{"id":127373,"date":"2025-11-10T05:25:07","date_gmt":"2025-11-10T05:25:07","guid":{"rendered":"https:\/\/www.newsbeep.com\/nz\/127373\/"},"modified":"2025-11-10T05:25:07","modified_gmt":"2025-11-10T05:25:07","slug":"criminal-proceeds-recovery-thai-meth-importer-piyaporn-paetmuangjan-agrees-to-forfeit-20000-seized-by-police-in-2007","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/nz\/127373\/","title":{"rendered":"Criminal proceeds recovery: Thai meth importer Piyaporn Paetmuangjan agrees to forfeit $20,000 seized by police in 2007"},"content":{"rendered":"<p class=\"UYVxLGUpqoLIsFLR\" style=\"display:none\">Now entering her  50s and living in her home country, <a href=\"https:\/\/www.nzherald.co.nz\/topic\/thailand\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.nzherald.co.nz\/topic\/thailand\/\">Thailand<\/a>, Paetmuangjan has signed an affidavit saying she wants \u201cnothing to do\u201d with assets she acquired through importing methamphetamine into New Zealand.<\/p>\n<p class=\"UYVxLGUpqoLIsFLR\" style=\"display:none\">To obtain the affidavit, police had to serve court papers on her &#8211; by email, and then in person in Thailand. <\/p>\n<p class=\"UYVxLGUpqoLIsFLR\" style=\"display:none\">This has helped clear the way for a <a href=\"https:\/\/www.nzherald.co.nz\/topic\/high-court\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.nzherald.co.nz\/topic\/high-court\/\">High Court<\/a> judge to order the money forfeited to the Crown.<\/p>\n<p class=\"UYVxLGUpqoLIsFLR\" style=\"display:none\">The money was seized  during Operation Earle, an investigation into the importation of meth from Thailand.<\/p>\n<p class=\"UYVxLGUpqoLIsFLR\" style=\"display:none\">On June 5, 2007, police searched Paetmuangjan\u2019s Wellington home and found $20,000 cash, cell phones, Sim cards and documentation related to Western Union money transfers.<\/p>\n<p class=\"UYVxLGUpqoLIsFLR\" style=\"display:none\">They did not find any drugs, but the <a href=\"https:\/\/www.nzherald.co.nz\/topic\/wellington\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.nzherald.co.nz\/topic\/wellington\/\">Wellington <\/a><a href=\"https:\/\/www.nzherald.co.nz\/topic\/district-court\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.nzherald.co.nz\/topic\/district-court\/\">District Court<\/a> was told later that Paetmuangjan was co-ordinating deliveries and payments for a meth ring  run from prison by her then partner. <\/p>\n<p class=\"UYVxLGUpqoLIsFLR\" style=\"display:none\">The methamphetamine was smuggled into the country inside clothing packages and distributed to syndicates based in <a href=\"https:\/\/www.nzherald.co.nz\/topic\/auckland\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.nzherald.co.nz\/topic\/auckland\/\">Auckland<\/a>, Wellington, the Hutt Valley and <a href=\"https:\/\/www.nzherald.co.nz\/topic\/whanganui\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.nzherald.co.nz\/topic\/whanganui\/\">Whanganui<\/a>.<\/p>\n<p class=\"UYVxLGUpqoLIsFLR\" style=\"display:none\">An order forfeiting the $20,000 to the Crown should have been made when the criminal case against Paetmuangjan concluded 18 years ago.<\/p>\n<p class=\"UYVxLGUpqoLIsFLR\" style=\"display:none\">It was not, due to an \u201coversight\u201d, according to a police application for a forfeiture order that was made to the High Court last month. <\/p>\n<p class=\"UYVxLGUpqoLIsFLR\" style=\"display:none\">\u201cThe funds have inadvertently been sitting in the NZ Police trust account ever since,\u201d said High Court Justice Helen Cull. <\/p>\n<p class=\"UYVxLGUpqoLIsFLR\" style=\"display:none\">The police applied for the money to be forfeited under the <a href=\"https:\/\/www.nzherald.co.nz\/nz\/police-seize-more-than-1000-properties-under-criminal-proceeds-recovery-act-law\/KPOWXFU74ZCJRMXKULEQFHAWTI\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.nzherald.co.nz\/nz\/police-seize-more-than-1000-properties-under-criminal-proceeds-recovery-act-law\/KPOWXFU74ZCJRMXKULEQFHAWTI\/\">Criminal Proceeds (Recovery) Act 2009<\/a>, through which criminals\u2019 assets acquired through their illegal activity can be confiscated.<\/p>\n<p class=\"UYVxLGUpqoLIsFLR\" style=\"display:none\">Justice Cull said she was satisfied the cash was \u201ctainted property\u201d under that law, and should be forfeited.<\/p>\n<p class=\"UYVxLGUpqoLIsFLR\" style=\"display:none\">Court documents show Paetmuangjan was a \u201cvital participant\u201d in the drugs ring  operated from Rimutaka Prison by another Thai national, Aritut Sungsuwan, using contraband cellphones.<\/p>\n<p class=\"UYVxLGUpqoLIsFLR\" style=\"display:none\">Sungsuwan had drug contacts in Thailand and was involved with other serving prisoners in importing on demand large quantities of methamphetamine from Thailand. <\/p>\n<p class=\"UYVxLGUpqoLIsFLR\" style=\"display:none\">The other prisoners arranged with their friends outside the wire to deliver money to Paetmuangjan, who sent it on to Thailand. <\/p>\n<p class=\"UYVxLGUpqoLIsFLR\" style=\"display:none\">At the time she was caught, Paetmuangjan had been in NZ illegally since 2003. She  had no legitimate job and received no other monetary benefits which would explain the $20,000 in her house. <\/p>\n<p class=\"UYVxLGUpqoLIsFLR\" style=\"display:none\">Sungsuwan was deported to Thailand at the end of his sentence. <\/p>\n<p class=\"UYVxLGUpqoLIsFLR\" style=\"display:none\">Ric Stevens spent many years working for the former NZ Press Association news agency, including as a political reporter at Parliament, before holding senior positions at various daily newspapers.
