\"TechA tech company says that Dua Lipa does not have the right to sue them for using her image on their TV box. They stated that she does not have any trademark rights over her likeness. (Instagram) Months ago, reports revealed that Dua Lipa is suing a tech giant for using her images on their TV boxes. However, according to recent reports, the company has said that the singer cannot sue them over the alleged issue. They have also requested that the lawsuit be dismissed.<\/p>\n

Tech giant files appeal to dismiss Dua Lipa\u2019s USD 15 million lawsuit<\/p>\n

Billboard revealed that the tech giant filed an appeal in court on September 10 to request that the judge overseeing the case dismiss it directly. According to the outlet, the company is stating that Lipa cannot sue them for her photograph being used. As per the outlet, their legal team shared, \u201cDefendants respectfully request that the court dismiss the complaint in its entirety,\u201d further adding, \u201cAn interface depicting a music-video channel among several unrelated content icons conveys nothing suggesting the plaintiff endorses the televisions. The images merely depict the televisions\u2019 on-screen interface, illustrating the applications and \u2026 an example of content available on the TV.\u201dAccording to the company\u2019s lawyers, Lipa has no trademark rights to her likeness, which is why she cannot rightfully sue them for her images being used on the TV boxes. They further stated that her face alone is not on the box and appears alongside a lot of other logos. According to their statement, they are also placing the blame on the content provider they used, which assured them that the content could be used without any issues with copyright and trademark infringement.The statement further added, \u201cThe image was used only after receiving explicit assurance from the content partner that permission had been secured, including for the retail boxes. Given this assurance, we deny any allegations of intentional misuse.\u201dThey concluded, \u201cThe complaint\u2019s right of publicity causes of action fail to state a claim because \u2026 English law must apply, and England does not recognize a right of publicity.\u201d<\/p>\n

Dua Lipa\u2019s lawyers respond to the filing and the tech giant\u2019s lawyers’ statements<\/p>\n

The singer\u2019s lawyers also issued their own statement into the matter, adding, \u201cSamsung<\/a>\u2019s response has been dismissive and callous, and the infringing products remain on the market to this day.” Samsung\u2019s infringing conduct\u2014using Ms. Lipa\u2019s assets for zero consideration\u2014makes a mockery of her hard work.\u201d\u201cMs. Lipa\u2019s face was prominently used for a mass marketing campaign for a consumer product without her knowledge, without consideration, and as to which she had no say, control, or input whatsoever,\u201d the lawyers previously said in the lawsuit. \u201cMs. Lipa did not allow and would not have allowed this use,” they further shared.<\/p>\n
