{"id":259010,"date":"2026-01-30T08:14:06","date_gmt":"2026-01-30T08:14:06","guid":{"rendered":"https:\/\/www.newsbeep.com\/nz\/259010\/"},"modified":"2026-01-30T08:14:06","modified_gmt":"2026-01-30T08:14:06","slug":"jury-returns-verdict-in-trial-over-whangamata-bakery-owners-collision-with-pedestrian","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/nz\/259010\/","title":{"rendered":"Jury returns verdict in trial over Whangamat\u0101 bakery owner\u2019s collision with pedestrian"},"content":{"rendered":"<p class=\"vwaNpWtPaxhXkxNi\" style=\"display:none\">Brett Henderson got in her Isuzu D-Max ute, and drove to find the man \u2013 Duane Jackison \u2013 who sometimes slept rough outside their <a href=\"https:\/\/www.nzherald.co.nz\/topic\/coromandel-peninsula\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.nzherald.co.nz\/topic\/coromandel-peninsula\/\">beachside town<\/a> bakery.<\/p>\n<p class=\"vwaNpWtPaxhXkxNi\" style=\"display:none\">Jackison was hit by the vehicle soon after.<\/p>\n<p class=\"vwaNpWtPaxhXkxNi\" style=\"display:none\">This week, in a <a href=\"https:\/\/www.nzherald.co.nz\/nz\/whangamata-bakery-owner-leslie-brett-henderson-accused-of-hitting-rough-man-with-isuzu-d-max-ute\/XYW6JXYUF5HSBJC3KDG23TJI2U\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.nzherald.co.nz\/nz\/whangamata-bakery-owner-leslie-brett-henderson-accused-of-hitting-rough-man-with-isuzu-d-max-ute\/XYW6JXYUF5HSBJC3KDG23TJI2U\/\">jury trial in the Tauranga District Court<\/a>, the Crown alleged Henderson was angry and \u201cticked off\u201d \u2013 both about his wife being upset by Jackison, and the damage to a near-new ute, which Christine referred to as \u201cher baby\u201d.<\/p>\n<p><img  alt=\"The bin hit the side of her ute, causing a scratch.\" class=\"article-media__image responsively-lazy\" data-test-ui=\"article-media__image\"\/>The bin hit the side of her ute, causing a scratch.<\/p>\n<p class=\"vwaNpWtPaxhXkxNi\" style=\"display:none\">The Crown claimed he went to find him, confront him, and \u201cdeal\u201d with him.<\/p>\n<p class=\"vwaNpWtPaxhXkxNi\" style=\"display:none\">But Henderson, who was represented by Philip Morgan KC, said he just wanted to have a \u201cman-to-man\u201d conversation with Jackison.<\/p>\n<p class=\"vwaNpWtPaxhXkxNi\" style=\"display:none\">He said, under cross-examination by Crown Solicitor Anna Pollet, that he wasn\u2019t angry, upset, or agitated; he had just wanted to understand why Jackison, whom he knew to be usually calm, had thrown a bin at his wife\u2019s car.<\/p>\n<p><img  alt=\"The metal bin liner, which was photographed by police following the incident.\" class=\"article-media__image responsively-lazy\" data-test-ui=\"article-media__image\"\/>The metal bin liner, which was photographed by police following the incident.<\/p>\n<p class=\"vwaNpWtPaxhXkxNi\" style=\"display:none\">He said when he saw Jackison on the road, he braked and swerved right to put his headlights on him, as he thought Jackison was about to throw the bin into his driver\u2019s side window.<\/p>\n<p class=\"vwaNpWtPaxhXkxNi\" style=\"display:none\">Henderson said, in \u201chindsight\u201d, he realised he probably should have swerved left.<\/p>\n<p class=\"vwaNpWtPaxhXkxNi\" style=\"display:none\">Morgan, in his closing address, said the Crown had not established in \u201cany way, shape or form\u201d, that his client intentionally struck Jackison with his vehicle.<\/p>\n<p class=\"vwaNpWtPaxhXkxNi\" style=\"display:none\">Jackison passed away from unrelated health issues some months after the incident, so he wasn\u2019t able to give his account of what happened, nor be cross-examined on \u201chearsay\u201d statements he made to ambulance officers about being hit by a car.<\/p>\n<p class=\"vwaNpWtPaxhXkxNi\" style=\"display:none\">In a statement given at the time, one of the officers said Jackison told her he \u201cwalked in front of a car\u201d, while the other said he said he\u2019d been \u201chit by a car\u201d.<\/p>\n<p class=\"vwaNpWtPaxhXkxNi\" style=\"display:none\">In his closing address, Morgan KC presented a number of possible scenarios about why Jackison might have been walking around on the road and throwing a bin around.<\/p>\n<p class=\"vwaNpWtPaxhXkxNi\" style=\"display:none\">He outlined questions it would have been helpful to ask him, had he not unfortunately passed away \u2013 about what had happened, why he had been behaving that way, and what he said to the ambulance officers afterwards.<\/p>\n<p class=\"vwaNpWtPaxhXkxNi\" style=\"display:none\">However, Judge David Cameron told the jury, in his summing up, they didn\u2019t need to speculate about the unknown, they needed to focus on the evidence they had.<\/p>\n<p class=\"vwaNpWtPaxhXkxNi\" style=\"display:none\">He explained the caution they should take with \u201chearsay\u201d statements not tested in court, and also urged caution when the jury was analysing CCTV footage, telling them to recognise its limitations.<\/p>\n<p class=\"vwaNpWtPaxhXkxNi\" style=\"display:none\">Much time was spent during the trial zooming in and replaying the council-supplied CCTV footage, but the Crown and defence drew different conclusions about what it showed.<\/p>\n<p class=\"vwaNpWtPaxhXkxNi\" style=\"display:none\">The Crown said it made it clear Jackison was walking away, not holding a bin up in a threatening manner as Henderson claimed, when Henderson swerved towards him.<\/p>\n<p class=\"vwaNpWtPaxhXkxNi\" style=\"display:none\">Morgan said Jackison was in the middle of the road, and Henderson was braking and attempting to take evasive action to avoid someone who was behaving irrationally, and had earlier thrown a metal bin liner at a car.<\/p>\n<p class=\"vwaNpWtPaxhXkxNi\" style=\"display:none\">While that evasive action hadn\u2019t been successful, it remained an \u201caccident\u201d, and there was nothing to prove Henderson had deliberately hit Jackison.<\/p>\n<p class=\"vwaNpWtPaxhXkxNi\" style=\"display:none\">Jackison was examined by ambulance officers later that morning, after earlier being arrested for suspected wilful damage.<\/p>\n<p class=\"vwaNpWtPaxhXkxNi\" style=\"display:none\">He was taken to Thames Hospital, and an ED doctor gave evidence to say he was found to have four broken ribs, a collapsed lung, as well as cuts and abrasions.<\/p>\n<p class=\"vwaNpWtPaxhXkxNi\" style=\"display:none\">The Crown said the broken ribs and collapsed lung were caused by the impact with the ute; the defence said no one knew what happened to him after the impact with the car, but pointed to the fact Jackison had got \u201cstraight up\u201d afterwards.<\/p>\n<p class=\"vwaNpWtPaxhXkxNi\" style=\"display:none\">Henderson said the main impact had been with the bin, which Jackison had been holding up, and said that had caused the dent in the front of his ute.<\/p>\n<p><img  alt=\"The damage to the front of the Isuzu D-Max ute.\" class=\"article-media__image responsively-lazy\" data-test-ui=\"article-media__image\"\/>The damage to the front of the Isuzu D-Max ute.<\/p>\n<p class=\"vwaNpWtPaxhXkxNi\" style=\"display:none\">He said afterwards, he got out of his ute and threw Jackison onto the ground, after he came towards him \u201cranting and raving\u201d.<\/p>\n<p class=\"vwaNpWtPaxhXkxNi\" style=\"display:none\">But whether Jackison\u2019s injuries were caused by the impact with the car didn\u2019t change whether they were caused intentionally, in the defence\u2019s submission.<\/p>\n<p class=\"vwaNpWtPaxhXkxNi\" style=\"display:none\">Morgan reminded the jury of the standard of proof \u2013 beyond a reasonable doubt.<\/p>\n<p class=\"vwaNpWtPaxhXkxNi\" style=\"display:none\">\u201cAsk yourself this, members of the jury, if you\u2019re driving a car and somebody walks out in front of you, would you expect to be charged with some sort of driving offence?\u201d Morgan asked.<\/p>\n<p class=\"vwaNpWtPaxhXkxNi\" style=\"display:none\">He had reminded the jury that the car was \u201cunder braking\u201d as Henderson swerved.<\/p>\n<p class=\"vwaNpWtPaxhXkxNi\" style=\"display:none\">\u201cNo, because a person walked in front of your car, unless they did it so far off down the road that you\u2019d have been able to stop. And then you\u2019d be able to rely on the extent to which you hit the brakes. <\/p>\n<p class=\"vwaNpWtPaxhXkxNi\" style=\"display:none\">\u201cYou wouldn\u2019t dream of anybody alleging that you assaulted somebody deliberately with a weapon, and that can be proven against you beyond a reasonable doubt.\u201d<\/p>\n<p class=\"vwaNpWtPaxhXkxNi\" style=\"display:none\">The jury acquitted Henderson on the single charge of assault with a weapon.<\/p>\n<p class=\"vwaNpWtPaxhXkxNi\" style=\"display:none\">Hannah Bartlett is a Tauranga-based Open Justice reporter at NZME.
