Jefferson’s vision of individual liberty shows New Zealand’s constitutional gap – David Harvey

Jefferson’s sentence is not merely a historical artefact. It is a revolutionary act of prioritising the individual – a declaration that the human person stands before the state, above the state, and beyond the reach of any majority that would diminish him. It is the clearest, most potent expression of the individualist ideal ever written in English.

New Zealand has never written such a sentence. It has been invited to, repeatedly. It has declined, repeatedly. And that refusal is not benign. It signals a constitutional culture that has quietly hollowed out the individual and replaced him with a managed, supervised, state‑dependent citizenry.

Jefferson’s claim has five features, each of which New Zealand’s political architecture resists:

Declaratory truth – rights are announced, not granted.Universality – they belong to all people, not to groups or partners.Natural rights – they precede the state and limit it.Individualism – the person, not the collective, is the unit of politics.Foundational status – they sit above ordinary lawmaking.

These features are not decorative. They are armour. Remove them, and the individual stands unprotected before the state. New Zealand has removed every one.

New Zealand’s unwritten constitution, scattered across statutes and conventions, rests on a single organising principle: Parliament is sovereign. It may make or unmake any law. No court may strike legislation down. No right is entrenched. No liberty is beyond revision.

From a Jeffersonian perspective, this is not a quirk – it is a constitutional inversion. Where Jefferson places the individual above the legislature, New Zealand places the legislature above the individual. Rights become permissions. Liberties become licences. And a people whose freedoms exist at the pleasure of Parliament will, inevitably, come to think of Parliament as the source of those freedoms.

That is the seedbed of dependency. New Zealand has been cultivating it for nearly a century.

The Treaty of Waitangi is foundational in New Zealand’s constitutional life, but it is not a declaration of natural rights. It is a compact between two parties, concerned with sovereignty, property, and citizenship. It is bicultural, relational and particular – the opposite of Jefferson’s universalism.

Its vocabulary reinforces a national habit of seeing the person as a member of a group, a partner in a relationship, a participant in a negotiated settlement. Jefferson’s citizen is sovereign over his own life. New Zealand’s citizen is a party to arrangements negotiated above him.

New Zealand’s Bill of Rights Act affirms the right to life and liberty. But these rights are statutory, not entrenched. They are framed as Parliament’s affirmations, not as truths that bind Parliament.

A right that can be revised by simple majority is not a right in Jefferson’s sense. It is a policy choice. And a citizen taught that rights are policy choices becomes a supplicant, not a sovereign individual.

It is in the third term – the pursuit of happiness – that New Zealand’s divergence becomes most dramatic. Jefferson’s phrase protects a private sphere in which individuals pursue their own flourishing. New Zealand has replaced this with a state‑managed ideal of wellbeing, embedded in the Public Finance (Wellbeing) Amendment Act 2020 and operationalised through the Treasury’s Living Standards Framework and He Ara Waiora.

This is not a philosophical footnote. It is a constitutional revolution. Happiness becomes something the state measures, manages and delivers. The citizen becomes a recipient of wellbeing rather than its author. And what the state undertakes to deliver, the citizen learns to expect.

The result is visible everywhere: a quiet, comfortable, unexamined dependence on the state – benign in intention, generous in administration, and corrosive in effect.

When New Zealand was offered a Jeffersonian sentence, it was rejected.

The most revealing episode came in 2024 with the Treaty Principles Bill, which attempted to articulate a simple, universalist principle: that all individuals are equal before the law. It was the closest New Zealand has come to a Jeffersonian declaration.

The response was overwhelming. Tens of thousands marched in protest. Parliament rejected the Bill 112-11. The political establishment united to oppose a sentence that, in any Jeffersonian polity, would be carved in stone.

The objection was not to equality itself. It was to the universalism that would flatten group‑based arrangements. New Zealand was offered a Jeffersonian sentence – and recoiled from it.

New Zealanders remain as capable and decent as any people on Earth. The deficiency is not in the people. It is in the political architecture and the habits it has bred.

New Zealand has rejected the form of Jefferson’s claim, and the form was the protection. Rights are revisable. Liberties are statutory. Happiness is bureaucratised. Identity is relational and group‑based. The individual is unfortified.

A citizenry taught that its rights are Parliament’s to adjust and its wellbeing is the Treasury’s to deliver will not develop the habits of self‑reliance, enterprise, and jealous liberty that Jefferson’s sentence assumes.

Jefferson’s claim asks a nation to declare that the individual comes first – before the state, before the collective, before every settlement and every Budget. New Zealand has repeatedly declined to make that declaration.

The comforts of the alternative are real. But they are purchased at the cost of the first principle of free government: that the person, not the polity, is the bearer of unalienable rights and the author of his own happiness.
