Ted Cruz seen hopping on flight ahead of catastrophic storm\" rel=\"nofollow noopener\" target=\"_blank\">Texas<\/a> man became severely ill and died after his longtime <a href=\"https:\/\/www.independent.co.uk\/topic\/pharmacy\" rel=\"nofollow noopener\" target=\"_blank\">pharmacy<\/a> mistakenly gave him another patient\u2019s prescription medication, according to a wrongful death <a href=\"https:\/\/www.independent.co.uk\/topic\/lawsuit\" rel=\"nofollow noopener\" target=\"_blank\">lawsuit<\/a> obtained by The Independent.<\/p>\n<p>Joseph Hamilton Broussard took the pills as directed for 66 days, which ultimately proved fatal, alleges a complaint filed Wednesday evening by his daughter.<\/p>\n<p>An expert opinion submitted to the court by a physician specializing in emergency medicine and toxicology contends Broussard\u2019s death, following an 11-month decline, was a direct result of having been dispensed the wrong drug, calling out Houston\u2019s Mercury Drive Pharmacy for \u201c<a href=\"https:\/\/www.independent.co.uk\/topic\/negligence\" rel=\"nofollow noopener\" target=\"_blank\">negligence<\/a> and breaches in the standard of care.\u201d<\/p>\n<p>\u201cThere are several steps that the standard of care requests to ensure a patient does not receive a medication intended for another patient,\u201d the opinion reads. \u201cHowever, one of the most fundamental checks is to ensure before a medication is given or delivered to a patient that the name on the pill bottle matches the name of the patient it is being given to.\u201d<\/p>\n<p>Mercury Drive is a member of Health Mart, a nationwide network of independent pharmacies, which is owned by McKesson, the publicly traded pharmaceutical distributor. A McKesson spokesperson did not respond Thursday to a request for comment. An employee who answered the phone at Mercury Drive said he would not be able to pass along a message to owner James Muldrow. On August 8, 2024, a bottle containing 90 45-milligram tablets of pioglitazone, a diabetes drug sold under the brand name Actos, arrived at Broussard\u2019s Houston home, it says. He followed the instructions precisely, taking one pill a day, the complaint continues. <\/p>\n<p>But Broussard \u2013 who had a pacemaker and was living with <a href=\"https:\/\/www.independent.co.uk\/bulletin\/news\/diabetes-type-1-screening-children-clinics-b2904374.html\" title=\"Diabetes screening could mark \u2018step change\u2019 in children\u2019s diagnosis\" rel=\"nofollow noopener\" target=\"_blank\">type 2 diabetes<\/a>, high blood pressure, high cholesterol, atrial fibrillation, congestive heart failure and had part of his kidney removed during a battle against cancer \u2013 hadn\u2019t been prescribed pioglitazone, the complaint states. Instead, it goes on, the meds were meant for someone else.<\/p>\n<p>That October, Broussard showed up at an area hospital complaining of shortness of breath and swollen ankles, the complaint states. Doctors found Broussard was retaining water due to a worsening of his congestive heart failure, started him on IV diuretics, and kept him under medical observation for two days. <\/p>\n<p>Several months later, following a bout of pneumonia, Broussard was hospitalized with \u201ccongestive heart failure exacerbation,\u201d this time for an entire week, according to the complaint.<\/p>\n<p>It says Broussard\u2019s health took a turn for the worse from there, and on June 7, 2025, he died. <\/p>\n<p><img decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/nz\/wp-content\/uploads\/2026\/01\/Screenshot-2026-01-22-at-3-42-56-PM.png\"  loading=\"lazy\" alt=\"The Houston pharmacy being sued by Joseph Hamilton Broussard's daughter is accused of sending the 91-year-old someone else's meds\" class=\"sc-1mc30lb-0 ggpMaE inline-gallery-btn\"\/><\/p>\n<p>open image in gallery<\/p>\n<p>The Houston pharmacy being sued by Joseph Hamilton Broussard&#8217;s daughter is accused of sending the 91-year-old someone else&#8217;s meds (Google Maps)<\/p>\n<p>Of the 90 pioglitazone pills in the bottle Broussard had been improperly sent, 24 remained, according to the <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.documentcloud.org\/documents\/26501567-broussard-medical-expert-opinionpdf\/\">expert opinion<\/a> filed alongside his daughter\u2019s complaint.<\/p>\n<p>\u201cHad Mr. Broussard not received this medication, it is more likely than not he would not have had an exacerbation of congestive heart failure or required hospitalization that he did,\u201d Jonathan David de Olano, M.D. wrote. <\/p>\n<p>It is \u201cforeseeable to all healthcare providers, including a pharmacy and its employees and staff, that failure to meet the standard of care described above can result in serious injuries or even death,\u201d the document by de Olano states. \u201cThat is why it is my opinion that the negligence and breaches in the standard of care identified by this report were a proximate cause of Mr. Broussard\u2019s resulting injuries.\u201d <\/p>\n<p>Pioglitazone promotes fluid retention, and can \u201ctrigger or worsen heart failure, particularly in individuals with pre-existing congestive heart failure, such as Mr. Broussard,\u201d according to de Olano. \u201c&#8230; Even in those with less severe cardiac dysfunction, careful monitoring is essential because volume overload may develop gradually and produce significant clinical consequences.\u201d<\/p>\n<p>With that in mind, de Olana said he believes it is \u201cmore likely than not, based on a reasonable degree of medical probability,\u201d that Broussard\u2019s taking pioglitazone resulted in his initial hospitalization and helped bring about his eventual demise.<\/p>\n<p>\u201cHad Mercury Drive Pharmacy\u2026 their employees and\/or staff complied with the standard of care, it is more likely than not that they would have identified that he was about to receive the wrong medication and would not have provided it to him,\u201d de Olana wrote.<\/p>\n<p>In 2019, a transcription error by a pharmacy technician led to the death of a patient, who was <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.pharmacytimes.com\/view\/dispensing-wrong-medications-leads-to-patients-death\">reportedly prescribed methotrexate<\/a>, a cancer drug, instead of metolazone, a diuretic. Last year, a 58-year-old auto mechanic died in the hospital after an in-house pharmacist accidentally <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.empr.com\/features\/medication-error-leads-to-patient-death-3-million-settlement\/\">prescribed him a lethal dose of pain killers<\/a>. In <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.live5news.com\/2025\/01\/18\/former-paramedic-facing-manslaughter-charge-patient-death-accused-giving-wrong-meds\/\">certain instances<\/a>, healthcare professionals have been <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/pmc.ncbi.nlm.nih.gov\/articles\/PMC1118964\/\">charged with manslaughter over medication errors<\/a>.<\/p>\n<p>Mercury Drive Pharmacy acted with \u201cconscious indifference to Broussard\u2019s rights, safety, health and welfare,\u201d according to Broussard\u2019s daughter\u2019s complaint.
