{"id":269840,"date":"2026-02-06T00:51:07","date_gmt":"2026-02-06T00:51:07","guid":{"rendered":"https:\/\/www.newsbeep.com\/nz\/269840\/"},"modified":"2026-02-06T00:51:07","modified_gmt":"2026-02-06T00:51:07","slug":"tribunal-rules-auckland-dealer-must-repay-32000-for-potentially-catastrophic-damage-found-by-new-owner-in-car-chassis","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/nz\/269840\/","title":{"rendered":"Tribunal rules Auckland dealer must repay $32,000 for \u2018potentially catastrophic\u2019 damage found by new owner in car chassis"},"content":{"rendered":"<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">The <a href=\"https:\/\/www.nzherald.co.nz\/topic\/disputes-tribunal\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.nzherald.co.nz\/topic\/disputes-tribunal\/\">Motor Vehicle Disputes Tribunal<\/a> allowed Tilyard\u2019s application to reject the vehicle and therefore claim back what she had paid for it, plus $324 as a portion of the insurance policy she had also bought.<\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">\u201cIt\u2019s been a big ordeal as it was a lot of money,\u201d she told NZME.<\/p>\n<p>Low mileage, smart car<\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">Tilyard bought the <a href=\"https:\/\/www.nzherald.co.nz\/topic\/driven\/233\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.nzherald.co.nz\/topic\/driven\/233\/\">2006 Holden Commodore SS<\/a> from TCB Autos in Auckland last September.<\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">She said it was among the lower-priced vehicles of its kind, and showed low mileage on the clock.<\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">The 19-year-old vehicle had done just 39,000km, according to the odometer.<\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">An <a href=\"https:\/\/www.nzherald.co.nz\/topic\/nz-automobile-association\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.nzherald.co.nz\/topic\/nz-automobile-association\/\">AA vehicle inspection<\/a> noted general wear and tear and minor cosmetic defects.<\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">It also spotted trouble in the rear bumper which could have led to warrant of fitness problems, and a crack in the corner of the windscreen.<\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">Tilyard said the dealer fixed these issues before she agreed to buy the vehicle.<\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">She also purchased a <a href=\"https:\/\/www.nzherald.co.nz\/nz\/net-helps-buyers-avoid-rip-offs\/LXIVPXYKNWVYWSTW7EQTMKRH5Q\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.nzherald.co.nz\/nz\/net-helps-buyers-avoid-rip-offs\/LXIVPXYKNWVYWSTW7EQTMKRH5Q\/\">CarJam<\/a> report &#8211; an online service which provides detailed information about vehicles registered in New\u202fZealand.<\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">Tribunal adjudicator Crystal Euden said in a recent decision that it was relevant that the report noted no record of any damage to the vehicle.<\/p>\n<p>Evidence of front-on collision<\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">However, a few days after driving off from the yard, Tilyard suddenly found it hard to engage the gears in the six-speed manual and had to \u201cpump\u201d the clutch repeatedly. <\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">\u201cI couldn\u2019t get it into gear. That\u2019s not normal,\u201d she said.<\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">Concerned, she took the vehicle to a nearby workshop, and the scale of the troubles was revealed, including evidence the car appeared to have been in a front-on collision.<\/p>\n<p><img  alt=\"The Motor Vehicle Disputes Tribunal took into account the vehicle's age, correspondingly \u201cvery low mileage\u201d, and \u201csignificant price\u201d of $32,000 when assessing if the vehicle was of an acceptable quality when sold. Photo \/ 123rf<\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">Tilyard said that, in her view, the discovery of a \u201ccompletely worn\u201d hanger bearing, the critical support components in driveshafts causing driveshaft \u201cwhip\u201d, was the most alarming.<\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">Driveshaft whip is described online as a dangerous phenomenon leading to \u201cpotential catastrophic failure\u201d, causing massive damage to the vehicle.<\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">\u201cThe bearing was so loose it could have caused a major accident, and my 19-year-old son could have been driving it.\u201d<\/p>\n<p>\u2018Crinkled\u2019 chassis<\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">Euden said in the decision that although attempts had been made to correct different measurements in the right and left wheelbase, the alignment remained out, indicating chassis distortion which was supported by photos showing \u201ccrinkle\u201d in the chassis.<\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">Rust staining was visible from radiator water leaks, with additional rust on the right front chassis rail. The exhaust system was touching the vehicle body, which was a condition that would fail a WOF inspection.<\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">A faded recall sticker on the inner door pillar recorded 59,000km, which was inconsistent with the odometer reading of 39,000km.<\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">The vehicle was advertised as having a new WOF but it was five months old when Tilyard collected it. <\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">TCB Autos director Brock Duckmanton told the tribunal this was an oversight rather than a deliberate failure to comply.<\/p>\n<p>Vehicle was \u2018NZ new\u2019<\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">CarJam chief executive Paul Osborne told NZME he had reviewed the data relevant to the vehicle and found the report was essentially \u201cclean\u201d.<\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">He said they received information from a number of government sources and none indicated any damage history, or written-off status.<\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">Osborne said the vehicle was New Zealand new and had not been flagged as re-registered by the <a href=\"https:\/\/www.nzherald.co.nz\/topic\/nz-transport-agency\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.nzherald.co.nz\/topic\/nz-transport-agency\/\">NZTA<\/a>. <\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">\u201cEven if it was re-registered as an insurance write-off, once re-registered NZTA do not provide the reason for the original de-registration.\u201d<\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">Osborne said in his view, such scenarios might, broadly speaking, be the result of \u201cquiet repairs\u201d somewhere in a vehicle\u2019s history, without any compliance steps through official processes, leaving potentially a chain of people none the wiser.<\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">When Tilyard approached the dealer to ask for her money back, it was declined so she hired a lawyer who wrote to TCB Autos, seeking to reject the vehicle, which was also declined. <\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">The dealer disputed liability and asked to inspect and repair the vehicle. <\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">The vehicle was collected and a WOF check sheet dated the same day, presented to the tribunal as evidence, showed the vehicle failed for a broken bearing on the mid driveshaft hanger, modification of the left front chassis (for which certification was required) and a park brake issue which required adjustment.<\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">Evidence provided to the tribunal by TCB also included an invoice for $575 showing the hanger bearing had been replaced, plus an invoice for $11,408 for \u201csubstantial panelbeating work\u201d. <\/p>\n<p>Vehicle \u2018rebuilt to factory standard\u2019<\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">Euden said Duckmanton advised at the hearing that the front of the vehicle was effectively \u201crebuilt to factory standard\u201d.<\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">A WOF check sheet dated November 6, 2025, showed the vehicle passed inspection.<\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">Tilyard then filed her application in the tribunal to reject the vehicle.<\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">Euden took into account its age, correspondingly \u201cvery low mileage\u201d, and \u201csignificant price\u201d of $32,000 when assessing if the vehicle was of an acceptable quality when sold.<\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">\u201cThese factors raise the ordinary expectation that, despite its age, the vehicle would be mechanically sound and free from serious defects,\u201d she said.<\/p>\n<p>Tribunal declines claim for legal costs reimbursement<\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">The vehicle\u2019s chassis distortion meant it also failed to meet a threshold of \u201csubstantial character\u201d, resulting in Euden\u2019s end decision which granted Tilyard the right to reject the vehicle.<\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">However, she was not satisfied that the faded recall sticker showing 59,000km proved the odometer reading was inaccurate, or that the vehicle\u2019s mileage was misrepresented. <\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">She said it was plausible that the sticker related to a replacement part rather than the vehicle\u2019s actual distance travelled. <\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">\u201cSimilarly, evidence of a prior frontal collision does not, by itself, amount to a failure of acceptable quality.\u201d<\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">Euden said a 19-year-old vehicle was likely to have a history of repairs, and the Consumer Guarantees Act did not require a vehicle to be free from historical damage, only that it met the standard of acceptable quality at the time of sale.<\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">Tilyard\u2019s claim of $2420 in legal costs was declined.<\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">She said the experience had put her off buying second-hand vehicles, because despite all the checks and balances and having bought through a dealer, she still got caught.<\/p>\n<p class=\"kNVbbmPsnUpLRHJLT\" style=\"display:none\">Brock Duckmanton has been
