{"id":379762,"date":"2026-04-07T15:41:18","date_gmt":"2026-04-07T15:41:18","guid":{"rendered":"https:\/\/www.newsbeep.com\/il\/379762\/"},"modified":"2026-04-07T15:41:18","modified_gmt":"2026-04-07T15:41:18","slug":"israels-death-penalty-law-has-little-to-do-with-criminal-justice-and-everything-to-do-with-ethno-nationalism","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/il\/379762\/","title":{"rendered":"Israel\u2019s death penalty law has little to do with criminal justice and everything to do with ethno-nationalism"},"content":{"rendered":"<p>In its nearly 80-year history, the state of Israel has carried out only one court-sanctioned execution: <a href=\"https:\/\/wwv.yadvashem.org\/yv\/en\/exhibitions\/eichmann\/eichmann-trial.asp\" rel=\"nofollow noopener\" target=\"_blank\">Adolf Eichmann<\/a>, a principal architect of the Nazi holocaust. <\/p>\n<p>But under a law <a href=\"https:\/\/www.pbs.org\/newshour\/world\/israels-parliament-approves-death-penalty-for-palestinians-convicted-of-murdering-israelis\" rel=\"nofollow noopener\" target=\"_blank\">passed by the Israeli parliament<\/a> on March 30, 2026, that restraint has been thrown out the window.<\/p>\n<p>Death by hanging will now become the default sentence for some offenses \u2013 but <a href=\"https:\/\/www.hrw.org\/news\/2026\/03\/31\/israel-discriminatory-death-penalty-bill-passes\" rel=\"nofollow noopener\" target=\"_blank\">only in effect when the crime is carried out by Palestinians<\/a>. <\/p>\n<p>The law establishes two distinct judicial tracks. For the first, civilian courts in Israel may sentence defendants to death when convicted of killing with intent to \u201cnegate the existence of the State of Israel.\u201d Meanwhile, military courts in the occupied West Bank must impose death for killings classified as terrorism, with life sentences permitted only in unspecified \u201cexceptional cases.\u201d <\/p>\n<p>The bill, which also indicated that executions under the military track must be carried out within 90 days, passed by a vote of 62-48, with <a href=\"https:\/\/www.timesofisrael.com\/knesset-passes-death-penalty-law-for-palestinians-convicted-of-deadly-acts-of-terror\/\" rel=\"nofollow noopener\" target=\"_blank\">all major parties in the ruling governing coalition voting in favor<\/a>. <\/p>\n<p>The move further entrenches a two-tiered legal system in which Palestinians in the West Bank are tried exclusively in military courts \u2013 tribunals with an approximately <a href=\"https:\/\/www.btselem.org\/topic\/military_courts\" rel=\"nofollow noopener\" target=\"_blank\">96% conviction rate<\/a>, based largely on confessions often extracted under coercive conditions. <\/p>\n<p>As someone who has been <a href=\"https:\/\/scholar.google.com\/citations?user=xBQYKHwAAAAJ&amp;hl=en\" rel=\"nofollow noopener\" target=\"_blank\">studying political violence and extremism in Israel for more than 20 years<\/a>, I believe that treating this law as merely another chapter in the Israeli-Palestinian conflict would miss its deeper significance. Rather, the passing of the death penalty bill is best understood as part of the consolidation of ethno-nationalist ideology in governance, the continued erosion of institutional constraints on state power and the legal codification of retributive policies directed overwhelmingly at Palestinians.<\/p>\n<p>The long arc of institutional capture<\/p>\n<p>Proponents of the law focus on its purported deterrence effect and its potential use to prevent unpopular exchanges of convicted Palestinian terrorists for Israeli hostages. One such exchange \u2013 the <a href=\"https:\/\/www.cnn.com\/2011\/10\/17\/world\/meast\/israel-prisoner-swap-explainer\" rel=\"nofollow noopener\" target=\"_blank\">2011 Gilad Shalit<\/a> deal, in which over 1,000 Palestinian prisoners were released <a href=\"https:\/\/www.timesofisrael.com\/knesset-passes-death-penalty-law-for-palestinians-convicted-of-deadly-acts-of-terror\/\" rel=\"nofollow noopener\" target=\"_blank\">in exchange for a single Israeli soldier<\/a> \u2013 included the release of Hamas\u2019 Yahya Sinwar, who later masterminded the attack of Oct. 7, 2023. <\/p>\n<p>However, some senior Israeli security officials, including representatives from the Israel Defense Forces and the intelligence service Shin Bet, dispute these claims, arguing that there is <a href=\"https:\/\/www.timesofisrael.com\/knesset-passes-death-penalty-law-for-palestinians-convicted-of-deadly-acts-of-terror\/\" rel=\"nofollow noopener\" target=\"_blank\">no evidence capital punishment deters terrorism<\/a>. <\/p>\n<p>Potential efficacy aside, the death penalty law did not emerge from a vacuum. It is the product of a political trajectory that has unfolded over decades and has seen the once-fringe settler movement <a href=\"https:\/\/theconversation.com\/how-the-israeli-settlers-movement-shaped-modern-israel-237813\" rel=\"nofollow noopener\" target=\"_blank\">evolve into a dominant force<\/a> shaping Israeli governance. <\/p>\n<p>When Likud, the right-wing party of current Prime Minister Benjamin Netanyahu, <a href=\"https:\/\/israeled.org\/begin-and-likud-elected-to-head-israeli-government-in-landslide-victory\/\" rel=\"nofollow noopener\" target=\"_blank\">first came to power in 1977<\/a>, settlements in the occupied West Bank gained legal status in Israeli law. Since then, settlements have expanded rapidly, despite remaining illegal under international law. <\/p>\n<p>Settlers <a href=\"https:\/\/www.timesofisrael.com\/west-bank-settler-population-grew-by-nearly-3-in-2023-report\/\" rel=\"nofollow noopener\" target=\"_blank\">now represent roughly 6%<\/a> of Israelis, but their political influence is far greater than their demographic weight. Settlers and settler-aligned public figures have <a href=\"https:\/\/academic.oup.com\/edited-volume\/34274\/chapter-abstract\/290592032?redirectedFrom=fulltext\" rel=\"nofollow noopener\" target=\"_blank\">reshaped the institutional landscape<\/a> by making strategic inroads into military leadership, government ministries and party primaries. <\/p>\n<p>The ruling coalition includes ministers with explicit pro-settler and ethno-nationalist ideologies \u2013 most notably Finance Minister Bezalel Smotrich and National Security Minister Itamar Ben-Gvir. <\/p>\n<p>Their ideology promotes Jewish supremacy over the entirety of historic Palestine, including the West Bank, and regards territorial compromise with Palestinians as both a <a href=\"https:\/\/theconversation.com\/itamar-ben-gvir-and-bezalel-smotrich-the-netanyahu-government-extremists-sanctioned-by-the-uk-258644\" rel=\"nofollow noopener\" target=\"_blank\">political and theological impossibility<\/a>. <\/p>\n<p>            <img decoding=\"async\" alt=\"A man in a suit walks through a crowd\" src=\"https:\/\/www.newsbeep.com\/il\/wp-content\/uploads\/2026\/04\/file-20260406-71-9sno94.jpg\" class=\"native-lazy\" loading=\"lazy\"  \/><\/p>\n<p>              Israeli Minister of National Security Itamar Ben-Gvir marches through the Muslim quarter of Jerusalem\u2019s old walled city.<br \/>\n              <a class=\"source\" href=\"https:\/\/www.gettyimages.com\/detail\/news-photo\/israeli-minister-of-national-security-itamar-ben-gvir-news-photo\/2216729509?adppopup=true\" rel=\"nofollow noopener\" target=\"_blank\">Eyal Warshavsky\/SOPA Images\/LightRocket via Getty Images<\/a><\/p>\n<p>The inclusion of people so closely aligned with the settler movement in Netanyahu\u2019s coalition signaled that anti-Palestinian violence would, in effect, be treated as legitimate expressions of state policy. Indeed, in the past two years, <a href=\"https:\/\/theconversation.com\/west-bank-violence-is-soaring-fueled-by-a-capitulation-of-israeli-institutions-to-settlers-interests-269162\" rel=\"nofollow noopener\" target=\"_blank\">settler violence in the West Bank rose to unprecedented levels<\/a>.<\/p>\n<p>Smotrich moved to transfer control of the Civil Administration \u2013 the military bureaucracy that has governed Palestinian civilian affairs in the West Bank since 1967 \u2013 from military to finance ministry oversight, <a href=\"https:\/\/www.theguardian.com\/world\/article\/2024\/jun\/20\/idf-transfers-powers-in-occupied-west-bank-to-pro-settler-civil-servants\" rel=\"nofollow noopener\" target=\"_blank\">reducing institutional checks on settlement expansion<\/a>. Meanwhile Ben-Gvir issued over 100,000 new gun licenses, granted settlers preferential access to firearms and began <a href=\"https:\/\/www.jpost.com\/israel-news\/article-865947\" rel=\"nofollow noopener\" target=\"_blank\">transforming the police force toward aggressive, Palestinian-focused enforcement<\/a>.<\/p>\n<p>Through such moves, the line between state security apparatus and settler militancy has become virtually indistinguishable.<\/p>\n<p>The politics of retribution<\/p>\n<p>This is the context within which the death penalty legislation operates. Capital punishment has always been part of the penal code, but with the exception of Eichmann in 1962, it has never been used. This was by choice: Israel for much of its existence wanted to project an image of a democratic modern nation based on the rule of law. <\/p>\n<p>This pivot from deterrence to retribution reflects the religious-nationalist worldview that I believe now dominates Israeli governance. It is rooted in a particular strain of religious Zionism, embraced by roughly <a href=\"https:\/\/www.pewresearch.org\/religion\/2016\/03\/08\/israels-religiously-divided-society\/\" rel=\"nofollow noopener\" target=\"_blank\">20% of Israeli Jews<\/a>, that interprets the establishment of the state of Israel and its subsequent military victories as a process of divine redemption.<\/p>\n<p>Under this <a href=\"https:\/\/theconversation.com\/how-the-israeli-settlers-movement-shaped-modern-israel-237813\" rel=\"nofollow noopener\" target=\"_blank\">ideology<\/a>, the West Bank is not occupied territory but the biblical heartland of Judea and Samaria \u2013 land to which Jews hold an irrevocable, God-given claim.<\/p>\n<p>Adherents believe that accelerating this redemptive process requires total military dominance and the systematic negation of Palestinian national aspirations. <\/p>\n<p>This theology leaves little room for the restraint that characterized earlier security doctrines. Rather, Palestinians are existential obstacles to be vanquished.<\/p>\n<p>In this light, the death penalty becomes not merely a tool of criminal justice but a declaration of supremacy \u2013 an instrument through which the state enacts its divine mandate.<\/p>\n<p>Democratic backsliding<\/p>\n<p>Perhaps the most consequential dimension of the legislation is what it makes explicit. <\/p>\n<p>The existence of parallel legal systems for Israelis and Palestinians in the occupied territories is not new. The Israeli case offers a particularly instructive example because it unfolds within a nation that continues to maintain democratic institutions for its own citizens while operating an increasingly coercive regime over a subject population. <\/p>\n<p>The death penalty law deepens this contradiction, pushing Israel further along a trajectory that some analysts have described as democratic backsliding.
