The <a href=\"https:\/\/www.medicarerights.org\/medicare-watch\/2023\/08\/31\/cms-announces-first-10-drugs-subject-to-price-negotiation\" rel=\"nofollow noopener\" target=\"_blank\">first set of negotiated drug prices will go into effect in 2026<\/a> and <a href=\"https:\/\/www.cms.gov\/files\/document\/infographic-negotiated-prices-maximum-fair-prices.pdf\" rel=\"nofollow noopener\" target=\"_blank\">are estimated to save $1.5 billion<\/a> in annual out-of-pocket costs for Medicare beneficiaries while saving the Medicare program $6 billion per year. The negotiated prices are a <a href=\"https:\/\/www.aarp.org\/medicare\/first-medicare-negotiated-drug-prices-debut\/\" rel=\"nofollow noopener\" target=\"_blank\">minimum of 38% off the 2023 list price<\/a>.<\/p>\n<p>Ten Important and Costly Drugs<\/p>\n<p>Drugs selected for negotiation must be brand-name drugs that don\u2019t have competition and must be among those that drive the most Medicare spending. These are the ten drugs for 2026:<\/p>\n<p>Eliquis<\/p>\n<p>Jardiance<\/p>\n<p>Xarelto<\/p>\n<p>Januvia<\/p>\n<p>Farxiga<\/p>\n<p>Entresto<\/p>\n<p>Enbrel<\/p>\n<p>Imbruvica<\/p>\n<p>Stelara<\/p>\n<p>NovoLog<\/p>\n<p>These medications treat serious chronic illnesses like cancer, diabetes, blood clots, heart failure, autoimmune conditions, and chronic kidney disease. In 2022, <a href=\"https:\/\/aspe.hhs.gov\/sites\/default\/files\/documents\/4bf549a55308c3aadc74b34abcb7a1d1\/ira-drug-negotiation-report.pdf\" rel=\"nofollow noopener\" target=\"_blank\">Part D spent around $46.4 billion on just these drugs<\/a>, 19% of all Part D spending, and beneficiaries paid $3.4 billion out of pocket for them. Evaluating based on total spending allows for the inclusion of medications that are extremely expensive on a per-patient basis as well as those that are very widely prescribed to beneficiaries.\u00a0<\/p>\n<p>The Negotiation Timeline<\/p>\n<p>All eligible Medicare beneficiaries will have access to these prices and new drugs will be added to the negotiated list each year. The next set of negotiated prices, for 15 additional drugs including <a href=\"https:\/\/www.medicarerights.org\/medicare-watch\/2025\/01\/23\/second-set-of-part-d-drugs-for-medicare-negotiation-includes-blockbuster-diabetes-and-weight-loss-drugs\" rel=\"nofollow noopener\" target=\"_blank\">blockbuster diabetes drugs like Ozempic<\/a>,\u00a0 will go into effect in 2027.<\/p>\n<p>2023\u2014CMS announced <a href=\"https:\/\/www.medicarerights.org\/medicare-watch\/2023\/08\/31\/cms-announces-first-10-drugs-subject-to-price-negotiation\" rel=\"nofollow noopener\" target=\"_blank\">the first 10 Part D drugs to be negotiated<\/a>.<\/p>\n<p>2024\u2014CMS published <a href=\"https:\/\/www.medicarerights.org\/medicare-watch\/2024\/08\/15\/biden-harris-administration-announces-billions-in-savings-from-drug-price-negotiations\" rel=\"nofollow noopener\" target=\"_blank\">the negotiated prices<\/a>.<\/p>\n<p>2025\u2014Medicare <a href=\"https:\/\/www.medicarerights.org\/medicare-watch\/2025\/01\/23\/second-set-of-part-d-drugs-for-medicare-negotiation-includes-blockbuster-diabetes-and-weight-loss-drugs\" rel=\"nofollow noopener\" target=\"_blank\">negotiating prices for 15 more Part D drugs<\/a>.<\/p>\n<p>2026\u2014Negotiated prices for the first 10 Part D drugs will take effect. This is the first year people with Medicare will see the direct impacts of negotiation. CMS will select another 15 drugs\u2014under Part D or Part B\u2014for negotiation.<\/p>\n<p>2027\u2014Negotiated prices for the 15 Part D drugs selected in 2025 will kick in. CMS will announce 20 more Part B or Part D drugs for negotiation.<\/p>\n<p>In subsequent years, CMS will continue negotiating prices for additional drugs, which will take effect two years later.\u00a0 Each round is cumulative, continuing to add to the total number of drugs with negotiated prices.<\/p>\n<p>Reconciliation Bill Restricts Negotiation Program\u2019s Potential<\/p>\n<p>Unfortunately, the 2025 budget reconciliation bill\u2014HR 1\u2014reduced the efficacy of the IRA\u2019s negotiation program by <a href=\"https:\/\/www.kff.org\/medicare\/people-with-medicare-will-face-higher-costs-for-some-orphan-drugs-due-to-changes-in-the-new-tax-and-budget-law\/\" rel=\"nofollow noopener\" target=\"_blank\">further limiting what drugs can be negotiated<\/a>. KFF estimates that this change will increase Medicare spending by at least $5 billion. As always, increases in Medicare spending mean increases in out-of-pocket costs for beneficiaries.<\/p>\n<p>Build on the Inflation Reduction Act<\/p>\n<p>At Medicare Rights, we condemn efforts to pull back on the IRA\u2019s negotiation framework. We believe more drugs should be subject to negotiation, not fewer.
