in NSW with its proposals to change the way developers compensate for damage to the environment, scientists and legal experts have warned.<\/p>\n<p class=\"dcr-130mj7b\">As the Coalition <a href=\"https:\/\/www.theguardian.com\/australia-news\/2025\/nov\/13\/48-hours-that-killed-liberal-party-net-zero-promise\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">tears itself apart again over climate<\/a>, Labor\u2019s plan to overhaul biodiversity offsets \u2013 and <a href=\"https:\/\/www.theguardian.com\/australia-news\/2025\/nov\/08\/labor-environment-laws-australia-biodiversity-crisis-five-reasons-concerned\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">nature laws more broadly<\/a> \u2013 has coasted under the radar with comparatively little scrutiny.<\/p>\n<p class=\"dcr-130mj7b\"><a href=\"https:\/\/www.theguardian.com\/email-newsletters?CMP=copyembed&amp;CMP=emailbutton\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">Sign up: AU Breaking News email<\/a><\/p>\n<p class=\"dcr-130mj7b\">The plan includes a proposal to establish a \u201crestoration contributions\u201d fund that developers could pay into rather than doing their own work to find a suitable project to compensate for harm their projects cause.<\/p>\n<p class=\"dcr-130mj7b\">The legislation before parliament would also overturn a ban on offsets forming part of the federal nature market under a <a href=\"https:\/\/www.theguardian.com\/environment\/2023\/dec\/05\/labor-and-greens-strike-deal-to-establish-nature-repair-market\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">deal reached with the Greens<\/a> two years ago.<\/p>\n<p class=\"dcr-130mj7b\">But Rachel Walmsley, deputy director of policy and law reform at the Environmental Defenders Office, said the proposals would replicate a flawed system at the national level despite \u201cso much evidence of the problems\u201d in NSW and other jurisdictions.<\/p>\n<p class=\"dcr-130mj7b\">Environmental offsets allow developers to compensate for the damage they cause by restoring habitat for the same species or ecosystem elsewhere.<\/p>\n<p class=\"dcr-130mj7b\">It is a system of balance sheet calculations \u2013 literally \u2013 where harm to habitat is approved on a promise to even the ledger with actions that deliver an equal or greater benefit.<\/p>\n<p class=\"dcr-130mj7b\">Offsets are meant to be a last resort after all efforts to avoid or mitigate damage to nature have been attempted.<\/p>\n<p class=\"dcr-130mj7b\">But as the former competition watchdog chief Graeme Samuel found in his 2020 review of national environmental laws, they have become the default policy by which most developments with significant impacts on endangered species are approved.<\/p>\n<p class=\"dcr-130mj7b\">Problems with the system include offsets that are <a href=\"https:\/\/www.theguardian.com\/environment\/2021\/feb\/10\/its-an-ecological-wasteland-offsets-for-sydney-tollway-were-promised-but-never-delivered\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">never delivered or are insufficient<\/a>, offsets on land that <a href=\"https:\/\/www.theguardian.com\/environment\/2021\/aug\/02\/environment-officials-questioned-use-of-heritage-listed-land-as-offset-for-western-sydney-airport\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">already had environmental protections<\/a> and restoration activities (meaning there is little to no extra benefit derived from the offset), and integrity and conflict of interest concerns that have largely escaped the watch of corporate regulators.<\/p>\n<p class=\"dcr-130mj7b\">In NSW developers have the option of finding and securing an offset themselves or buying offsets on a market where \u201ccredits\u201d for specific ecosystems and species are attached to properties where the landholder is undertaking conservation work.<\/p>\n<p class=\"dcr-130mj7b\">Developers can also pay into a fund managed by the state\u2019s Biodiversity <a href=\"https:\/\/www.theguardian.com\/environment\/conservation\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\" rel=\"nofollow noopener\" target=\"_blank\">Conservation<\/a> Trust, which then inherits the task of finding offsets that meet the developer\u2019s obligations.<\/p>\n<p class=\"dcr-130mj7b\">In 2021, <a href=\"https:\/\/www.theguardian.com\/media\/2023\/may\/29\/the-investigation-that-blew-the-lid-off-sydneys-environmental-offsets\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">Guardian Australia exposed a litany of failures<\/a> in this NSW scheme, triggering several investigations.<\/p>\n<p class=\"dcr-130mj7b\">An <a href=\"https:\/\/www.theguardian.com\/environment\/2022\/aug\/30\/utterly-damning-review-finds-offsets-scheme-fails-to-protect-nsw-environment\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">auditor general report<\/a> found the government had no strategy for ensuring the offset market delivered the required environmental outcomes. The auditor and a separate parliamentary inquiry found the money developers were paying into the fund managed by the trust was outstripping the supply of available offsets or credits.<\/p>\n<p class=\"dcr-130mj7b\">In plain terms, development was occurring that harmed nature, money was accumulating in the fund because there were not enough offsets to compensate for that harm and species were being pushed closer to extinction.<\/p>\n<p class=\"dcr-130mj7b\">Subsequent reviews by the NSW Independent Pricing and Regulatory Tribunal have made similar findings and the NSW government has now <a href=\"https:\/\/www.theguardian.com\/australia-news\/2024\/nov\/22\/nsw-goverment-biodiversity-offset-scheme-minns-government\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">taken steps to limit<\/a> the circumstances in which developers can pay into the fund.<\/p>\n<p class=\"dcr-130mj7b\">Dr Megan Evans, an expert on offsetting at the University of NSW, warned the federal legislation in its current form would replicate the problems seen at state level.<\/p>\n<p class=\"dcr-130mj7b\">\u201cWe know from experience \u2026 that pay-and-go offset schemes do not work because impacts to threatened biodiversity continue to be approved and then the state is liable for spending the money to buy offsets which are then too scarce, nonexistent \u2013 because there\u2019s no habitat left \u2013 or expensive\u201d.<\/p>\n<p><a data-ignore=\"global-link-styling\" href=\"#EmailSignup-skip-link-19\" class=\"dcr-jzxpee\">skip past newsletter promotion<\/a><\/p>\n<p class=\"dcr-rsfwa\">Sign up to Breaking News Australia<\/p>\n<p class=\"dcr-1xjndtj\">Get the most important news as it breaks<\/p>\n<p>Privacy Notice: Newsletters may contain information about charities, online ads, and content funded by outside parties. Like-for-like rules require an environmental benefit to be delivered for the same species or ecosystem harmed by a development.<\/p>\n<p class=\"dcr-130mj7b\">Prof Brendan Wintle from the Biodiversity Council said last week the proposal was \u201cabsurd\u201d.<\/p>\n<p class=\"dcr-130mj7b\">\u201cYou\u2019re basically saying you can trade koalas with a land snail in Tasmania or a small plant in north Queensland,\u201d Wintle said.<\/p>\n<p class=\"dcr-130mj7b\">Another element of the legislation would create a \u201ctop-up\u201d provision to draw on taxpayer funds where contributions from developers fall short.
