{"id":551209,"date":"2026-07-20T21:38:09","date_gmt":"2026-07-20T21:38:09","guid":{"rendered":"https:\/\/www.newsbeep.com\/il\/551209\/"},"modified":"2026-07-20T21:38:09","modified_gmt":"2026-07-20T21:38:09","slug":"colorado-was-the-first-state-to-cap-a-drugs-price-then-a-federal-court-stepped-in","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/il\/551209\/","title":{"rendered":"Colorado was the first state to cap a drug\u2019s price \u2013 then a federal court stepped in"},"content":{"rendered":"<p>Colorado is one of a handful of states with a <a href=\"https:\/\/leg.colorado.gov\/bills\/sb21-175\" rel=\"nofollow noopener\" target=\"_blank\">review board for drug prices<\/a> and one of only four with a board empowered to set upper limits on what state agencies, insurers and other purchasers may pay or be reimbursed for certain high-cost drugs dispensed to patients in the state.<\/p>\n<p>In fall 2025, the <a href=\"https:\/\/www.enbrel.com\" rel=\"nofollow noopener\" target=\"_blank\">Colorado board capped Enbrel<\/a>, an immunosuppressant <a href=\"https:\/\/www.amgen.com\" rel=\"nofollow noopener\" target=\"_blank\">drug made by Amgen<\/a> used to treat rheumatoid arthritis, psoriasis and other autoimmune conditions, at US$600 per weekly dose. That\u2019s about $31,200 per year, which is much less than the <a href=\"https:\/\/doi.colorado.gov\/sites\/doi\/files\/documents\/Enbrel%20UPL%20graph%20packet%20%28PUBLIC%20COPY%29.pdf\" rel=\"nofollow noopener\" target=\"_blank\">approximately $53,000 the average Colorado health plan paid<\/a> for the drug in 2023. <\/p>\n<p>The price cap was <a href=\"https:\/\/doi.colorado.gov\/sites\/doi\/files\/documents\/Adopted%20UPL%20Rule%20for%20Enbrel_1.pdf\" rel=\"nofollow noopener\" target=\"_blank\">set to take effect<\/a> on Jan. 1, 2027. But a <a href=\"https:\/\/litigationtracker.law.georgetown.edu\/litigation\/amgen-inc-et-al-v-mizner-et-al-ii\/\" rel=\"nofollow noopener\" target=\"_blank\">lawsuit<\/a> brought by Amgen could delay or block it altogether.<\/p>\n<p>The cap set by the Colorado board is roughly in line with the <a href=\"https:\/\/www.cms.gov\/newsroom\/fact-sheets\/medicare-drug-price-negotiation-program-negotiated-prices-initial-price-applicability-year-2026\" rel=\"nofollow noopener\" target=\"_blank\">maximum fair price the federal government negotiated<\/a> for Enbrel under Medicare, which took effect in January 2026.<\/p>\n<p>The list price of Enbrel, which has been on the market since 1998, has <a href=\"https:\/\/www.denver7.com\/news\/local-news\/judge-suspends-colorados-price-cap-on-prescription-drug-embrel-while-lawsuit-plays-out\" rel=\"nofollow noopener\" target=\"_blank\">risen by more than 1,500% since its launch<\/a>. Amgen generated <a href=\"https:\/\/www.amgen.com\/newsroom\/press-releases\/2026\/02\/amgen-reports-fourth-quarter-and-full-year-2025-financial-results\" rel=\"nofollow noopener\" target=\"_blank\">$2.23 billion in sales<\/a> in 2025 alone.<\/p>\n<p>I study <a href=\"https:\/\/papers.ssrn.com\/sol3\/cf_dev\/AbsByAuth.cfm?per_id=6533162\" rel=\"nofollow noopener\" target=\"_blank\">how patent law and drug regulation shape access to medicine<\/a>. This case sits at the center of a fight that will determine whether states can do more than document high drug prices and make policy recommendations. Its outcome could decide whether states such as Colorado can meaningfully regulate drug prices, or whether federal patent law will stand in their way. <\/p>\n<p>The lawsuit<\/p>\n<p>In <a href=\"https:\/\/litigationtracker.law.georgetown.edu\/litigation\/amgen-inc-et-al-v-mizner-et-al-ii\/\" rel=\"nofollow noopener\" target=\"_blank\">Amgen Inc. v. Mizner<\/a>, Chief Judge Daniel D. Domenico <a href=\"https:\/\/litigationtracker.law.georgetown.edu\/wp-content\/uploads\/2025\/10\/gov.uscourts.cod_.248711.66.0.pdf\" rel=\"nofollow noopener\" target=\"_blank\">granted Amgen a preliminary injunction<\/a> on July 1, 2026. The ruling barred the Colorado Prescription Drug Affordability Review Board from enforcing the upper payment limit it set for Enbrel. <\/p>\n<p>A <a href=\"https:\/\/litigationtracker.law.georgetown.edu\/litigation\/amgen-inc-et-al-v-colorado-prescription-drug-affordability-review-board-et-al\/\" rel=\"nofollow noopener\" target=\"_blank\">prior lawsuit<\/a> in the same court, filed in 2024 after the Colorado review board selected Enbrel for review, was <a href=\"https:\/\/litigationtracker.law.georgetown.edu\/wp-content\/uploads\/2024\/03\/Amgen_2025.03.28_MEMORANDUM-OPINION-AND-ORDER.pdf\" rel=\"nofollow noopener\" target=\"_blank\">dismissed in March 2025<\/a> by Judge Nina Y. Wang.<\/p>\n<p>The court reasoned that Amgen, as a manufacturer at the top of the supply chain, was not directly regulated by the law, which applied only to downstream transactions, and thus had no right to sue the state. Those transactions include pharmacy-to-consumer sales, payer reimbursements, and pharmacies\u2019 and providers\u2019 purchases. The court also reasoned that with no upper payment limit yet set, any injury was \u201ctoo speculative to support standing.\u201d Amgen refiled the present suit once Colorado actually set its upper payment limit.<\/p>\n<p>            The Colorado Prescription Drug Affordability Board announced it would cap prices for the drug Enbrel in 2025, as reported by Fox31 Denver.<\/p>\n<p>Amgen\u2019s challenge rests on the doctrine of patent preemption. Under the <a href=\"https:\/\/constitution.congress.gov\/browse\/essay\/artVI-C2-1\/ALDE_00013395\/\" rel=\"nofollow noopener\" target=\"_blank\">U.S. Constitution\u2019s supremacy clause<\/a>, when a state law conflicts with a federal law, the state law is invalidated, or \u201cpreempted,\u201d by the federal law. While federal patent law does not expressly bar states from capping drug prices, Amgen argued that the cap is preempted because it interferes with patent law\u2019s core objective of allowing inventors to recoup the costs of research and development with a limited monopoly.<\/p>\n<p>A patent gives its holder roughly 20 years to <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/35\/154\" rel=\"nofollow noopener\" target=\"_blank\">exclude others from making, selling and using an invention<\/a>. Drugmakers argue that they need that window to earn back the <a href=\"https:\/\/doi.org\/10.1001\/jamanetworkopen.2024.15445\" rel=\"nofollow noopener\" target=\"_blank\">hundreds of millions to billions of dollars<\/a> they say it takes to bring a new medicine to market. However, researchers have <a href=\"https:\/\/www.rand.org\/news\/press\/2025\/01\/07.html\" rel=\"nofollow noopener\" target=\"_blank\">disputed those figures as inflated<\/a> and difficult to verify. <\/p>\n<p>The preemption argument is based on the U.S. Court of Appeals for the Federal Circuit\u2019s 2007 decision in <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-federal-circuit\/1396804.html\" rel=\"nofollow noopener\" target=\"_blank\">Biotechnology Industry Organization v. District of Columbia<\/a>, which struck down a Washington, D.C., drug-pricing law. <\/p>\n<p>In the Colorado case, Judge Domenico <a href=\"https:\/\/litigationtracker.law.georgetown.edu\/wp-content\/uploads\/2025\/10\/gov.uscourts.cod_.248711.66.0.pdf\" rel=\"nofollow noopener\" target=\"_blank\">viewed the 2007 decision as binding<\/a>, reasoning that balancing innovators\u2019 profits and consumers\u2019 access to innovation is a task exclusively for Congress, which it undertook in the Patent Act.<\/p>\n<p>The court also rejected the board\u2019s argument that the cap only affects what downstream purchasers pay, writing that \u201cit is not necessary to unravel the entire system to understand that, as a result of Colorado\u2019s cap, Amgen will receive less money from its wholesalers and will fare more poorly in negotiations with other purchasers in Colorado and elsewhere.\u201d<\/p>\n<p>Why the ruling is contested<\/p>\n<p>Still, the fight isn\u2019t over.<\/p>\n<p>That\u2019s because patents confer a <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/35\/154\" rel=\"nofollow noopener\" target=\"_blank\">right to exclude competitors<\/a>, not an affirmative right to sell, much less to recoup a particular profit. The court conceded this point, yet it treated any state-imposed reduction in Amgen\u2019s expected profits as an obstacle to Congress\u2019 purpose of balancing profits and access to innovation in the Patent Act. <\/p>\n<p>Governments routinely limit what patent owners earn. For example, the U.S. Supreme Court has held that states are <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/103\/344\/\" rel=\"nofollow noopener\" target=\"_blank\">permitted to tax sales<\/a> of or <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/97\/501\/\" rel=\"nofollow noopener\" target=\"_blank\">outright ban<\/a> inventions that happen to be patented. In 2003, the Supreme Court <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/538\/644\/\" rel=\"nofollow noopener\" target=\"_blank\">upheld a Maine program<\/a> designed to pressure drug manufacturers into lowering prices. <\/p>\n<p>And federal courts have <a href=\"https:\/\/www.healthaffairs.org\/content\/forefront\/ira-litigation-pharma-s-failed-challenges-medicare-drug-pricing\" rel=\"nofollow noopener\" target=\"_blank\">uniformly rejected<\/a> the pharmaceutical industry\u2019s challenges to Medicare drug price negotiation.<\/p>\n<p>The same logic could apply to the <a href=\"https:\/\/www.ncsl.org\/technology-and-communication\/right-to-repair-2023-legislation\" rel=\"nofollow noopener\" target=\"_blank\">right-to-repair laws<\/a> two dozen states have enacted, which require manufacturers such as <a href=\"https:\/\/www.404media.co\/apple-is-selling-ipad-repair-parts-for-astronomical-prices\/\" rel=\"nofollow noopener\" target=\"_blank\">Apple<\/a> and <a href=\"https:\/\/www.ftc.gov\/news-events\/news\/press-releases\/2026\/07\/ftc-states-secure-settlement-deere-company-advancing-farmers-right-repair\" rel=\"nofollow noopener\" target=\"_blank\">John Deere<\/a> to sell repair parts \u2013 many of them patented \u2013 at fair and reasonable prices. An overbroad reading of patent preemption would <a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=5418435\" rel=\"nofollow noopener\" target=\"_blank\">effectively gut state right-to-repair laws<\/a>, enabling patentees to exert extraordinary control over downstream prices of consumer goods. And prescription <a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=6858502\" rel=\"nofollow noopener\" target=\"_blank\">drugs are no exception<\/a>. <\/p>\n<p>            Colorado passed a right-to-repair law in 2024 that provides consumers with more choices to fix their digital electronic devices, as reported by 9News.<\/p>\n<p>There are also differences between the two laws the court treated as equivalent. The D.C. law <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-federal-circuit\/1396804.html\" rel=\"nofollow noopener\" target=\"_blank\">penalized manufacturers<\/a> for \u201cexcessive\u201d pricing of patented drugs, specifically targeting patented inventions. <a href=\"https:\/\/www.law.cornell.edu\/regulations\/colorado\/3-CCR-702-9-3.1\" rel=\"nofollow noopener\" target=\"_blank\">Colorado\u2019s criteria<\/a> apply to all drugs, patented or not. Furthermore, the Colorado law gives manufacturers a voice in the review by permitting them to submit data and participate in hearings before any upper payment limit is set.<\/p>\n<p><a href=\"https:\/\/litigationtracker.law.georgetown.edu\/litigation\/amgen-inc-et-al-v-mizner-et-al-ii\/\" rel=\"nofollow noopener\" target=\"_blank\">Domenico offered that Colorado<\/a> may pursue affordability through \u201csubsidization\u201d or \u201cusing its market power to negotiate lower prices,\u201d just not \u201cby capping the price of a patented drug.\u201d <\/p>\n<p>What happens next?<\/p>\n<p>A <a href=\"https:\/\/www.law.cornell.edu\/wex\/preliminary_injunction\" rel=\"nofollow noopener\" target=\"_blank\">preliminary injunction<\/a> is not a final ruling.<\/p>\n<p>Because the injunction paused the cap before it ever took effect, the pressure on Amgen to reduce the price of Enbrel or pull it from the Colorado market is now on hold. Because the case arises under patent law, any appeal would be heard by the <a href=\"https:\/\/www.cafc.uscourts.gov\/home\/the-court\/about-the-court\/\" rel=\"nofollow noopener\" target=\"_blank\">Federal Circuit<\/a>, the same court that decided to strike down the Washington, D.C., drug-pricing law in <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-federal-circuit\/1396804.html\" rel=\"nofollow noopener\" target=\"_blank\">2007<\/a>.<\/p>\n<p>If the Federal Circuit does not overrule its 2007 decision or find it inapplicable to Colorado\u2019s law, the Colorado upper price limit may survive only if the Supreme Court steps in. <\/p>\n<p>The stakes extend well beyond Colorado. <\/p>\n<p>Although 4 in 10 American adults report being <a href=\"https:\/\/www.kff.org\/health-costs\/public-opinion-on-prescription-drugs-and-their-prices\/\" rel=\"nofollow noopener\" target=\"_blank\">unable to afford taking their medication<\/a> as prescribed, federal action hasn\u2019t filled this gap. The White House touts its \u201c<a href=\"https:\/\/www.whitehouse.gov\/fact-sheets\/2026\/02\/fact-sheet-president-donald-j-trump-launches-trumprx-gov-to-bring-lower-drug-prices-to-american-patients\/\" rel=\"nofollow noopener\" target=\"_blank\">most-favored-nation\u201d drug deals<\/a> and TrumpRx.gov, but the voluntary deals mainly benefit <a href=\"https:\/\/www.factcheck.org\/2026\/02\/trump-misleads-on-drug-pricing-deals\/\" rel=\"nofollow noopener\" target=\"_blank\">Medicaid and cash-paying patients<\/a>, leaving most insured Americans\u2019 prices, including for drugs such as Enbrel, untouched. <\/p>\n<p>            <img decoding=\"async\" alt=\"A man with a purple tie speaks behind the podium with the word TrumpRx.gov behind him in gold lettering and an American flag to his right.\" src=\"https:\/\/www.newsbeep.com\/il\/wp-content\/uploads\/2026\/07\/file-20260716-57-41dokc.jpg\" class=\"native-lazy\" loading=\"lazy\"  \/><\/p>\n<p>              President Donald Trump announced the launch of TrumpRx, a website intended to sell prescription drugs at a discounted price, on Feb. 5, 2026.<br \/>\n              <a class=\"source\" href=\"https:\/\/www.gettyimages.com\/detail\/news-photo\/president-donald-trump-speaks-during-an-event-on-drug-news-photo\/2260135243?adppopup=true\" rel=\"nofollow noopener\" target=\"_blank\">Nathan Howard\/Stringer via Getty Images<\/a><\/p>\n<p>Medicare\u2019s <a href=\"https:\/\/www.cms.gov\/newsroom\/fact-sheets\/medicare-drug-price-negotiation-program-negotiated-prices-initial-price-applicability-year-2026\" rel=\"nofollow noopener\" target=\"_blank\">negotiation program<\/a>, though <a href=\"https:\/\/www.kff.org\/medicare\/key-facts-about-medicare-drug-price-negotiation\/\" rel=\"nofollow noopener\" target=\"_blank\">popular with voters across party lines<\/a>, covers only <a href=\"https:\/\/www.kff.org\/medicare\/key-facts-about-medicare-drug-price-negotiation\/\" rel=\"nofollow noopener\" target=\"_blank\">10-20 additional drugs a year<\/a> and does not affect the private insurance market, meaning only Medicare recipients see those lower prices.<\/p>\n<p>Other states, including Maryland, Washington and Minnesota, each of which has its <a href=\"https:\/\/familiesusa.org\/wp-content\/uploads\/2026\/04\/PDABs-1-Pager_2026-Update_Fact-Sheet-1.pdf\" rel=\"nofollow noopener\" target=\"_blank\">own affordability review board<\/a>, are developing their own payment limits and will be watching this case closely. Maryland has <a href=\"https:\/\/www.wypr.org\/wypr-news\/2026-05-19\/maryland-drug-affordability-board-puts-payment-limits-on-ozempic\" rel=\"nofollow noopener\" target=\"_blank\">already agreed to cap prices<\/a> for the diabetes drugs <a href=\"https:\/\/www.ozempic.com\" rel=\"nofollow noopener\" target=\"_blank\">Ozempic<\/a> and <a href=\"https:\/\/patient.boehringer-ingelheim.com\/us\/products\/jardiance\/\" rel=\"nofollow noopener\" target=\"_blank\">Jardiance<\/a>.
