warned the charity in April<\/a> over its then-CEO\u2019s continued employment despite his being disqualified due to having an individual voluntary arrangement (IVA), a legally binding agreement set up to manage a person\u2019s debt repayments.<\/p>\nAt the time, the commission told trustees that failing to comply with its regulatory advice and guidance \u2013 including advice about carrying out IVA checks \u2013 constituted misconduct and\/or mismanagement in the charity\u2019s administration.<\/p>\n
It instructed the charity to take independent legal advice in relation to the validity of the CEO\u2019s employment contract.<\/p>\n
A commission spokesperson said: \u201cWe have issued an official warning to Signposted Cymru, in relation to a failure to comply with the commission\u2019s regulatory advice and guidance.<\/p>\n
\u201cWe have an ongoing regulatory compliance case into the charity and continue to engage with the trustees to further resolve the issues brought to our attention.\u201d<\/p>\n
Charity\u2019s spending halted<\/p>\n
In a statement on Signposted Cymru\u2019s website, the trustees said they were undertaking a review of the charity\u2019s governance, operational and financial position \u201cfollowing a series of serious concerns identified internally\u201d.<\/p>\n
Due to the charity\u2019s financial position, they said the charity\u2019s spending had been halted and counselling provision \u201csignificantly reduced\u201d while trustees \u201cdetermine whether services can continue safely and sustainably\u201d.<\/p>\n
\u201cThis has been an incredibly difficult period for everyone connected to Signposted Cymru, particularly our beneficiaries, volunteers, staff and supporters,\u201d they said.<\/p>\n
\u201cThe trustees are continuing to work closely with relevant agencies and partners while assessing the future of the charity.\u201d<\/p>\n
Registered in January 2022, the charity reported an income of \u00a3173,000, mostly from restricted grants, and expenditure of \u00a3159,000 in the year to March 2025.<\/p>\n
