{"id":533676,"date":"2026-07-09T21:41:13","date_gmt":"2026-07-09T21:41:13","guid":{"rendered":"https:\/\/www.newsbeep.com\/il\/533676\/"},"modified":"2026-07-09T21:41:13","modified_gmt":"2026-07-09T21:41:13","slug":"bts-hit-swim-subject-of-copyright-lawsuit-filed-by-three-songwriters-against-hybe-claiming-the-track-copied-their-demo","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/il\/533676\/","title":{"rendered":"BTS hit \u2018SWIM\u2019 subject of copyright lawsuit filed by three songwriters against HYBE, claiming the track copied their demo"},"content":{"rendered":"<p>Three Los Angeles songwriters have filed a lawsuit against HYBE and the writers behind BTS\u2018s single SWIM, alleging that the track copied a demo they had written.<\/p>\n<p><a target=\"_blank\" class=\"link-relationship\" title=\"People &gt; Steve Cooper [188 articles]\" href=\"https:\/\/www.musicbusinessworldwide.com\/people\/steve-cooper\/\" rel=\"nofollow noopener\">Steve Cooper<\/a>, Jon Sandler and Greylyn Johnson filed the complaint on Wednesday (July 8) in the US District Court for the Central District of California.<\/p>\n<p>They allege that SWIM, the lead single from BTS\u2019s album Arirang, reproduces a composition of the same name that the three of them wrote and recorded as a demo in early 2025.<\/p>\n<p>The plaintiffs completed their SWIM demo in March 2025 and began sending it to industry contacts to gauge interest, according to the complaint, obtained by MBW and which you can <a class=\"link-internal\" href=\"https:\/\/www.musicbusinessworldwide.com\/files\/2026\/07\/BTS-SWIM-Lawsuit.pdf\" rel=\"nofollow noopener\" target=\"_blank\">read in full here<\/a>.<\/p>\n<p>Among the recipients, the lawsuit says, was the publishing company Artist Publishing Group (<a target=\"_blank\" class=\"link-relationship\" title=\"Companies &gt; Artist Partner Group (APG) [52 articles]\" href=\"https:\/\/www.musicbusinessworldwide.com\/companies\/artist-partner-group-apg\/\" rel=\"nofollow noopener\">APG<\/a>), a named defendant.<\/p>\n<p>The complaint alleges that APG representatives listened to the demo and shared it with others, including Derrick Milano, a songwriter signed to APG and a credited co-writer of BTS\u2019s SWIM.<\/p>\n<p>A listening report from the music-sharing platform Disco.ac, attached to the complaint as an exhibit, shows that the demo was played by those reps, the plaintiffs say.<\/p>\n<p>The lawsuit says the plaintiffs also sent the recording to Noreen Prunier-Winans, whom it describes as head of A&amp;R and publishing at ATG Group, and that she shared it with other songwriters and producers.<\/p>\n<p>BTS worked on Arirang in Los Angeles in 2025, meeting songwriters and producers to select material, the complaint says.<\/p>\n<p>It cites the <a target=\"_blank\" class=\"link-relationship\" title=\"Companies &gt; Netflix [505 articles]\" href=\"https:\/\/www.musicbusinessworldwide.com\/companies\/netflix\/\" rel=\"nofollow noopener\">Netflix<\/a> documentary BTS: The Return as referencing a track titled SWIM among the material.<\/p>\n<p>The Arirang album, containing SWIM, was released in March 2026.<\/p>\n<p>The plaintiffs say that after repeated listens they concluded BTS\u2019s SWIM had copied their work, and in April 2026 engaged a musicologist, Alexander Stewart, to compare the two songs.<\/p>\n<p>In a preliminary report quoted in the complaint, Stewart refers to the plaintiffs\u2019 song as \u201cSJG\u201d and to the BTS track as \u201cBTS\u201d.<\/p>\n<p>\u201cMy research, investigation and analysis have determined that the versions of these songs titled \u2018Swim\u2019 contain significant similarities and that these elements in BTS were unequivocally taken from SJG,\u201d Stewart writes.<\/p>\n<p>\u201cThese similarities encompass the signature phrase (or \u2018hook\u2019) referencing the title, unusual harmonies, textures, and rhythmic and lyrical elements. A prior art search has revealed no other songs containing this expression and no songs as similar to these songs as they are to each other,\u201d Stewart adds.<\/p>\n<p>\u201cIn my expert opinion, independent creation of BTS can be ruled out and copying is the inescapable conclusion,\u201d Stewart writes.<\/p>\n<p>Stewart concludes that BTS\u2019s SWIM \u201cwould not exist in anything like its present form without the pervasive influence of\u201d the plaintiffs\u2019 song.<\/p>\n<p>The plaintiffs registered their SWIM composition with the US Copyright Office, according to a certificate attached to the complaint.<\/p>\n<p>They are seeking an injunction against further use of BTS\u2018s SWIM, along with damages and a share of the profits, in amounts to be determined at trial.<\/p>\n<p>In the alternative, the plaintiffs ask to be credited as co-writers of \u201cnearly all\u201d of BTS\u2018s SWIM and awarded nearly all of the profits it has generated, plus an accounting.<\/p>\n<p>The song\u2019s other writers named as defendants are James Essien, Jamison Baken (who records as Leclair), Ryan Tedder, Tyler Spry, Sean Foreman and Kirsten Spencer, alongside Milano.<\/p>\n<p>BTS\u2019s RM and the HYBE producer Pdogg are also credited as writers of SWIM but are not named as defendants.<\/p>\n<p>Also named as defendants are HYBE Co., HYBE America and HYBE Music Services, along with the BTS label Big Hit Music.<\/p>\n<p>The complaint says the plaintiffs contacted the defendants before filing on July 8 in an attempt to resolve the dispute, but that they either did not respond or could not reach a resolution.
