A Sunshine Coast chiropractor has been stripped of his registration after a random audit by the industry watchdog found he was working without appropriate insurance.

Documents filed from the Queensland Civil and Administrative Tribunal show the Chiropractic Board of Australia brought disciplinary action against Mieczyslaw Patrick Rozanski after it was uncovered he did not have appropriate insurance to work as a chiropractor.

The court documents show Mr Rozanski was registered with the board until November of this year, however, an audit by the Australian health Practitioner Regulation Authority in 2021 found he did not have professional indemnity insurance.

“The matter was investigated. AHPRA took steps to confirm his insurance holdings by notifying a number of different insurance companies,” the QCAT documents stated.

“The investigation ultimately indicated that he did not hold PII with any insurance provider during what is called the lapse period and that he practised as a chiropractor during that period.”

According to the QCAT documents, Mr Rozanski claimed “financial hardship” was the reason he was not insured.

“He also provided AHPRA with a certificate of currency with Aon Risk Management Services (‘Aon’) dated 23 August 2021 which was valid until 23 October 2022, and its policy included retroactive cover,” the documents stated.

QCAT member Julie Dick stated Mr Rozanski had been found by the tribunal to have committed three counts of professional misconduct and one of unprofessional misconduct.

“The conduct is serious. Responsible tribunals have generally found that the conduct of practitioners who have failed to hold insurance and then make false declarations is characterised as professional misconduct,” Ms Dick stated in the documents.

Ms Dick said Mr Rozanksi had shown “limited remorse”.

His registration was ultimately cancelled and he is banned from applying for it to be reinstated for six months.
