{"id":17107,"date":"2025-09-12T02:16:08","date_gmt":"2025-09-12T02:16:08","guid":{"rendered":"https:\/\/www.newsbeep.com\/nz\/17107\/"},"modified":"2025-09-12T02:16:08","modified_gmt":"2025-09-12T02:16:08","slug":"florida-appeals-federal-ruling-striking-down-book-ban-law-as-unconstitutional","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/nz\/17107\/","title":{"rendered":"Florida appeals federal ruling striking down book ban law as unconstitutional"},"content":{"rendered":"<p>                   CBS News Live <\/p>\n<p>          <img decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/nz\/wp-content\/uploads\/2025\/09\/ap24317807826093.jpg\"   class=\"temp__img\"\/><\/p>\n<p>                              <a href=\"https:\/\/www.cbsnews.com\/miami\/live\/\" class=\"embed__headline-link\" data-invalid-url-rewritten-http=\"\" rel=\"nofollow noopener\" target=\"_blank\"><\/p>\n<p>          CBS News Miami<\/p>\n<p>          Live<\/p>\n<p>                      <\/a><\/p>\n<p>The state has appealed a federal judge&#8217;s ruling that said a key part of a 2023 Florida law that led to <a href=\"https:\/\/www.cbsnews.com\/miami\/news\/bookleggers-library-in-miami-offers-free-books-including-ones-banned-in-schools\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\" rel=\"nofollow noopener\">books being removed<\/a> from school library shelves is &#8220;overbroad and unconstitutional.&#8221;  <\/p>\n<p>Attorney General James Uthmeier&#8217;s office, representing members of the State Board of Education, filed a notice Wednesday that is a first step in appealing U.S. District Judge Carlos Mendoza&#8217;s ruling to the 11th U.S. Circuit Court of Appeals.  <\/p>\n<p>As is common, the notice did not detail arguments the state will make at the Atlanta-based appeals court.<\/p>\n<p>Federal judge sides with publishers and parents<\/p>\n<p>Mendoza on Aug. 13 issued a 50-page decision that sided with a group of publishers, authors and parents in the First Amendment lawsuit filed last year.  <\/p>\n<p>Mendoza focused primarily on part of the law that seeks to prevent the availability of reading material that &#8220;describes sexual conduct.&#8221;  <\/p>\n<p>The Orlando-based judge wrote that the law &#8220;does not evaluate the work to determine if it has any holistic value&#8221; and &#8220;does not specify what level of detail &#8216;describes sexual conduct.'&#8221;<\/p>\n<p>Law&#8217;s removal process sparks controversy<\/p>\n<p>The law set up a process in which parents could object to reading material that is &#8220;pornographic&#8221; or &#8220;depicts or describes sexual conduct.&#8221;  <\/p>\n<p>It required books that received such objections to be removed within five days and to remain unavailable until the objections were resolved.
