(Photo by Matt Winkelmeyer\/Getty Images for The Recording Academy)\" data-lazy- data-lazy- height=\"\" width=\"\"\/><\/p>\n<p>\t\t\t<\/a><\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tWade alleges her intellectual property has been trampled by similar phrasing in The Life of a Showgirl, Swift\u2019s mega-successful 12th studio album that spent <a href=\"https:\/\/www.billboard.com\/music\/chart-beat\/taylor-swift-showgirl-twelfth-week-number-one-billboard-200-1236148560\/\" rel=\"nofollow noopener\" target=\"_blank\">12 weeks<\/a> atop the Billboard 200 and sold a record <a href=\"https:\/\/www.billboard.com\/lists\/taylor-swift-life-of-a-showgirl-number-one-billboard-200\/\" rel=\"nofollow noopener\" target=\"_blank\">4 million units<\/a> in its first week this past October. Swift had tried to trademark the album\u2019s title, but her efforts were rejected by the U.S. Patent and Trademark Office due to a \u201clikelihood of confusion\u201d with Wade\u2019s brand.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tAccording to Wade, customers have indeed been confused as to whether there\u2019s a connection between The Life of a Showgirl and \u201cConfessions of a Showgirl.\u201d But she says this hasn\u2019t caused any market harm to Swift, given the superstar\u2019s \u201csubstantially greater commercial scale.\u201d Wade alleges she\u2019s been the sole victim of the similarity, and the new Swift era \u201cthreatened to swallow\u201d her much smaller business.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t\u201cAs a solo performer operating in the same entertainment space, she found herself having to navigate the wave of consumer attention defendants\u2019 program had generated and attempting to maintain her presence in a conversation and a marketplace that defendants had overtaken,\u201d reads Wade\u2019s lawsuit.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tWade is now bringing claims for trademark infringement and unfair competition against Swift, her company TAS Rights Management, Universal Music Group (UMG) and the major label\u2019s merch subsidiary Bravado. The lawsuit seeks unspecified financial damages and an injunction stopping Swift from selling The Life of a Showgirl consumer products, including apparel, drinkware, candles and hairbrushes.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tNotably, Wade\u2019s trademark claims focus solely on merch sales related to Swift\u2019s album, not the underlying music itself. The complaint says, \u201cPlaintiff, as a performer herself, respects Taylor Swift\u2019s right to creative expression, and nothing in this action challenges it.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tSwift\u2019s reps did not immediately return a request for comment on the lawsuit on Monday.
