{"id":370735,"date":"2026-04-02T06:21:09","date_gmt":"2026-04-02T06:21:09","guid":{"rendered":"https:\/\/www.newsbeep.com\/il\/370735\/"},"modified":"2026-04-02T06:21:09","modified_gmt":"2026-04-02T06:21:09","slug":"trapped-in-the-eu-israel-impunity-loop-euobserver","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/il\/370735\/","title":{"rendered":"Trapped in the EU-Israel impunity loop \u2013 EUobserver"},"content":{"rendered":"<p>With the approval of the discriminatory death penalty bill by the Israeli parliament on 31 March \u2014 described by the EU top diplomat Kaja Kallas on behalf of the 27 as \u201ca violation of the right to life\u201d \u2014 calls for Europe to \u201cdo something\u201d continue to echo in Brussels.\u00a0<\/p>\n<p>But there is little reason to believe the <a href=\"https:\/\/euobserver.com\/209169\/no-movement-on-eu-sanctions-as-israel-passes-apartheid-death-penalty\/\" rel=\"nofollow noopener\" target=\"_blank\">statements of concern<\/a> will go further than that.<\/p>\n<p>As its largest trading partner, the EU has plentiful leverage and tools it could use to punish or pressure Israel.\u00a0<\/p>\n<p>In reality, however, these options are overshadowed by a larger strategic priority: avoiding any kind of confrontation with the US, Israel\u2019s closest ally.<\/p>\n<p>Sadly, this allows the Israeli government to continue acting with complete impunity while the international community remains largely complacent \u2014 even if this is pissing off some EU member states, such as Spain or Ireland.<\/p>\n<p>The EU is a complex mechanism of institutions, policy-making, and archetypes. And this is why, when there is political will, avenues and creative ways to make things magically happen are found, one way or another.\u00a0<\/p>\n<p>In the last two years, and in light of the devastating humanitarian situation in Gaza, most of the debate in Brussels has been focused on the suspension of the trade association agreement between the EU and Israel, which entered into force in 2020 and governs trade perks and political cooperation. And rightly so, since it remains the EU\u2019s most powerful instrument of leverage over Israel.<\/p>\n<p>In September 2025, the European Commission finally proposed the partial suspension of the EU-Israel trade deal due to Article 2 breaches (human rights violations), and amid UN <a href=\"https:\/\/www.ohchr.org\/en\/statements-and-speeches\/2025\/09\/hc-turk-updates-human-rights-council-we-need-safeguard-eighty-years\" rel=\"nofollow noopener\" target=\"_blank\">warnings<\/a> of systemic war crimes and genocidal rhetoric by Israeli officials.<\/p>\n<p>But the move was largely symbolic, lacking the member-state backing even to subject it to a vote. No surprises there. In July 2025, EU foreign ministers showed no appetite for Kallas\u2019s 10-point plan, which also included suspending visa-free travel and blocking settlement imports. And by October 2025, only a <a href=\"https:\/\/euobserver.com\/29214\/eus-horizon-suspension-sanction-for-israel-a-bad-joke-says-borrell\/\" rel=\"nofollow noopener\" target=\"_blank\">partial suspension<\/a> from the Horizon research programme had reached a formal proposal, and it, too, failed to gain sufficient support.<\/p>\n<p>Hungary, Austria, Bulgaria and the Czech Republic rejected the suspension. And a few countries, including Germany, said during that meeting that they needed more time to study the details.<\/p>\n<p>Notably, from this group, Germany issued this week strong words of condemnation against Israel\u2019s new \u2018Palestinians-only\u2019 death-penalty bill.\u00a0<\/p>\n<p>But let\u2019s be honest, the world couldn\u2019t be more tired of the statements of concern by EU leaders.<\/p>\n<p>In fact, the failure of member states to back collective action should shift the spotlight to the commission\u2019s powers. Having often centralised decision-making in other crises, Ursula von der Leyen now faces calls to show some executive muscle to pressure Israel and make sure EU law and international law are respected.<\/p>\n<p>Here is a reminder of two things von der Leyen could do:<\/p>\n<p>First, as previously published by EUobserver in <a href=\"https:\/\/euobserver.com\/25110\/europe-looks-in-the-wrong-place-when-debating-israeli-research-funding\/\" rel=\"nofollow noopener\" target=\"_blank\">an opinion article by professor Yiorgos Vassalos<\/a>, the commission could use the Model Grant Agreement\u2019s ethical clauses to suspend payments to Israeli entities immediately, as it did with Russian organisations after the invasion of Ukraine in 2022.\u00a0<\/p>\n<p>When asked whether this has ever been on the table, the commission did not respond to EUobserver\u2019s questions.<\/p>\n<p>Secondly, privacy experts are <a href=\"https:\/\/www.linkedin.com\/feed\/update\/urn:li:activity:7444991198072754176\/?originTrackingId=52DCv0r69nTDKbmrApcnng%3D%3D\" rel=\"nofollow noopener\" target=\"_blank\">calling<\/a> to suspend data transfers between the EU and Israel. The basic argument is that if the judiciary cannot protect the \u201cright to life\u201d or \u201cnon-discrimination,\u201d it is argued they cannot be trusted to protect \u201cdata privacy.\u201d<\/p>\n<p>Unlike the trade agreement (which requires member states\u2019 support), the GDPR adequacy decision is an implementing act. Advocates urge the commission to trigger Article 45(5) and suspend data flows.<\/p>\n<p>These are both small steps, but they would show that Brussels is willing to use the tools already available to act.\u00a0<\/p>\n<p>But as mentioned, this is highly unlikely.
