and of how difficult it can be to do new things even when you&#8217;re in power.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">With judge Lord Sandison now considering his ruling, what have we learned from this case and the collapse of the deposit return scheme?<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">Let&#8217;s deal with the specific claims made by Biffa in the first instance, before looking for wider lessons.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">The company&#8217;s \u00a351.4m lawsuit hinges on a letter from then-minister Lorna Slater in May 2022, voicing &#8220;unwavering&#8221; commitment to a deposit return scheme going live the following August.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">The plans aimed to boost recycling by charging consumers an extra 20p for a single-use bottle or can, which would be repaid when it was returned.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">Biffa was in talks to be the main logistics provider, and insists the letter from Slater was &#8220;foundational&#8221; in the decision to sign a contract and invest tens of millions of pounds.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">Crucially, the company notes there was no mention in this letter of any risks to the plans &#8211; introduced post-Brexit to maintain free trade across the UK &#8211; meant Westminster would need to approve any plans creating different rules for businesses north and south of the border.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">Ultimately they only allowed a more limited version of the scheme, capping deposits and excluding glass, leading Scottish ministers to <a target=\"_self\" href=\"https:\/\/www.bbc.co.uk\/news\/uk-scotland-65731807\" class=\"sc-f9178328-0 iCaRzc\" rel=\"nofollow noopener\">accuse Scottish Secretary Alister Jack of &#8220;sabotage&#8221;<\/a>.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">Officials had been aware of the issue since late 2021, and it had been clear since March 2022 that they would need to make a fresh application to the UK government for an exemption.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">Biffa says it was &#8220;disingenuous in the extreme&#8221; not to mention that in the letter &#8211; and was backed by Lord Jack, who said it was &#8220;utterly irresponsible&#8221; to encourage investment without mentioning the &#8220;huge level of risk&#8221;.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">Slater said the letter was not a project update which would detail such risks, but was simply designed to reassure the firm that the government remained committed to the future of the scheme, having <a target=\"_self\" href=\"https:\/\/www.bbc.co.uk\/news\/uk-scotland-scotland-politics-59659953\" class=\"sc-f9178328-0 iCaRzc\" rel=\"nofollow noopener\">recently delayed the &#8220;go live&#8221; date by a year<\/a>.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">The government maintains Biffa was not offered any special assurances, and in any case was well aware of the risks &#8211; to the extent it took out a \u00a320m insurance policy against delays.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/nz\/wp-content\/uploads\/2025\/10\/1761830662_895_grey-placeholder.png\" class=\"sc-5340b511-0 gUePlo hide-when-no-script\" aria-label=\"image unavailable\"\/><img decoding=\"async\"   src=\"https:\/\/www.newsbeep.com\/nz\/wp-content\/uploads\/2025\/11\/78f1c320-b659-11f0-aa13-0b0479f6f42a.jpg.webp.webp\" loading=\"lazy\" alt=\"PA Media Alister Jack - a man with greying fair hair, wearing a dark suit with a blue shirt and patterned tie - pictured shortly after getting out of a car in London\" class=\"sc-5340b511-0 hLdNfA\"\/>PA Media<\/p>\n<p>Alister Jack was sharply critical of the Scottish government in his evidence to the court<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">Lord Sandison is pondering whether that letter was a negligent misrepresentation of the true situation and whether Scottish ministers had a duty to warn Biffa of potential risks.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">He is expected to make a ruling in the new year but in the meantime there are broader lessons we can learn too.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">Having come under the microscope in this case, the failure of the deposit return scheme is in many ways a case study in why it&#8217;s hard to do new things.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">Lorna Slater told the court there were &#8220;many existential threats&#8221; to the plans.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">The whole of the UK was moving in the direction of having deposit return systems but Scotland was set to go first &#8211; and thus was breaking new ground while puzzling out the practicalities.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">Drinks producers would need to agree standard approaches to labelling and barcodes, and retailers would need to be knitted into a vast network of return points with connecting IT infrastructure.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">An arm&#8217;s length body called Circularity Scotland was set up to administer the scheme. CEO David Harris told the court that parliament had essentially set a date at which the system would come into force, but countless questions were not addressed by the legislation.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">How would new stock be phased in on the day the scheme went into force?<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">Would firms need to put different barcodes on stock heading to Scotland and England?<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">What about online sales? Would a supermarket delivering single-use containers to a customer have to come back to collect them?<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">There were governmental issues too around VAT &#8211; would a 20p deposit actually become 24p?<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">And then there was the threat of legal challenge hanging over matters. and says it lost millions<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">This underlines the problem the government had with its relationship with business.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">John Swinney nodded to a broader issue when he explicitly sought to reset that relationship on becoming first minister, drafting in <a target=\"_self\" href=\"https:\/\/www.bbc.co.uk\/news\/uk-scotland-64785574\" class=\"sc-f9178328-0 iCaRzc\" rel=\"nofollow noopener\">deposit return critic Kate Forbes<\/a> as his deputy to smooth things over.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">The partnership between Circularity Scotland and the government was frequently challenging, with Mr Harris saying he felt like a &#8220;middle-man&#8221; constantly under pressure from ministers and companies.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">Worse, he told the court it was &#8220;alarming&#8221; that he hadn&#8217;t been told about internal market issues sooner &#8211; he only found out about them via a media inquiry in 2023 &#8211; and said &#8220;I feel the material facts were kept from us&#8221;.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">Asked by Biffa&#8217;s lawyer whether he felt &#8220;betrayed&#8221;, he ultimately agreed.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">The court also heard claims the government had &#8220;deliberately concealed&#8221; its concerns about the future of the scheme from the very companies investing in it.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">A working group had been set up for partners involved in the new system, with a publicly-available register of potential risks to the plans.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">Emails from spring 2022 saw one company boss asking whether a range of issues including internal market rules should be added to the shared risk register.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">But civil servants discussed not doing this, because they had separately been threatened with legal action by a member of the Scottish Grocers&#8217; Federation, which was part of the group.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">Biffa&#8217;s lawyer said issues were being &#8220;kept secret&#8221; in an effort to &#8220;run down the clock&#8221; are commonplace in countries like Denmark which operate deposit return schemes<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">Relations were even worse when it came to the UK government.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">Scottish ministers <a target=\"_self\" href=\"https:\/\/www.bbc.co.uk\/news\/uk-scotland-scotland-politics-54439757\" class=\"sc-f9178328-0 iCaRzc\" rel=\"nofollow noopener\">hated the Internal Market Act from day one<\/a>, considering it to drive a coach and horses through the heart of devolution.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">Slater told the court there was no reason for the UK government to block a scheme that would soon be replicated nationwide &#8211; and that Lord Jack had &#8220;single-handedly undermined&#8221; the plans &#8220;to give the SNP a black eye&#8221;.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">The Scottish secretary had certainly been taking a muscular approach to Holyrood around that time, having made unprecedented use of his powers to <a target=\"_self\" href=\"https:\/\/www.bbc.co.uk\/news\/uk-politics-64288757\" class=\"sc-f9178328-0 iCaRzc\" rel=\"nofollow noopener\">block a controversial gender reform bill<\/a>.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">He insisted that there was nothing political about his decisions around the deposit return scheme, telling the court he was looking out for businesses, consumers and the economy.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">But he didn&#8217;t hesitate to stick the boot in, describing the Scottish government approach as &#8220;incompetent&#8221;, &#8220;farcical&#8221; and a &#8220;comedy of errors&#8221;.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">Both he and Slater have left government, and relations between London and Edinburgh were meant to improve when Labour took office.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">But a review of the Internal Market Act has tweaked rather than scrapped its most controversial clauses, and with Labour and the SNP about to go head to head in a Holyrood election the rhetoric remains every bit as combative as it was in the Jack era.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">Lord Sandison is deciding whether damages of \u00a351.4m will have to be paid out to Biffa.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">That is a lot of money, even against the context of the Scottish government&#8217;s annual budget being in excess of \u00a360bn.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">But the bigger issue for the Scottish government may be a reputational one.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">Their record in big litigation in recent years has not been great, and Biffa&#8217;s submissions paint them as being incompetent, negligent, naive and secretive.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">Because of what it says about their decisions, ministers really won&#8217;t want this case to go against them.<\/p>\n","protected":false},"excerpt":{"rendered":"Phil SimScotland political correspondent Getty Images It could have been a dry legal debate about drinks container recycling,&hellip;\n","protected":false},"author":2,"featured_media":120166,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[22],"tags":[273,111,139,69,147],"class_list":{"0":"post-120165","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-environment","8":"tag-environment","9":"tag-new-zealand","10":"tag-newzealand","11":"tag-nz","12":"tag-science"},"_links":{"self":[{"href":"https:\/\/www.newsbeep.com\/nz\/wp-json\/wp\/v2\/posts\/120165","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.newsbeep.com\/nz\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.newsbeep.com\/nz\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/nz\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/nz\/wp-json\/wp\/v2\/comments?post=120165"}],"version-history":[{"count":0,"href":"https:\/\/www.newsbeep.com\/nz\/wp-json\/wp\/v2\/posts\/120165\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/nz\/wp-json\/wp\/v2\/media\/120166"}],"wp:attachment":[{"href":"https:\/\/www.newsbeep.com\/nz\/wp-json\/wp\/v2\/media?parent=120165"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.newsbeep.com\/nz\/wp-json\/wp\/v2\/categories?post=120165"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.newsbeep.com\/nz\/wp-json\/wp\/v2\/tags?post=120165"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
