Danger of internet\"\/><\/p>\n<p class=\"photo-captioned__information\">\nThe New Zealand government has been exploring online and social media regulation, to combat increasing concerns at social media harm in a variety of forms.<br \/>\nPhoto: 123RF\n<\/p>\n<p>Comment &#8211; Around the world, lawmakers are grappling with how to better protect young people from online harms such as cyberbullying, sexual exploitation and AI-generated <a href=\"https:\/\/theconversation.com\/how-ai-generated-sexual-images-cause-real-harm-even-though-we-know-they-are-fake-273427\" rel=\"nofollow noopener\" target=\"_blank\">&#8220;deepfake&#8221; images<\/a>.<\/p>\n<p>Recent reforms overseas &#8211; notably Australia&#8217;s landmark move <a href=\"https:\/\/www.rnz.co.nz\/news\/world\/581376\/australia-s-social-media-ban-for-under-16s-starts-today-here-is-what-you-should-know\" rel=\"nofollow noopener\" target=\"_blank\">to restrict young people&#8217;s access to social media<\/a> &#8211; have sharpened debate about how far governments should go.<\/p>\n<p>Despite past and current efforts &#8211; including <a href=\"https:\/\/www3.parliament.nz\/en\/pb\/sc\/committees-press-releases\/have-your-say-on-harms-youth-encounter-online-and-what-the-government-business-and-society-should-do-to-tackle-these\" rel=\"nofollow noopener\" target=\"_blank\">a government inquiry<\/a> shortly due to report its final findings &#8211; New Zealand arguably lags other developed countries in tackling a problem that is growing more serious and complex by the year.<\/p>\n<p>In 2026, the question facing the government is whether to cautiously follow overseas models, or to use this moment to develop a response better suited to its own legal, social and cultural context.<\/p>\n<p>What is online harm?<\/p>\n<p>Online harm can take many forms, including <a href=\"https:\/\/www.classificationoffice.govt.nz\/resources\/research\/online-exposure-experiences-of-extreme-or-illegal-content-in-aotearoa\/\" rel=\"nofollow noopener\" target=\"_blank\">exposure to illegal material<\/a>, AI-driven racial bias, and the non-consensual sharing of intimate images. As <a href=\"https:\/\/netsafe.org.nz\/online-abuse-and-harassment\" rel=\"nofollow noopener\" target=\"_blank\">Netsafe highlights<\/a>, online abuse and harassment can unfold across social media, messaging apps, email and text, and often involves repeated or sustained behaviour.<\/p>\n<p>New Zealand&#8217;s legislative response has developed gradually over the past decade. A major step was the <a href=\"https:\/\/netsafe.org.nz\/our-work\/helpline-services\/the-harmful-digital-communications-act\" rel=\"nofollow noopener\" target=\"_blank\">Harmful Digital Communications Act 2015<\/a>, which introduced civil and criminal penalties for serious online abuse and established Netsafe as the approved agency for complaints and dispute resolution.<\/p>\n<p><a href=\"https:\/\/www.rnz.co.nz\/news\/on-the-inside\/584512\/sexualised-deepfakes-on-x-are-a-sign-of-things-to-come-nz-law-is-already-way-behind\" rel=\"nofollow noopener\" target=\"_blank\">Sexualised deepfakes on X are a sign of things to come. NZ law is already way behind<\/a><\/p>\n<p>Since then, governments have attempted broader reform. In 2018, the Department of Internal Affairs launched a wide-ranging regulatory review, followed in 2021 by the <a href=\"https:\/\/www.dia.govt.nz\/media-and-online-content-regulation#About\" rel=\"nofollow noopener\" target=\"_blank\">Safer Online Services and Media Platforms<\/a> review, which aimed to modernise online safety protections and oversight.<\/p>\n<p>However, that process stalled and in May 2024 <a href=\"https:\/\/www.rnz.co.nz\/national\/programmes\/mediawatch\/audio\/2018938976\/media-oversight-one-stop-shop-stopped\" rel=\"nofollow noopener\" target=\"_blank\">the review was terminated<\/a> by Internal Affairs Minister Brooke van Velden. A year later, the government <a href=\"https:\/\/www3.parliament.nz\/en\/pb\/sc\/committees-press-releases\/have-your-say-on-harms-youth-encounter-online-and-what-the-government-business-and-society-should-do-to-tackle-these\/\" rel=\"nofollow noopener\" target=\"_blank\">launched a new inquiry<\/a> into &#8220;the harm young New Zealanders encounter online&#8221;.<\/p>\n<p><a href=\"https:\/\/www.rnz.co.nz\/news\/political\/581442\/social-media-ban-backed-by-online-harm-inquiry-prompting-act-disagreement\" rel=\"nofollow noopener\" target=\"_blank\">Social media ban backed by online harm inquiry, prompting ACT disagreement<\/a><br \/>\n<a href=\"https:\/\/www.rnz.co.nz\/news\/national\/575137\/tech-giants-warn-against-banning-under-16s-from-social-media\" rel=\"nofollow noopener\" target=\"_blank\">Tech giants warn NZ against banning under 16s from social media<\/a><\/p>\n<p>In the meantime, New Zealand&#8217;s fragmented and increasingly outdated regulatory framework is struggling to keep pace with fast-evolving digital risks.<\/p>\n<p>What can NZ learn from other countries?<\/p>\n<p>Many submissions to the government&#8217;s latest inquiry urged New Zealand <a href=\"https:\/\/www3.parliament.nz\/en\/pb\/sc\/submissions-and-advice\/document\/54SCEDUW_EVI_8611cb90-f850-4b63-6bf5-08dda3e61931_EDUW6363\/national-council-of-women-new-zealand\" rel=\"nofollow noopener\" target=\"_blank\">to learn from overseas experience<\/a>, while others noted that not all of those solutions would work at home.<\/p>\n<p>InternetNZ argued that as a small and relatively late mover, New Zealand can &#8220;piggyback&#8221; on reforms in larger markets, so long as it ensured they reflect the country&#8217;s &#8220;unique local context, both socially and practically&#8221;. The Inclusive Aotearoa Collective &#8211; T\u0101hono similarly stressed the need to protect sovereignty.<\/p>\n<p>Others argued New Zealand should draw on its reputation for innovation and develop its own culturally appropriate approaches.<\/p>\n<p>Amokura Panoho of Pou Tangata <a href=\"https:\/\/www.poutangata.com\/onlinesafetyilg\" rel=\"nofollow noopener\" target=\"_blank\">Online Safety<\/a>, for instance, called for updating the Harmful Digital Communications Act to address emerging AI harms such as deepfakes, and creating new M\u0101ori-led reporting pathways tailored for young M\u0101ori to seek help. Advocates argue this could allow New Zealand to anticipate future risks rather than chase them.<\/p>\n<p>Australia&#8217;s move to ban social media for under-16s has loomed large over the inquiry. While France and <a href=\"https:\/\/theconversation.com\/i-research-the-harm-that-can-come-to-teenagers-on-social-media-i-dont-support-a-ban-273835\" rel=\"nofollow noopener\" target=\"_blank\">the United Kingdom<\/a> are considering similar bans, there are concerns blanket age restrictions can be blunt instruments and that young people <a href=\"https:\/\/www.forbes.com\/sites\/paultassi\/2025\/07\/31\/the-uks-internet-age-verification-is-being-bypassed-by-death-stranding-2-garrys-mod\/\" rel=\"nofollow noopener\" target=\"_blank\">often find ways around age-verification systems<\/a>.<\/p>\n<p><a href=\"https:\/\/www.rnz.co.nz\/news\/world\/586025\/two-months-since-australia-s-social-media-ban-began-and-teens-say-it-isn-t-working\" rel=\"nofollow noopener\" target=\"_blank\">Two months since Australia&#8217;s social media ban began and teens say it isn&#8217;t working<\/a><\/p>\n<p>This international focus was reinforced in the inquiry&#8217;s interim report, which drew heavily on models from Australia, the UK, Ireland and the European Union. But submitters also pointed to other lessons, including the UK&#8217;s Internet Watch Foundation, South Korea&#8217;s online safety framework and <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=202120220AB2273\" rel=\"nofollow noopener\" target=\"_blank\">California&#8217;s youth privacy laws<\/a>.<\/p>\n<p>A further complication is that many international reforms remain largely untested. Australia&#8217;s Online Safety Act is still being rolled out in phases, while the EU&#8217;s <a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/policies\/digital-services-act\" rel=\"nofollow noopener\" target=\"_blank\">Digital Services Act<\/a> only entered full force in early 2024. As a result, evidence about their effectiveness remains limited.<\/p>\n<p>The case for a national regulator<\/p>\n<p>One of the clearest options emerging from the inquiry is the creation of a national online safety regulator: a model already adopted in several comparable countries, including Australia, the UK and Ireland.<\/p>\n<p>In the UK, communications regulator Ofcom oversees the <a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/2023\/50\" rel=\"nofollow noopener\" target=\"_blank\">Online Safety Act 2023<\/a>, while Australia&#8217;s eSafety Commissioner was granted expanded powers under the Online Safety Act 2021.<\/p>\n<p>A 2021 Department of Internal Affairs report <a href=\"https:\/\/www.dia.govt.nz\/diawebsite.nsf\/Files\/online-content-regulation\/%24file\/International-Regulatory-Frameworks-for-Online-Content-Report.pdf\" rel=\"nofollow noopener\" target=\"_blank\">concluded that a central regulator in New Zealand could streamline oversight<\/a>, provide a single point of contact and improve enforcement. The inquiry&#8217;s interim report reached a similar conclusion, pointing to the benefits of coordinated regulation and proactive &#8220;safety by design&#8221; rules.<\/p>\n<p>But reform has been slowed by political caution, particularly around concerns about freedom of expression. The government&#8217;s preference for light-touch regulation has left gaps &#8211; notably in addressing emerging harms such as <a href=\"https:\/\/theconversation.com\/sexualised-deepfakes-on-x-are-a-sign-of-things-to-come-nz-law-is-already-way-behind-273562\" rel=\"nofollow noopener\" target=\"_blank\">sexualised deepfakes<\/a> &#8211; prompting ACT MP <a href=\"https:\/\/www.rnz.co.nz\/news\/political\/576768\/bill-to-criminalise-explicit-deepfakes-pulled-from-ballot\" rel=\"nofollow noopener\" target=\"_blank\">Laura McClure&#8217;s member&#8217;s bill<\/a> aimed at closing some of those loopholes.<\/p>\n<p><a href=\"https:\/\/www.rnz.co.nz\/news\/national\/583838\/we-can-t-rely-on-goodwill-nz-lags-behind-on-battling-ai-creation-of-sexual-images\" rel=\"nofollow noopener\" target=\"_blank\">&#8216;We can&#8217;t rely on goodwill&#8217; &#8211; NZ lags behind on battling AI creation of sexual images<\/a><\/p>\n<p>The inquiry&#8217;s final report, and the government&#8217;s response to it, offer a rare opportunity to reset direction. The challenge will be to move beyond piecemeal reform and design a system capable of keeping pace with rapid technological change, while placing the voices of young people and M\u0101ori at its centre.<\/p>\n<p>* Claire Henry is an associate professor in screen at Flinders University, Adelaide.
