The Below Deck bosun was granted conditional bail by Burwood Local Court on January 15 and scheduled to appear in court yesterday. He had earlier pleaded not guilty.
The Sydney Morning Herald reported that prosecutors asked the judge to convict the Irishman in absentia.

Judge Janine Lacy convicted Gallagher on all three charges and issued a warrant for his arrest.
New South Wales Police have issued the warrant, asking anyone with information on Gallagher’s whereabouts not to approach him and to inform authorities.
Australian media reported that the reality TV star’s alleged victim, his then-partner and Below Deck Mediterranean castmate Gael Cameron, was in court yesterday ready to give evidence.
Gallagher and Cameron share a young son.
The latest season of Below Deck Mediterranean, filmed before the incident took place, is currently airing in New Zealand and features Gallagher balancing his role as bosun aboard a superyacht with family commitments involving Cameron and their infant son.
Following news of the Boxing Day incident, it has also been revealed that Gallagher is also subject to a bench warrant issued in Ireland.
This separate warrant relates to an alleged assault of an unknown man in Dungloe in August 2022, two years before Gallagher found fame as a cast member on the Bravo franchise.
