(ABC News: Berge Breiland)<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The proposal seeks to add a dedicated complaints framework to the Online Safety Act, granting the eSafety Commissioner powers to demand deepfake removals and issue immediate fines.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Under the changes, individuals who share a non-consensual deepfake could be fined $165,000 up-front, while companies that fail to comply with a removal notice could pay as much as $825,000.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">As well as the initial fine, individuals caught sharing non-consensual deepfakes could also be hit with a second fine for ignoring removal notices.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Additionally, proposed changes to the Privacy Act would allow Australians to bring civil lawsuits and sue perpetrators directly for financial compensation.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Under Senator Pocock&#8217;s proposal, the victim would not have to prove they had suffered financially in order to bring a case, in recognition of the emotional harm caused by deepfakes.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;As humans \u2014 our likeness, our face, our voice, our mannerisms \u2014 that&#8217;s a big part of who we are,&#8221; he said.<\/p>\n<p>&#8220;To me, this seems like a bit of a no-brainer. (ABC News: Abbey Haberecht)<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The bill also contained important limits, Senator Pocock said.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">It would carve out uses such as journalism, satire, and good faith uses by law enforcement, with similar exemptions and defences to defamation law, and an additional exemption for children.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The bill was also designed with the goal of sparing people who share non-consensual deepfakes without realising it, while still catching out those who do so knowingly or recklessly.<\/p>\n<p>&#8220;We are now living in a world where increasingly anyone can create a deepfake and use it however they want,&#8221;  Senator Pocock said.Loading&#8230;<\/p>\n<p class=\"paragraph_paragraph__iYReA\"><a class=\"Link_link__kR0xA Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.abc.net.au\/news\/2024-09-07\/david-pocock-creates-ai-deepfake-of-albanese\/104323688\" data-component=\"Link\" data-uri=\"coremedia:\/\/article\/104323688\" rel=\"nofollow noopener\" target=\"_blank\">Last year<\/a>, the crossbencher created AI-generated videos of Prime Minister Anthony Albanese and then-opposition leader Peter Dutton ahead of the election, to highlight how easily deepfakes could distort political debate.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">He said the changes proposed in his bill would also apply to political campaigns.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;We have to draw a line in the sand and say, this is not on \u2014 you cannot deepfake someone without their consent,&#8221; he said.\u00a0<\/p>\n<p>Crossbench moves on AI as government mulls response<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Senator Pocock&#8217;s bill is not the only effort from the crossbench to tackle AI harms, fuelled by a sense that the government has fallen behind.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">In July, independent MP Kate Chaney introduced a private members&#8217; bill to criminalise AI apps and tools that generate child sexual abuse material.<\/p>\n<p><a href=\"https:\/\/www.abc.net.au\/news\/2025-07-28\/kate-chaney-bill-aims-to-criminalise-ai-child-abuse-tools\/105571734\" data-component=\"FullBleedLink\" class=\"RelatedCard_link__rsgR9 FullBleedLink_root__lTw_U interactive_focusContext__yRhc_ interactive_defaults__AKxUU FullBleedLink_showVisited__g3Xvz\" rel=\"nofollow noopener\" target=\"_blank\">Bill to criminalise AI child abuse apps to be introduced<\/a><\/p>\n<p class=\"Typography_base__sj2RP RelatedCard_synopsis__cFwMW Typography_sizeMobile14__u7TGe Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Independent MP Kate Chaney is set to introduce a bill to criminalise the use of AI tools purpose-built to create child sexual abuse material.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;I spoke to the attorney-general&#8217;s office, and there was an acknowledgement that, yeah, there probably is an issue here. But still, we&#8217;ve seen no action on it,&#8221; she said.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The government passed a law in August 2024 to criminalise sharing non-consensual sexually explicit deepfakes, although it did not criminalise the act of creating such material.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Ms Chaney and Senator Pocock said there was now an urgent need for far broader protections beyond the issue of sexualised deepfakes.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;The crossbench is stepping up here because the government has been missing in action,&#8221; Senator Pocock said.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;Talking to Australians, they&#8217;re concerned about the misuse of AI,&#8221; he said.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Last week, Ms Chaney raised similar concerns about the lack of protections, calling for Australia to establish its own AI Safety Institute.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;The US, the UK, Canada, Japan, Singapore all have an equivalent.
