It is also a decade since another key moment in climate justice, when a <a href=\"https:\/\/www.theguardian.com\/environment\/2015\/jun\/24\/dutch-government-ordered-cut-carbon-emissions-landmark-ruling\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">state was ordered<\/a> for the first time to cut its carbon emissions faster to protect its citizens from climate change. The Urgenda case, which was <a href=\"https:\/\/www.theguardian.com\/world\/2019\/dec\/20\/dutch-supreme-court-upholds-landmark-ruling-demanding-climate-action\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">upheld by the Netherlands\u2019 supreme court in 2019<\/a>, was one of the first rumblings of a wave of climate litigation around the world that <a href=\"https:\/\/climatelitigationnetwork.org\/tenyearsclimatelitigation\/\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">campaigners say<\/a> has resulted in a new legal architecture for climate protection.<\/p>\n<p class=\"dcr-130mj7b\">Over the past 12 months, there have been many more important rulings and tangible changes on climate driven by legal action.<\/p>\n<p>Rosebank and Jackdaw approval ruled illegal<\/p>\n<p class=\"dcr-130mj7b\">The year started with a bang when UK government approval of the Rosebank and Jackdaw oil and gas fields in the North Sea was ruled illegal by <a href=\"https:\/\/www.theguardian.com\/environment\/2025\/jan\/30\/rosebank-oilfield-jackdaw-decision-unlawful-edinburgh-court\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">the Scottish court of session<\/a>, because it did not account for greenhouse gas emissions caused by burning the extracted fossil fuels.<\/p>\n<p class=\"dcr-130mj7b\">The judgment relied heavily on a <a href=\"https:\/\/www.theguardian.com\/environment\/article\/2024\/jun\/20\/landmark-supreme-court-ruling-throws-doubt-on-new-uk-fossil-fuel-projects?ref=the-wave.net\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">2024 supreme court ruling<\/a> in a climate <a href=\"https:\/\/www.theguardian.com\/environment\/article\/2024\/jun\/26\/sarah-finch-climate-activism-uk-supreme-court-win\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">case brought by campaigner Sarah Finch<\/a>. That ruling also led the high court to throw out <a href=\"https:\/\/inews.co.uk\/news\/plan-new-uk-coal-mine-blocked-high-court-3274992?ref=the-wave.net\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">planning permission<\/a> for a new coalmine in Whitehaven, Cumbria, after which the <a href=\"https:\/\/www.theguardian.com\/environment\/2025\/apr\/04\/mining-firm-withdraws-plan-for-uks-first-deep-coalmine-in-30-years\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">company withdrew its plans<\/a>.<\/p>\n<p class=\"dcr-130mj7b\">The government <a href=\"https:\/\/www.gov.uk\/government\/news\/new-guidance-issued-for-environmental-impact-assessments?ref=the-wave.net\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">published new guidance<\/a> in June on how these assessments should be undertaken, although the ruling <a href=\"https:\/\/www.theguardian.com\/environment\/2025\/jun\/19\/uk-ministers-to-restart-approval-process-for-two-north-sea-oilfields\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">does not automatically prevent regulators<\/a> from approving fossil fuel projects once they have fully analysed their impacts.<\/p>\n<p class=\"dcr-130mj7b\">Equinor published a <a href=\"https:\/\/cdn.equinor.com\/files\/h61q9gi9\/global\/685dbd65fd8991b72499a38e131b822a6fde5438.pdf?rosebank-assessment-of-scope-3-emissions-equinor.pdf\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">revised environmental assessment<\/a> of Rosebank in October and a decision on approval is imminent. The government has hinted that it may give consent again, and Greenpeace has vowed further legal action if that happens.<\/p>\n<p>Plans to build Brazil\u2019s largest coal plant scrapped<\/p>\n<p class=\"dcr-130mj7b\">Civil society organisations have been campaigning for years against a coalmine and power plant in the southern state of Rio Grande do Sul planned by the coal company Copelmi. If it had gone ahead, it would have been the largest coal plant in Brazil.<\/p>\n<p class=\"dcr-130mj7b\">The groups argued that the Nova Seival plant and Gua\u00edba mine breached Brazil\u2019s climate obligations, and that the licensing process had not been undertaken properly. In 2022, a court <a href=\"https:\/\/www.climatecasechart.com\/document\/instituto-preservar-et-al-v-copelmi-mineracao-ltda-and-ibama_99f9?q=%22nova+seival%22\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">suspended the licences<\/a> and set out requirements for how the process should be revised. But in February this year, Copelmi <a href=\"https:\/\/ihu.unisinos.br\/categorias\/648978-mineradora-desiste-de-projetos-da-mina-guaiba-e-da-usina-termeletrica-nova-seival\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">formally withdrew its plans<\/a>, saying the project had become unfeasible.<\/p>\n<p>German court opens door for climate damages claims<\/p>\n<p class=\"dcr-130mj7b\">On the face of it, it sounds like a failure that a German court <a href=\"https:\/\/www.theguardian.com\/world\/2025\/may\/28\/rwe-peruvian-farmer-court-germany\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">rejected a climate case<\/a> brought by a Peruvian farmer and mountain guide against German energy company RWE.<\/p>\n<p class=\"dcr-130mj7b\"><a href=\"https:\/\/www.theguardian.com\/business\/2025\/mar\/19\/farmer-climate-change-legal-case-rwe-peru-germany\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">Sa\u00fal Luciano Lliuya had sought<\/a> 0.47% of the overall cost of building flood defences to protect his home from a melting glacier, a proportion equivalent to RWE\u2019s contribution to global emissions.<\/p>\n<p class=\"dcr-130mj7b\">But the <a href=\"https:\/\/www.theguardian.com\/environment\/2015\/mar\/16\/peruvian-farmer-demands-climate-compensation-from-german-company\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">decade-old case<\/a> had always been a stretch, and in reality it set a potentially important precedent on polluters\u2019 liability for their carbon emissions.<\/p>\n<p class=\"dcr-130mj7b\">So it was not a surprise when later in the year a group of Pakistani farmers whose livelihoods were devastated by floods three years ago <a href=\"https:\/\/www.theguardian.com\/environment\/2025\/oct\/28\/pakistani-farmers-to-sue-german-polluters-over-climate-linked-flood-damage\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">fired the starting shot in a new legal claim<\/a> against two of Germany\u2019s most polluting companies.<\/p>\n<p>EnergyAustralia settles greenwashing lawsuit with parents<\/p>\n<p class=\"dcr-130mj7b\">In May, EnergyAustralia <a href=\"https:\/\/www.theguardian.com\/australia-news\/2025\/may\/19\/energy-australia-apologises-to-400000-customers-and-settles-greenwashing-legal-action?ref=the-wave.net\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">settled a greenwashing lawsuit<\/a> brought by a group of Australian parents.<\/p>\n<p class=\"dcr-130mj7b\">Climate action group Parents for Climate claimed EnergyAustralia breached Australian Consumer Law when promoting electricity and gas products because the carbon offsets used to secure certification were not backed by meaningful reductions in emissions.<\/p>\n<p class=\"dcr-130mj7b\">As part of the settlement, the utility company acknowledged that carbon offsets do not prevent or undo damage caused by greenhouse gas emissions and apologised to 400,000 customers who were part of the scheme.<\/p>\n<p class=\"dcr-130mj7b\">It was the <a href=\"https:\/\/www.theguardian.com\/australia-news\/2025\/may\/14\/energy-australia-is-in-court-accused-of-greenwashing-what-is-the-case-about-and-why-is-it-significant\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">first case in the country<\/a> to be brought against a company for marketing itself as carbon neutral.<\/p>\n<p>International courts issue landmark climate opinions<\/p>\n<p class=\"dcr-130mj7b\">Two international courts issued landmark advisory opinions on climate change in July.<\/p>\n<p class=\"dcr-130mj7b\">First was the <a href=\"https:\/\/www.theguardian.com\/environment\/2025\/jul\/03\/countries-must-protect-human-right-to-a-stable-climate-court-rules\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">inter-American court of human rights<\/a>, which found that there is a human right to a healthy climate and states have a duty to protect it. This was closely followed by the <a href=\"https:\/\/www.theguardian.com\/environment\/2025\/jul\/23\/healthy-environment-is-a-human-right-top-un-court-rules\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">international court of justice<\/a>, which said countries must prevent harm to the climate system and that failing to do so could result in their having to pay compensation and make other forms of restitution.<\/p>\n<p class=\"dcr-130mj7b\">The two documents are already being <a href=\"https:\/\/www.the-wave.net\/young-people-international-court-justice-legal-climate-change\/\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">referenced in climate lawsuits around the world<\/a>. And <a href=\"https:\/\/www.theguardian.com\/environment\/2025\/nov\/09\/what-impact-will-icj-climate-ruling-have-on-cop30\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">attempts were made to use them as leverage<\/a> during climate talks in Brazil last month, although this proved <a href=\"https:\/\/www.climatechangenews.com\/2025\/12\/04\/why-the-icjs-advisory-opinion-on-climate-change-took-a-backseat-at-cop30\/\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">more difficult than anticipated<\/a>.<\/p>\n<p>New South Wales coalmine expansion annulled<\/p>\n<p class=\"dcr-130mj7b\">Approval for the largest coalmine expansion in New South Wales was <a href=\"https:\/\/www.theguardian.com\/australia-news\/2025\/jul\/24\/significant-legal-breakthrough-as-nsw-court-blocks-coal-mine-expansion-over-emissions?ref=the-wave.net\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">annulled<\/a> in July because the state\u2019s independent planning commission did not take into account the project\u2019s full greenhouse gas emissions.<\/p>\n<p class=\"dcr-130mj7b\">Denman Aberdeen Muswellbrook Scone Healthy Environment Group, working with the Environmental Defenders Office, filed the case in 2023, arguing MACH Energy\u2019s <a href=\"https:\/\/www.the-wave.net\/r\/9abd5c68?m=1a66047d-f4a7-4a14-991b-4c3b981b1ae0\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">Mount Pleasant Optimisation<\/a> coal mining project near Muswellbrook would worsen climate change and threaten a unique species of legless lizard.<\/p>\n<p class=\"dcr-130mj7b\">The court of appeal said the commission failed to account for \u201cscope 3\u201d emissions when the coal is exported and burned overseas.<\/p>\n<p>Apple scales back carbon neutrality claims<\/p>\n<p class=\"dcr-130mj7b\">In August, a Frankfurt court ruled that Apple was not allowed to call its Apple Watch \u201ccarbon neutral\u201d.<\/p>\n<p class=\"dcr-130mj7b\">It agreed with German NGO Deutsche Umwelthilfe that the company could not demonstrate long-term carbon neutrality because the claim was based on funding eucalyptus groves in Paraguay, leases for which expire soon.<\/p>\n<p class=\"dcr-130mj7b\">Apple is trying to get a <a href=\"https:\/\/www.the-wave.net\/us-edf-backs-apple-in-greenwashing-carbon-offsetting-claim\/\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">similar greenwashing case<\/a> against it in the US dismissed.<\/p>\n<p class=\"dcr-130mj7b\">A few months later, <a href=\"https:\/\/www.watchgeneration.fr\/apple-watch\/2025\/10\/les-nouvelles-apple-watch-ne-sont-plus-neutres-en-carbone-18799?ref=the-wave.net\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">tech news websites noticed<\/a> that Apple had stopped marketing its newly launched watches as carbon neutral in other countries too.<\/p>\n<p>Hawaii to cut transport emissions after lawsuit<\/p>\n<p class=\"dcr-130mj7b\">Last year, Hawaii <a href=\"https:\/\/www.theguardian.com\/us-news\/article\/2024\/jun\/20\/hawaii-youth-climate-activists-win\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">agreed to settle a lawsuit<\/a> by 13 young people, represented by Our Children\u2019s Trust, who said it was breaching their rights with infrastructure that contributes to climate change.<\/p>\n<p class=\"dcr-130mj7b\"><a href=\"https:\/\/governor.hawaii.gov\/newsroom\/office-of-the-governor-news-release-historic-agreement-settles-navahine-climate-litigation\/?ref=the-wave.net\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">The settlement acknowledged<\/a> the constitutional rights of Hawaii youth to a life-sustaining climate, and the state promised to develop a roadmap to achieve zero emissions for its ground, sea and inner island air transportation systems by 2045.<\/p>\n<p class=\"dcr-130mj7b\">In October, it delivered. The <a href=\"https:\/\/hidot.hawaii.gov\/wp-content\/uploads\/2025\/10\/FINAL-ESWRP-2025-10-15.pdf\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">energy security and waste reduction plan<\/a> includes new electric vehicle chargers, investments in public and active transport, and efforts to sequester carbon through native reforestation. It will be updated annually.<\/p>\n<p class=\"dcr-130mj7b\"><a href=\"https:\/\/navahinevhawaiidot.ourchildrenstrust.org\/settlement\/\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">Campaigners called the plan<\/a> a \u201ccritical milestone\u201d.<\/p>\n<p>Campaigners put end to coal power plant in Kenya<\/p>\n<p class=\"dcr-130mj7b\">Environmental campaigners won a key climate case challenging approval of a coal power plant in Lamu, on Kenya\u2019s southern coast, in October.<\/p>\n<p class=\"dcr-130mj7b\">Litigation against Amu Power (a joint venture between Centum and Gulf Energy) and the Kenyan National Environment Management Authority began a decade ago and <a href=\"https:\/\/www.theguardian.com\/global-development\/2019\/jul\/11\/kenya-first-coal-plant-construction-paused-climate-victory\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">construction was ordered to stop in 2019<\/a>.<\/p>\n<p class=\"dcr-130mj7b\">The environment and land court finally upheld a revocation of the plant\u2019s licence because of flaws in the environmental assessment, particularly a lack of proper public participation. Climate change impacts had also not been properly assessed.<\/p>\n<p>TotalEnergies ordered to stop greenwashing in France<\/p>\n<p class=\"dcr-130mj7b\">Later in the month, TotalEnergies <a href=\"https:\/\/www.theguardian.com\/environment\/2025\/oct\/23\/oil-firm-totalenergies-made-misleading-green-statements-court-rules\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">was found to have made false claims about its climate goals<\/a> in a French court for false claims about its climate goals.<\/p>\n<p class=\"dcr-130mj7b\">Les Amis de la Terre France, Greenpeace France and Notre Affaire \u00e0 Tous, with the support of ClientEarth, claimed TotalEnergies\u2019s \u201creinvention\u201d marketing campaign broke European consumer law by suggesting it could reach net zero carbon emissions by 2050 while continuing to produce fossil fuels.<\/p>\n<p class=\"dcr-130mj7b\">The Paris judicial court ruled that some claims on the company\u2019s French website were likely to mislead consumers because there was not enough information about what they meant.<\/p>\n<p>Meat companies settle greenwashing claims<\/p>\n<p class=\"dcr-130mj7b\">In early November, New York <a href=\"https:\/\/ag.ny.gov\/press-release\/2025\/attorney-general-james-secures-11-million-climate-smart-agriculture-worlds?ref=the-wave.net\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">agreed a $1.1m settlement<\/a> with Brazilian meat company JBS\u2019s US arm to end a lawsuit claiming the company misled customers about its efforts to reduce its greenhouse gas emissions.<\/p>\n<p class=\"dcr-130mj7b\">The money will be used to support climate-smart agriculture programmes that help New York farmers adopt best practices to reduce emissions, increase resiliency and enhance productivity. JBS USA also agreed to reform its environmental marketing practices and report annually to the New York office of the attorney general for three years.<\/p>\n<p class=\"dcr-130mj7b\">Soon after, Tyson Foods also <a href=\"https:\/\/www.reuters.com\/sustainability\/cop\/tyson-foods-halt-carbon-emissions-claims-environmental-group-says-2025-11-17\/?ref=the-wave.net\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">agreed to stop saying<\/a> it will reach net zero greenhouse gas emissions by 2050 and marketing beef as climate friendly to settle a greenwashing lawsuit brought by agriculture industry watchdog Environmental Working Group.<\/p>\n<p>UK government publishes tougher climate plan<\/p>\n<p class=\"dcr-130mj7b\">The UK government published a revised <a href=\"https:\/\/www.gov.uk\/government\/news\/climate-plan-captures-clean-energy-benefits-and-boosts-investment?ref=the-wave.net\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">carbon budget and growth delivery plan<\/a> in October after its previous plan was ruled unlawful by the high court.<\/p>\n<p class=\"dcr-130mj7b\">The <a href=\"https:\/\/www.theguardian.com\/environment\/2025\/oct\/29\/uk-unveils-carbon-budget-delivery-plan-to-get-back-on-track-for-net-zero-targets?ref=the-wave.net#:~:text=The%20prime%20minister%2C%20Keir%20Starmer,gas%20emissions%20drastically%20by%202037.\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">new document reaffirms<\/a> the UK\u2019s commitment to decarbonise its electricity supply by 2030 and reduce greenhouse gas emissions drastically by 2037, with specific measures for energy, transport, agriculture, homes and industry.<\/p>\n<p class=\"dcr-130mj7b\">It follows a successful lawsuit by the Good Law Project, Friends of the Earth and ClientEarth. After the <a href=\"https:\/\/www.theguardian.com\/environment\/2022\/jul\/18\/court-orders-uk-government-to-explain-how-net-zero-policies-will-reach-targets?ref=the-wave.net\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">striking down of the original<\/a> net zero strategy in court in 2022, the trio argued that the \u201cthreadbare\u201d revised version was still not good enough.<\/p>\n<p class=\"dcr-130mj7b\">However, campaigners are <a href=\"https:\/\/glanlaw.org\/cases\/climate-justice-case-with-good-law-project\/\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">planning another round of legal action<\/a> challenging national climate strategy, this time at the European court of human rights.<\/p>\n<p>Three Norwegian oilfields ruled illegal<\/p>\n<p class=\"dcr-130mj7b\">Licences for three oilfields in the North Sea were declared illegal in November by a Norwegian court because they were approved without the full impacts of climate change being considered.<\/p>\n<p class=\"dcr-130mj7b\">The Borgarting court of appeal <a href=\"https:\/\/www.climatecasechart.com\/documents\/greenpeace-nordic-and-nature-youth-v-energy-ministry-the-north-sea-fields-case-decision_caa9?q=greenpeace+nordic\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">upheld a claim<\/a> by Greenpeace Nordic and Natur og Ungdom challenging permission for the Equinor-operated Breidablikk and Aker BP\u2019s Yggdrasil and Tyrving fields.<\/p>\n<p class=\"dcr-130mj7b\">The decision closely followed the European court of human rights\u2019s <a href=\"https:\/\/hudoc.echr.coe.int\/?ref=the-wave.net#%7B%22itemid%22:%5B%22001-245561%22%5D%7D\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">dismissal of a lawsuit by the same claimants against Norway<\/a>, which nonetheless set important standards for how states should undertake environmental impact assessments of fossil fuel projects.<\/p>\n<p class=\"dcr-130mj7b\">However, the Borgarting court stopped short of ordering the fields to stop producing oil, giving the Norwegian government six months to sort out the licences.<\/p>\n","protected":false},"excerpt":{"rendered":"This year marks the 10th anniversary of the Paris agreement.
