News July 6, U.S. District Judge Aileen M. Cannon\u00a0asserts that \u201cthe allegedly infringed material\u2014basic ideas, themes, metaphors, isolated words, and short phrases\u2014is not protected expression and cannot be infringed.\u201d<\/p>\n<p>Additionally, in order to prove copyright infringement, a plaintiff needs to provide direct evidence of copying by showing that \u201c(a) that Defendants had access to her works and (b) that the works are \u2018so substantially similar . . . that an average lay observer would recognize the alleged copy as having been appropriated from the original work.\u2019\u201d<\/p>\n<p>In this case, however, the Court ruled that Marasco \u201chas failed to plausibly allege either access or substantial\u00a0similarity, each of which is independently required to plead copying.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"Taylor Swift\u00a0has spent her whole life putting her feelings into words.
