and creating a court to handle disciplinary matters.<\/p>\n<p class=\"dcr-130mj7b\">Meloni says the changes are essential for impartiality, in particular to weed out what she calls the leftwing political \u201cfactions\u201d ruling the judiciary. Opponents claim they will weaken the power and independence of judges and prosecutors, making them more vulnerable to government control in a manner akin to Viktor Orb\u00e1n\u2019s Hungary.<\/p>\n<p class=\"dcr-130mj7b\">Opinion polls before the blackout period began pointed to a close race in which the no camp, supported by a significant proportion of the opposition, had gained an edge as the debate intensified.<\/p>\n<p class=\"dcr-130mj7b\">At the end of the campaign, Meloni upped her messaging by accusing judges of <a href=\"https:\/\/www.theguardian.com\/world\/2024\/nov\/11\/italian-government-condemns-judges-ruling-to-return-migrants-from-albania\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">undermining her policies<\/a> to crack down on crime and irregular immigration. She said rejecting the changes would put public safety at risk because it would mean \u201cmore immigrants, rapists, paedophiles and drug dealers being freed\u201d. <a href=\"https:\/\/www.dire.it\/12-03-2026\/1222564-referendum-si-meloni-stupratori-non-mi-dimettero-in-nessun-caso\/\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">Speaking at a theatre in Milan<\/a> last week, she said if the ballot failed \u201cwe will find ourselves with even more negligent judges and even more surreal sentences\u201d.<\/p>\n<p class=\"dcr-130mj7b\">Carlo Nordio, the justice minister, caused a furore after referring to the judiciary\u2019s supreme council as a \u201cpara-mafia system\u201d. His chief of staff, Giusi Bartolozzi, likened the judiciary to a \u201cfiring squad\u201d that needed to be eliminated.<\/p>\n<p class=\"dcr-130mj7b\">Justice has long been a thorny issue in Italy, where the spectre of Silvio Berlusconi, the late former prime minister who faced dozens of criminal trials, looms large. Forza Italia, the party founded by Berlusconi, is a partner in Meloni\u2019s ruling coalition. <a href=\"https:\/\/www.ilcorrieredelgiorno.it\/referendum-giustizia-marina-berlusconi-vittoria-si-non-sarebbe-solo-di-mio-padre\/\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">Marina Berlusconi<\/a>, his daughter, said: \u201cA win for yes wouldn\u2019t just be my father\u2019s [victory].\u201d<\/p>\n<p class=\"dcr-130mj7b\">But Luigi Li Gotti, a criminal lawyer, believes the objective is to come down especially hard on public prosecutors, whom <a href=\"https:\/\/www.abc.net.au\/news\/2011-05-09\/berlusconi-blasts-judges-during-bribery-trial\/2713618\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">Berlusconi depicted<\/a> as \u201cthe cancer of our democracy\u201d, which could make them more reluctant to investigate high-profile corruption cases and organised crime.<\/p>\n<p class=\"dcr-130mj7b\">Li Gotti, who served as a justice undersecretary in Romano Prodi\u2019s centre-left government, came under fire from Meloni last year for <a href=\"https:\/\/www.theguardian.com\/world\/2025\/jan\/28\/giorgia-meloni-invesigation-repatriation-osama-najim-libya\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">filing a legal complaint against her<\/a> after Italy released and repatriated a Libyan general <a href=\"https:\/\/www.theguardian.com\/world\/2025\/jan\/22\/giorgia-meloni-faces-questions-after-italy-frees-libyan-general-accused-of-war-crimes\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">wanted for alleged war crimes<\/a> by the international criminal court.<\/p>\n<p class=\"dcr-130mj7b\">He said the government wanted to change the constitution to \u201cweaken prosecutors and indirectly influence\u201d investigations. Meloni claimed the changes would make Italy\u2019s notoriously sluggish justice system more efficient. \u201cBut the goal has nothing to do with improving efficiency,\u201d Li Gotti said.<\/p>\n<p class=\"dcr-130mj7b\">Antonella Attardo, a civil judge in Milan, said that behind the political vitriol was an important vote on significant changes \u201con which none of us voters have a clue\u201d.<\/p>\n<p class=\"dcr-130mj7b\">\u201cThe fear is very much about what will come afterwards,\u201d she said, citing a law change mooted by Antonio Tajani, <a href=\"https:\/\/www.ilfattoquotidiano.it\/2026\/01\/25\/riforma-giustizia-tajani-controllo-polizia-giudiziaria-notizie\/8268399\/\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">Italy\u2019s deputy prime minister<\/a>, that would make police forces more accountable to their relevant government ministries, weakening the power prosecutors have to coordinate an investigation.<\/p>\n<p class=\"dcr-130mj7b\">\u201cThis would mean that the executive decides which investigations are going to be done and how,\u201d Attardo said. \u201cThe fear is that investigations on corruption or on those close to political or economic power would be silenced.\u201d<\/p>\n<p class=\"dcr-130mj7b\">Micol Parati, a lawyer from Crema in Lombardy who attended a demonstration in Rome in support of the proposals, said: \u201cNowhere is it written that the judiciary would become slaves of the executive if the referendum wins.\u201d<\/p>\n<p class=\"dcr-130mj7b\">Li Gotti expressed concern that success for Meloni would strengthen her resolve to push forward with other controversial constitutional changes, such as a directly elected prime minister.<\/p>\n<p>Meloni appeared on the Italian rapper Fedez\u2019s Pulp podcast this week.
