As the name suggests, it is legally binding, but most will lapse or expire after up to three years.<\/p>\n<p class=\"yf-7hmkaz\">Glissan &amp; Associates Lawyers practice manager James Glissan told Yahoo Finance that without a binding death benefit nomination, the trustee of your <a data-i13n=\"cpos:5;pos:1\" href=\"https:\/\/au.finance.yahoo.com\/news\/major-3-million-superannuation-tax-change-coming-for-aussies-in-2026-fairer-214700501.html\" data-ylk=\"slk:super fund;cpos:5;pos:1;elm:context_link;itc:0;sec:content-canvas;outcm:mb_qualified_link;_E:mb_qualified_link;ct:story;\" class=\"link  yahoo-link\" rel=\"nofollow noopener\" target=\"_blank\">super fund<\/a> decides where your superannuation goes and this could be \u201ctotally different\u201d to what your will says.<\/p>\n<p class=\"yf-7hmkaz\">RELATED<\/p>\n<p class=\"yf-7hmkaz\">\u201cIt\u2019s definitely one of the factors that leads to a lot of <a data-i13n=\"cpos:9;pos:1\" href=\"https:\/\/au.finance.yahoo.com\/news\/inheritance-warning-as-australians-without-a-will-left-vulnerable-in-35-trillion-wealth-transfer-190007924.html\" data-ylk=\"slk:family provisions claims;cpos:9;pos:1;elm:context_link;itc:0;sec:content-canvas;outcm:mb_qualified_link;_E:mb_qualified_link;ct:story;\" class=\"link  yahoo-link\" rel=\"nofollow noopener\" target=\"_blank\">family provisions claims<\/a>, because obviously, once the big nest egg is removed from the intentions of the will, that tends to cause a lot of animosity and a lot of fights between people,\u201d he said.<\/p>\n<p class=\"yf-7hmkaz\">Glissan gave the example of a Western Australian man <a data-i13n=\"cpos:10;pos:1\" href=\"https:\/\/au.finance.yahoo.com\/news\/baby-boomer-terrified-kids-will-blow-80-million-inheritance-odds-arent-good-031727284.html\" data-ylk=\"slk:who left everything in his will;cpos:10;pos:1;elm:context_link;itc:0;sec:content-canvas;outcm:mb_qualified_link;_E:mb_qualified_link;ct:story;\" class=\"link  yahoo-link\" rel=\"nofollow noopener\" target=\"_blank\">who left everything in his will<\/a> to his kids. Despite this, his super fund paid more than $300,000 to his de facto partner instead of his kids because his binding death benefit nomination form had lapsed.<\/p>\n<p class=\"yf-7hmkaz\">\u201cOne of the big issues is people will do it once. Understandably, people often think that it works like a will, and that it is binding until you change it, or until there&#8217;s some triggering event,\u201d he said.<\/p>\n<p class=\"yf-7hmkaz\">\u201cBut more often than not, most super funds have this three-year expiration period, so it can become lapsed. Experts expect disputes will continue to become more common as older Australians transfer an <a data-i13n=\"cpos:13;pos:1\" href=\"https:\/\/au.finance.yahoo.com\/news\/inheritance-impatience-exposes-generation-of-australians-to-financial-abuse-as-54-trillion-wealth-transfer-looms-032435978.html\" data-ylk=\"slk:expected $5.4 trillion to younger generations;cpos:13;pos:1;elm:context_link;itc:0;sec:content-canvas;outcm:mb_qualified_link;_E:mb_qualified_link;ct:story;\" class=\"link  yahoo-link\" rel=\"nofollow noopener\" target=\"_blank\">expected $5.4 trillion to younger generations<\/a> over the next 20 years.<\/p>\n<p class=\"yf-7hmkaz\">A death benefit nomination allows you to nominate who you would like to receive your <a data-i13n=\"cpos:14;pos:1\" href=\"https:\/\/au.finance.yahoo.com\/news\/cbus-super-announces-major-death-benefit-overhaul-to-allocate-retirement-payouts-quicker-013116366.html\" data-ylk=\"slk:super benefits;cpos:14;pos:1;elm:context_link;itc:0;sec:content-canvas;outcm:mb_qualified_link;_E:mb_qualified_link;ct:story;\" class=\"link  yahoo-link\" rel=\"nofollow noopener\" target=\"_blank\">super benefits<\/a> in the event of your death.<\/p>\n<p> Story Continues  <\/p>\n<p class=\"yf-7hmkaz\">They can be binding or non-binding. A binding nomination will be legally binding, while a non-binding nomination will let your fund know about your wishes, but can be overruled. The super trustee will get to decide who gets the money under superannuation law and regulations.<\/p>\n<p class=\"yf-7hmkaz\">\u201cThat\u2019s what leads to a lot of disputes as well because you have your ex-partners or estranged relatives, blended families and the trustee may not necessarily follow what the will intends,\u201d Glissan said.<\/p>\n<p class=\"yf-7hmkaz\">You can\u2019t nominate just anyone and it\u2019ll need to be dependants, such as a spouse or de facto partner, your children, a financial dependent or an interdependency. You can also nominate your estate.<\/p>\n<p class=\"yf-7hmkaz\">A binding nomination will generally require you to complete a form and sign it in the presence of two witnesses who are not beneficiaries.<\/p>\n<p class=\"yf-7hmkaz\">It is generally valid for three years, so you\u2019ll need to renew it before the time is up or it will become non-binding.<\/p>\n<p class=\"yf-7hmkaz\">Glissan recommended three simple steps that Aussies can take to stop this from turning into a \u201cmonumental issue\u201d where the intended recipients of your <a data-i13n=\"cpos:15;pos:1\" href=\"https:\/\/au.finance.yahoo.com\/news\/aussies-richer-than-ever-as-wealth-boom-boosts-superannuation-cash-and-stocks-we-are-loaded-000042323.html\" data-ylk=\"slk:superannuation;cpos:15;pos:1;elm:context_link;itc:0;sec:content-canvas;outcm:mb_qualified_link;_E:mb_qualified_link;ct:story;\" class=\"link  yahoo-link\" rel=\"nofollow noopener\" target=\"_blank\">superannuation<\/a> miss out.<\/p>\n<p class=\"yf-7hmkaz\">First, check that you have a binding death benefit nomination.<\/p>\n<p class=\"yf-7hmkaz\">Second, check that it is valid and hasn\u2019t lapsed due to the three-year rule.<\/p>\n<p class=\"yf-7hmkaz\">Third, check that your super is going where you want it to go.<\/p>\n<p class=\"yf-7hmkaz\">\u201cIt only takes, realistically, 10 to 15 minutes, assuming you know what your login is to your super.
