{"id":544299,"date":"2026-07-16T12:09:18","date_gmt":"2026-07-16T12:09:18","guid":{"rendered":"https:\/\/www.newsbeep.com\/il\/544299\/"},"modified":"2026-07-16T12:09:18","modified_gmt":"2026-07-16T12:09:18","slug":"nzs-overhaul-of-nature-protection-laws-is-a-chance-to-move-away-from-fortress-conservation","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/il\/544299\/","title":{"rendered":"NZ\u2019s overhaul of nature protection laws is a chance to move away from \u2018fortress conservation\u2019"},"content":{"rendered":"<p>Fierce opposition from <a href=\"https:\/\/www.forestandbird.org.nz\/resources\/conservation-law-must-deliver-protections-new-zealanders-demand\" rel=\"nofollow noopener\" target=\"_blank\">environmental organisations<\/a> and the <a href=\"https:\/\/www.acat.org.nz\/legislation\/outdoor-recreation-sector-unites-against-the-conservation-amendment-bill\" rel=\"nofollow noopener\" target=\"_blank\">outdoor recreation sector<\/a> has forced the government to <a href=\"https:\/\/www.doc.govt.nz\/news\/media-releases\/2026-media-releases\/government-acts-on-conservation-bill-concerns\/\" rel=\"nofollow noopener\" target=\"_blank\">backflip on one of the most contentious proposed changes<\/a> in its reform plan for conservation management. <\/p>\n<p>Earlier this month, Minister for Conservation Tama Potaka told a conference he would <a href=\"https:\/\/www.rnz.co.nz\/news\/politics\/620847\/controversial-clause-in-conservation-amendment-bill-that-allows-sale-of-conservation-land-to-be-removed\" rel=\"nofollow noopener\" target=\"_blank\">remove a controversial clause<\/a> from the <a href=\"https:\/\/www3.parliament.nz\/en\/pb\/sc\/make-a-submission\/document\/54SCENV_SCF_BD7D0F89-D8CB-42F7-9C5F-08DEABEDA048\/conservation-amendment-bill\" rel=\"nofollow noopener\" target=\"_blank\">Conservation Amendment Bill<\/a> that would have allowed more conservation land to be sold.<\/p>\n<p>But the bill contains other, no less concerning changes. This includes the proposal of a new \u201c<a href=\"https:\/\/www.legislation.govt.nz\/bill\/government\/2026\/309\/en\/latest\/#LMS1601300\" rel=\"nofollow noopener\" target=\"_blank\">economic opportunity<\/a>\u201d function for the Department of Conservation (<a href=\"https:\/\/www.doc.govt.nz\/\" rel=\"nofollow noopener\" target=\"_blank\">DOC<\/a>), requiring it to: <\/p>\n<p>recognise the economic opportunities that arise from the use and development of land and other resources managed by the department, and to enable this use and development to the greatest extent practicable. <\/p>\n<p>The reforms would also relegate the New Zealand Conservation Authority and regional conservation boards to <a href=\"https:\/\/www.legislation.govt.nz\/bill\/government\/2026\/309\/en\/latest\/#LMS1601302\" rel=\"nofollow noopener\" target=\"_blank\">mere advisory bodies<\/a> and give the minister broad powers to make policies to deliver on the government\u2019s development agenda.<\/p>\n<p>We argue that reform of the conservation system in a settler-colonial country such as Aotearoa New Zealand raises inevitable questions about who gets to decide where and how conservation lands are protected, and whose values guide the process.<\/p>\n<p>Values in conservation<\/p>\n<p>Many New Zealanders share a <a href=\"https:\/\/www.doc.govt.nz\/globalassets\/documents\/conservation\/biodiversity\/anzbs-2020.pdf\" rel=\"nofollow noopener\" target=\"_blank\">deep connection<\/a> to conservation lands. Public mobilisation in opposition to the conservation reform reflects widely held concerns that their next hike or hunt will be less than idyllic. <\/p>\n<p>But this connection is underpinned by European conservation values, including the concept of \u201c<a href=\"https:\/\/www.tandfonline.com\/doi\/full\/10.1080\/21550085.2021.2002625?needAccess=true\" rel=\"nofollow noopener\" target=\"_blank\">fortress conservation<\/a>\u201d. This model of conservation prioritises the preservation of pristine natural landscapes and native species, \u201cprotecting\u201d them from people\u2019s activities which are assumed to be inherently harmful. <\/p>\n<p>Ironically, fortress conservation has enabled <a href=\"https:\/\/www.tandfonline.com\/doi\/full\/10.1080\/03066150.2011.607695?needAccess=true\" rel=\"nofollow noopener\" target=\"_blank\">lands not classified as protected to be over-exploited<\/a>.<\/p>\n<p>Such \u201cpreservationist\u201d approaches to conservation have also created protected areas by removing Indigenous peoples from their ancestral territories or by <a href=\"https:\/\/www.mdpi.com\/2073-445X\/9\/3\/65\" rel=\"nofollow noopener\" target=\"_blank\">restricting customary resource use<\/a>, sometimes through violent means. <\/p>\n<p>The <a href=\"https:\/\/www.teaonews.co.nz\/2025\/08\/18\/ta-tumus-last-great-battle-the-return-of-tongariro\/\" rel=\"nofollow noopener\" target=\"_blank\">harm caused to M\u0101ori<\/a> by separating them from the use and governance of their ancestral lands in the name of conservation has been acknowledged in multiple <a href=\"https:\/\/www.waitangitribunal.govt.nz\/en\/inquiries\/district-inquiries\/kaipara-9\" rel=\"nofollow noopener\" target=\"_blank\">Waitangi Tribunal reports<\/a> and <a href=\"https:\/\/www.legislation.govt.nz\/act\/public\/2014\/51\/en\/latest\/#DLM6183601\" rel=\"nofollow noopener\" target=\"_blank\">Treaty settlements<\/a>. <\/p>\n<p><a href=\"https:\/\/whakatau.govt.nz\/assets\/Publications\/OIA-responses\/Tongariro-National-Park.pdf\" rel=\"nofollow noopener\" target=\"_blank\">Significant tracts<\/a> of conservation land remain subject to unresolved legal claims by M\u0101ori. Some iwi (tribes or first nations) and hap\u016b (sub-tribes or kinship groups) have attempted to <a href=\"https:\/\/www.rnz.co.nz\/news\/te-ao-maori\/597037\/new-te-au-roa-o-te-rakihouia-marine-reserves-coming-into-force-in-otago\" rel=\"nofollow noopener\" target=\"_blank\">collaborate<\/a> with DOC to practice their rangatiratanga (legal and political authority) and kaitiakitanga (caretaking or guardianship) over ancestral lands. Others have shown leadership in conservation institutions such as the <a href=\"https:\/\/www.doc.govt.nz\/about-us\/statutory-and-advisory-bodies\/nz-conservation-authority\/nzca-media-releases\/odg-report-a-useful-document-to-explore-opportunity-in-conservation\/\" rel=\"nofollow noopener\" target=\"_blank\">New Zealand Conservation Authority<\/a> and <a href=\"https:\/\/whc.unesco.org\/document\/153428\" rel=\"nofollow noopener\" target=\"_blank\">UNESCO<\/a>. <\/p>\n<p>Aotearoa leads in environmental governance<\/p>\n<p>It is not without irony that New Zealand\u2019s most progressive environmental governance models have emerged from Treaty settlements that interact with conservation lands. This includes the legal personhood granted to the <a href=\"https:\/\/www.tandfonline.com\/doi\/full\/10.1080\/13642987.2024.2314532\" rel=\"nofollow noopener\" target=\"_blank\">Whanganui River<\/a>, <a href=\"https:\/\/ecojurisprudence.org\/initiatives\/te-urewera-act-2014\/\" rel=\"nofollow noopener\" target=\"_blank\">Te Urewera<\/a> and <a href=\"https:\/\/www.theguardian.com\/world\/2025\/jan\/30\/taranaki-mounga-new-zealands-second-highest-mountain-granted-same-legal-rights-as-a-person\" rel=\"nofollow noopener\" target=\"_blank\">Taranaki Mounga<\/a>. <\/p>\n<p>These models have captured <a href=\"https:\/\/researchbriefings.files.parliament.uk\/documents\/CBP-10496\/CBP-10496.pdf\" rel=\"nofollow noopener\" target=\"_blank\">global attention<\/a> as a gold standard for environmental governance. They signal a different way to <a href=\"https:\/\/www.tandfonline.com\/doi\/full\/10.1080\/03036758.2022.2143383\" rel=\"nofollow noopener\" target=\"_blank\">value nature<\/a>, grounded in relatedness and reciprocity between people and natural features, in which the land provides food, employment and identity for people and they care for it in return. <\/p>\n<p>Such models also open new spaces for iwi and hap\u016b to govern ancestral landscapes according to their own <a href=\"https:\/\/www.nature.com\/articles\/s41599-025-04382-1\" rel=\"nofollow noopener\" target=\"_blank\">legal systems<\/a> and worldviews, and for local governments, community members and industry groups to reconsider their relationship with nature. <\/p>\n<p>As such, they enable people to move beyond a binary approach of preserving pristine landscapes and developing everything else. Other countries have been inspired by legal innovations in Aotearoa to reevaluate their relationships to nature, including the United Kingdom\u2019s <a href=\"https:\/\/post.parliament.uk\/rights-of-nature-ethical-frameworks\/\" rel=\"nofollow noopener\" target=\"_blank\">Rights of Nature Bill<\/a> which passed its second reading in parliament. <\/p>\n<p>Despite the broad acclaim these legal personhood models have received, New Zealand\u2019s government is unravelling protections for the environment. It has <a href=\"https:\/\/www.rnz.co.nz\/news\/environment\/596538\/ministry-for-the-environment-officially-scrapped-in-parliament-vote\" rel=\"nofollow noopener\" target=\"_blank\">disestablished the Ministry for the Environment<\/a>, attempted to <a href=\"https:\/\/www.forestandbird.org.nz\/resources\/fisheries-amendment-erases-what-good-about-act\" rel=\"nofollow noopener\" target=\"_blank\">weaken environmental protections in fisheries laws<\/a>, and plans to reform the Resource Management Act to enable more widespread \u201cfast-track\u201d development. <\/p>\n<p>The proposed conservation reforms place further strain on the government\u2019s already <a href=\"https:\/\/www.teaonews.co.nz\/2026\/05\/14\/ngai-tahu-warns-conservation-reforms-undermine-treaty-settlements-minister-defends-it\/\" rel=\"nofollow noopener\" target=\"_blank\">uneasy relationship<\/a> with Treaty partners, with concerns it will infringe both settled and unsettled Treaty rights. <\/p>\n<p>Although the bill would require some consultation with iwi and hap\u016b, the final decision would rest with the same minister who wants to shift DOC\u2019s functions away from conservation and towards development. <\/p>\n<p>Unsurprisingly, M\u0101ori are once again using various means to <a href=\"https:\/\/www.courtsofnz.govt.nz\/assets\/cases\/2026\/2026-NZHC-722.pdf\" rel=\"nofollow noopener\" target=\"_blank\">challenge the Crown\u2019s conduct as a Treaty partner<\/a>.<\/p>\n<p>Conservation reform fit for Aotearoa<\/p>\n<p>The government argued Aotearoa\u2019s conservation regime needed to be \u201c<a href=\"https:\/\/www.beehive.govt.nz\/release\/landmark-conservation-reform-bill-will-boost-economy-and-protect-nature\" rel=\"nofollow noopener\" target=\"_blank\">modernised<\/a>\u201d. This is uncontroversial. It is an argument the <a href=\"https:\/\/eds.org.nz\/our-work\/policy\/projects\/conservation-reform-project\/\" rel=\"nofollow noopener\" target=\"_blank\">conservation sector<\/a> and iwi and hap\u016b have made for decades. <\/p>\n<p>Until now, policymakers have struggled to reconcile the competing values attached to Aotearoa\u2019s conservation estate, and the extent to which it should be preserved or developed. <\/p>\n<p>The government should learn from what Aotearoa has done well in the past and take up this opportunity to design lasting and equitable conservation reforms that uphold the rights and values of people with interests in conservation lands. <\/p>\n<p>Only then can we move towards a conservation system that reflects Aotearoa\u2019s local context and the value of partnership embodied in Te Tiriti o Waitangi. <\/p>\n<p>It is time to abandon a European-style \u201clock it or lose it\u201d approach to conservation.
