Foodstuffs begin appeal to overturn Commerce Commission’s merger ruling

Foodstuffs North Island and Foodstuffs South Island, whose brands include Pak’nSave, are appealing a decision by the Commerce Commission to stop the co-operative groups from merging.

Foodstuffs’ two major co-operative groups today told a court that their proposed merger should be cleared on grounds it is not likely to substantially lessen competition in any grocery market.

The pair have begun their appeal of a Commerce Commission decision in October 2024 that ruled against their proposed tie-up.

The appeal, before Justice Andru Isac with Dr Lilla Csorgo, is slated to continue this week before the High Court in Wellington.

Foodstuffs North Island (FSNI) and Foodstuffs South Island (FSSI) – collectively the appellants – sought for the court to grant clearance for the merger on three main grounds.
