{"id":380385,"date":"2026-04-07T23:28:08","date_gmt":"2026-04-07T23:28:08","guid":{"rendered":"https:\/\/www.newsbeep.com\/il\/380385\/"},"modified":"2026-04-07T23:28:08","modified_gmt":"2026-04-07T23:28:08","slug":"new-israeli-law-could-mean-death-by-default-for-palestinians-news","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/il\/380385\/","title":{"rendered":"New Israeli law could mean death by default for Palestinians &#8211; News"},"content":{"rendered":"<p>Israel\u2019s parliament, the Knesset, has passed legislation that would vastly expand capital punishment in Israel and in the occupied Palestinian territories.<\/p>\n<p class=\"mb-4 font-serif text-lg sm:text-lg group-[.is-premiumproperty]:font-sans\">The changes, made via an amendment to Israel\u2019s penal law, allow for executions without proper appeal, pardons or meaningful judicial discretion.<\/p>\n<p class=\"mb-4 font-serif text-lg sm:text-lg group-[.is-premiumproperty]:font-sans\">According to media reports, 62 of 120 Knesset members voted in favour of the bill, including Prime Minister Benjamin Netanyahu, and 48 voted against. The remainder absented themselves from the vote or abstained.<\/p>\n<p class=\"mb-4 font-serif text-lg sm:text-lg group-[.is-premiumproperty]:font-sans\">UN experts and Amnesty International have warned these new death sentencing rules would apply almost exclusively to Palestinians.<\/p>\n<p class=\"mb-4 font-serif text-lg sm:text-lg group-[.is-premiumproperty]:font-sans\">It would, they argue, entrench discrimination already identified by the International Court of Justice as amounting to apartheid. UN experts said of the bill:<\/p>\n<p class=\"w-[90%] text-center\">&#8220;Since Israeli military trials of civilians typically do not meet fair trial standards under international human rights law and humanitarian law, any resulting death sentence would further violate the right to life [\u2026] Denial of a fair trial is also a war crime.&#8221;<\/p>\n<p class=\"mb-4 font-serif text-lg sm:text-lg group-[.is-premiumproperty]:font-sans\">This development is a significant change for Israel, which has not executed anyone for more than 60 years. It reverses decades of global movement towards abolition, while normalising executions in an occupied territory.<\/p>\n<p>Death penalty as the default<\/p>\n<p class=\"mb-4 font-serif text-lg sm:text-lg group-[.is-premiumproperty]:font-sans\">These changes were made via legislation brought by National Security Minister Itamar Ben-Gvir and his far-right Otzma Yehudit party.<\/p>\n<p class=\"mb-4 font-serif text-lg sm:text-lg group-[.is-premiumproperty]:font-sans\">The Penal Bill (Amendment \u2015 Death Penalty for Terrorists) amends both Israeli civil law (applicable to Israeli settlers) and Israeli military law (applicable to Palestinians) in the occupied West Bank.<\/p>\n<p class=\"mb-4 font-serif text-lg sm:text-lg group-[.is-premiumproperty]:font-sans\">The law states, according to a Deutsche Welle media report:<\/p>\n<p class=\"w-[90%] text-center\">&#8220;Palestinians in the occupied West Bank convicted of terrorism in military courts will face a mandatory death sentence or, in the wording of the bill \u201chis sentence shall be death, and this penalty only.\u201d Only if the court determines that there are \u201cspecial reasons\u201d can it then commute the death sentence to life in prison.&#8221;<\/p>\n<p class=\"mb-4 font-serif text-lg sm:text-lg group-[.is-premiumproperty]:font-sans\">Under this change:<\/p>\n<p>prosecutors do not need to request the death penalty<br \/>\nthe defence minister may submit an opinion to the judicial panel of three military officials who only need a simple majority to impose the death penalty<br \/>\njudges need to record exceptional reasons for imposing a life sentence over the death penalty<br \/>\navenues for appeal would be tightly restricted<br \/>\nthere would be no possibility of a pardon<br \/>\npeople sentenced to death would be detained in isolated facilities that would have restricted visitor access, with legal counsel only by video link<br \/>\nexecutions (by hanging) would take place within 90 days of the final judgement.<\/p>\n<p class=\"mb-4 font-serif text-lg sm:text-lg group-[.is-premiumproperty]:font-sans\">Another yet-to-be-passed bill that may still be brought before the Knesset \u2013 the Prosecution of Participants in the October 7 Massacre Events Bill \u2013 would also see more death sentences handed down.<\/p>\n<p class=\"mb-4 font-serif text-lg sm:text-lg group-[.is-premiumproperty]:font-sans\">It establishes ad hoc military tribunals with retrospective jurisdiction to prosecute those accused of participating in the October 7 2023 Hamas-led attacks on southern Israel.<\/p>\n<p class=\"mb-4 font-serif text-lg sm:text-lg group-[.is-premiumproperty]:font-sans\">These tribunals would:<\/p>\n<p>consist of a retired district court judge and two officers qualified to serve as judges<br \/>\nbe authorised to depart from ordinary rules around evidence and procedure<br \/>\nbe able to impose the death penalty via a simple majority, without prosecutors requesting it.<\/p>\n<p class=\"mb-4 font-serif text-lg sm:text-lg group-[.is-premiumproperty]:font-sans\">Appeals and clemency mechanisms would again be extremely limited.<\/p>\n<p class=\"mb-4 font-serif text-lg sm:text-lg group-[.is-premiumproperty]:font-sans\">Taken together, the two amendments significantly expand the scope of capital punishment in Israel. They also remove many procedural safeguards.<\/p>\n<p class=\"mb-4 font-serif text-lg sm:text-lg group-[.is-premiumproperty]:font-sans\">Supporters argue capital punishment could deter future attacks and preclude hostage-taking for prisoner exchanges.<\/p>\n<p class=\"mb-4 font-serif text-lg sm:text-lg group-[.is-premiumproperty]:font-sans\">Yet, historically, Israel\u2019s intelligence services have opposed death sentences. They have argued it may encourage armed groups to kidnap Israelis as bargaining chips to prevent executions.<\/p>\n<p>International humanitarian law<\/p>\n<p class=\"mb-4 font-serif text-lg sm:text-lg group-[.is-premiumproperty]:font-sans\">Critics have argued the new changes place Israel in breach of international humanitarian law and international human rights law.<\/p>\n<p class=\"mb-4 font-serif text-lg sm:text-lg group-[.is-premiumproperty]:font-sans\">As critics point out, Israel\u2019s new death penalty rules limit access to legal counsel. They also:<\/p>\n<p>restrict appeals<br \/>\nallows trials before ad hoc military tribunals for new capital offences<br \/>\nmandate executions be carried out within 90 days.<\/p>\n<p class=\"mb-4 font-serif text-lg sm:text-lg group-[.is-premiumproperty]:font-sans\">This all runs counter to international humanitarian law.<\/p>\n<p class=\"mb-4 font-serif text-lg sm:text-lg group-[.is-premiumproperty]:font-sans\">Significant legal concerns are raised by Israel enforcing new capital offences in the occupied territory after the International Court of Justice concluded Israel\u2019s occupation violates international law and must cease.<\/p>\n<p class=\"mb-4 font-serif text-lg sm:text-lg group-[.is-premiumproperty]:font-sans\">These concerns are compounded by longstanding criticisms of Israeli military courts in the occupied West Bank, where conviction rates for Palestinian defendants reportedly exceed 99 per cent.<\/p>\n<p>International human rights law<\/p>\n<p class=\"mb-4 font-serif text-lg sm:text-lg group-[.is-premiumproperty]:font-sans\">Under international human rights law people should be guaranteed equality before the law and protected from discrimination.<\/p>\n<p class=\"mb-4 font-serif text-lg sm:text-lg group-[.is-premiumproperty]:font-sans\">But the changes passed by the Knesset this week subject Palestinians to death sentences as the default, while Israeli citizens accused of killing Palestinians would appear before civil courts. Here, capital punishment would be discretionary and far more limited.
