The inclusion of habitat in the \u201charm\u201d definition was upheld by the supreme court in 1995, which ruled in support of old-growth forest protections relied on by endangered spotted owls.<\/p>\n<p class=\"dcr-1s160rg\">But despite widespread public support for a strong ESA \u2013 and <a href=\"https:\/\/www.regulations.gov\/document\/FWS-HQ-ES-2025-0034-0001\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">hundreds of thousands of public comments submitted opposing<\/a> the change \u2013 the Department of the Interior and Department of Commerce reframed the definition as \u201cregulatory intrusion that interfered with private property rights\u201d and announced it would be rescinded.<\/p>\n<p class=\"dcr-1s160rg\">Habitat destruction is <a href=\"https:\/\/wwf.panda.org\/discover\/our_focus\/wildlife_practice\/problems\/habitat_loss_degradation\/\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">considered the strongest driver of species loss<\/a>. The legislation has helped safeguard more than 1,700 species and their habitats, <a href=\"https:\/\/peerj.com\/articles\/6803\/\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">preventing 99%<\/a> of those listed from going extinct, most famously the bald eagle. Experts fear the move could cause catastrophic damage to species already close to the brink.<\/p>\n<p class=\"dcr-1s160rg\">\u201cFor the first time ever, a presidential administration now claims that species protected by the Endangered Species Act shouldn\u2019t be safe from habitat modification that destroys where they live, raise their young, or search for food,\u201d Earthjustice attorney Kristen Boyles said in a statement.<\/p>\n<p class=\"dcr-1s160rg\">Stephanie Kurose, deputy director of government affairs at the Center for Biological Diversity, said the plan would be \u201ca death sentence for wolverines, monarch butterflies, Florida manatees and so many other animals and plants that desperately need our help\u201d, when the proposal was first released last year.<\/p>\n<p class=\"dcr-1s160rg\">The erosion in regulations comes amid <a href=\"https:\/\/www.theguardian.com\/environment\/series\/the-age-of-extinction\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">an extinction emergency<\/a>, as the climate crisis adds new challenges to recovery. Roughly 1m species are threatened with extinction, according to a 2019 assessment from the Intergovernmental Science-Policy Platform on Biodiversity and Ecosystem Services (IPBES), including roughly 40% of amphibians, and a third of reef-forming corals, marine mammals and sharks.<\/p>\n<p class=\"dcr-1s160rg\">Insects, considered the bedrock of biodiversity and the foundation of most ecosystems on Earth, are in rapid decline. About 80% of insect species have yet to be identified and some are disappearing before they can be named.<\/p>\n<p class=\"dcr-1s160rg\">Impacts to habitat can threaten a broader network of interconnected species and ecosystems. Landscape modification can trigger a devastating domino effect, where the loss of one species leads to the extinction of others that depend on it.<\/p>\n<p class=\"dcr-1s160rg\">The US public broadly supports species protections. A 2023 poll found that 80% of registered voters <a href=\"https:\/\/defenders.org\/newsroom\/new-defenders-poll-shows-american-public-overwhelmingly-supports-endangered-species-act\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">favored full-funding of the ESA<\/a> and 73% view biodiversity as important to their everyday lives.<\/p>\n<p class=\"dcr-1s160rg\">But <a href=\"https:\/\/www.theguardian.com\/us-news\/trump-administration\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\" rel=\"nofollow noopener\" target=\"_blank\">Trump administration<\/a> officials claim the rules were changed to better align with what they believe is the original intent of the law. Accusing federal agencies of abusing the ESA to \u201cobstruct lawful land use and burden American families and businesses\u201d, interior secretary Doug Burgum said in a statement that the protections \u201cturned routine activity into a regulatory trap\u201d.<\/p>\n<p class=\"dcr-1s160rg\">In the announcement, officials said \u201cactions that directly injure or kill listed wildlife will continue to be prohibited\u201d.<\/p>\n<p class=\"dcr-1s160rg\">But these rescinded rules are part of a broader deregulatory effort by <a href=\"https:\/\/www.theguardian.com\/us-news\/donaldtrump\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">Donald Trump<\/a>, who has made it a priority to <a href=\"https:\/\/www.theguardian.com\/environment\/2025\/feb\/13\/endangered-extinction-us-nature-protections-survive-trump-god-squad-aoe\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">dismantle endangered species protections<\/a> to boost energy extraction and industrial access, even in the US\u2019s most sensitive and vulnerable natural areas.<\/p>\n<p class=\"dcr-1s160rg\">In March, the president convened the so-called \u201cGod squad\u201d, named for its ability to decide a species\u2019 fate, <a href=\"https:\/\/www.theguardian.com\/us-news\/2026\/mar\/30\/trump-protections-endangered-species-gulf-of-mexico\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">to expand oil and gas industry operations in the Gulf of Mexico<\/a>.
