class=\"wp-block-paragraph\">The European Commission is facing fresh legal scrutiny after a group of leading scholars questioned its options paper on restricting imports from illegal Israeli settlements, before EU foreign ministers revisit the issue in September.<\/p>\n<p class=\"wp-block-paragraph\">In a <a href=\"https:\/\/thegoodlobby.eu\/wp-content\/uploads\/2026\/07\/Letter-on-EC-Options-Paper-Israeli-settlements.docx.pdf\" rel=\"nofollow noopener\" target=\"_blank\">letter<\/a> to the EU Commission president, Ursula von der Leyen, dated 31 July, the scholars argue that the options paper contains \u201cmanifestly incorrect and misleading claims\u201d that risk undermining the EU\u2019s obligations under international law.<\/p>\n<p class=\"wp-block-paragraph\">\u201cWe cannot avoid the impression that the analysis was shaped to justify inaction, rather than providing an objective assessment,\u201d said the signatories.<\/p>\n<p><a href=\"https:\/\/euobserver.com\/226724\/the-eu-can-ban-trade-with-illegal-israeli-settlements-heres-how\/\" rel=\"nofollow noopener\" target=\"_blank\"><img loading=\"lazy\" decoding=\"async\" width=\"600\" height=\"400\" src=\"https:\/\/www.newsbeep.com\/il\/wp-content\/uploads\/2026\/08\/14b429df-bc7c-4396-b24c-bdfffa17120d-7a70d898-b682-4e2f-8b78-7f267f696af3-efd3c150-ff8c-4656-bcb5-28.jpeg\" class=\"attachment-thumbnail size-thumbnail wp-post-image\" alt=\"\"  \/><\/a><\/p>\n<p class=\"wp-block-paragraph\">Legal scholars criticised the commission\u2019s assumption that the EU\u2019s existing differentiation regime between Israeli exports and settler goods \u201cis in line with the 2024 International Court of Justice (ICJ) Advisory Opinion\u201d as being \u201cfactually untenable.\u201d\u00a0<\/p>\n<p class=\"wp-block-paragraph\">The ICJ <a href=\"https:\/\/www.icj-cij.org\/node\/204160\" rel=\"nofollow noopener\" target=\"_blank\">found that all states are under the obligation<\/a> \u201cto take steps to prevent trade or investment relations that assist in the maintenance of the illegal situation created by Israel in the Occupied Palestinian Territory.\u201d\u00a0<\/p>\n<p class=\"wp-block-paragraph\">\u201cAllowing trade with settlements on most-favoured Nation terms cannot reasonably be characterised as taking steps to prevent such trade as required by the ICJ,\u201d the scholars said in the letter, mentioning particularly Israel\u2019s reimbursement scheme for settlement exports.<\/p>\n<p class=\"wp-block-paragraph\">The scholars also questioned the commission&#8217;s reasoning that a trade restriction would primarily pursue foreign policy objectives by seeking \u201cto promote a change of conduct of the Israeli government.\u201d\u00a0<\/p>\n<p class=\"wp-block-paragraph\">This \u201cmischaracterises\u201d the aim of the proposed measure, they said, arguing that trade restrictions seek \u201cto ensure \u2026 consistency of the EU&#8217;s own Common Commercial Policy with international law\u201d and to prevent EU trade from contributing to the economic viability of illegal settlements.\u00a0<\/p>\n<p><a href=\"https:\/\/euobserver.com\/226735\/a-ban-on-israeli-settlement-products-here-are-the-options-the-eu-is-considering\/\" rel=\"nofollow noopener\" target=\"_blank\"><img loading=\"lazy\" decoding=\"async\" width=\"600\" height=\"399\" src=\"https:\/\/www.newsbeep.com\/il\/wp-content\/uploads\/2026\/07\/5f1d30f4115fda5d7826f1a5a6bb3186-600x399.jpg\" class=\"attachment-thumbnail size-thumbnail wp-post-image\" alt=\"\"  \/><\/a><\/p>\n<p class=\"wp-block-paragraph\">Consequently, they argue that Article 207 of the EU treaty provides the appropriate legal basis for the move, which would open the door for a potential agreement that does not require EU27 unanimity, which has proven impossible to achieve in the past.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">\u201cThis is not a sanction against Israel because it applies exclusively to trade with settlers in the occupied territories,\u201d Ignacio Garc\u00eda Bercero, former director of the commission trade department until 2024 and current researcher at the think\u2013tank\u00a0<a href=\"https:\/\/www.bruegel.org\/\" rel=\"nofollow noopener\" target=\"_blank\">Bruegel<\/a>, told EUobserver earlier this month.<\/p>\n<p>EU&#8217;s credibility at stake<\/p>\n<p class=\"wp-block-paragraph\">The legal experts also said the commission&#8217;s argument that the \u201ccomparatively small volume of trade\u201d demonstrates that a settlement trade ban would be primarily political rather than economic is \u201cself-contradictory.\u201d\u00a0<\/p>\n","protected":false},"excerpt":{"rendered":"The
